WHEREAS, it is a condition of the issuance of a Grading/Public Improvements permit by the Department of Engineering of the City of Frederick, Maryland, acting for and on behalf of said City of Frederick, these presents should be executed. NOW, THEREFORE, the condition of this obligation is such: 1. That the permittee and/or subdivider, his agents and servants will faithfully complete the construction and installation of the required public facilities in accordance with the terms and requirements of the Public Works Agreement executed; and. 2. That the permittee and/or subdivider, his agents and servants will comply with all the applicable ordinances and requirements of the City of Frederick; and 3. That the permittee and/or subdivider, his agents and servants will save and hold harmless the City of Frederick, and their employees and agents from any claims, actions, expenses, of whatever nature, arising out of or incurred through the failure of the permittee and/or subdivider, his agents and servants, to complete the required public facilities, or from any damages growing out of the negligence of the permittee and/or subdivider or his agents or servants. 4. That the permittee and/or subdivider, his agents and servants and the surety hereby consent to jurisdiction in the Circuit Court for Frederick County, Maryland in the event of litigation. 5. This obligation shall remain in full force and effect until the work described in the application has been approved and accepted by the Mayor and Board of Aldermen of the City of Frederick, Maryland.
