BACKGROUND Title VI and EJ Legislation and Regulations Environmental Justice comes from Title VI of the Civil Rights Act (1964). Section 601 states, No person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. Section 602 of Title VI requires each federal department and agency to issue rules or regulations to ensure that programs and activities are in compliance with Title VI goals. Environmental Justice (EJ) comes from an Executive Order (EO) 12898 signed in February 1994. It is a Federal Action that addresses the effect of all programs, policies, and activities on minority and low-income (MLI) populations. The three main principles of EJ are to avoid or minimize high and adverse human health, environmental, social, and or economic effects on MLI populations; ensure full and fair participation of all potentially affected communities in the transportation decision-making process; and to prevent denial of, reduction in, or significant delay in the receipt of benefits by MLI populations. Department of Transportation Order (DOT) 5610.2 was issued in response to the EO 12898, which set forth policies to address EJ concerns in the early administration and development of transportation programs, policies and activities. Federal Highway Administration followed DOT s Order with Order 6640.23. MISSION AND POLICY A mission of the WSMPO is to enforce the 1964 Title VI Civil Rights Act as its own policy, which states, No person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. The MPO will ensure to implement and practice the three main principles of Environmental Justice: 1) Avoid or minimize disproportionate and adverse human health, environmental, social, and or economic effects on MLI; 2) Ensure full and fair participation of all potentially affected communities in the transportation decision-making process; 3) Prevent denial of, reduction in, or significant delay in the receipt of benefits by MLI populations. In the context of EJ, disproportionate and adverse effects are defined as unfavorable effects that minority and low-income populations predominately experience. They are typically more severe and or greater in magnitude than the adverse effects suffered by non-minority and or non low-income populations. The MPO will work through compliance goals and planning process goals to conduct population identification, process documentation, and benefit/burden assessments in order to identify and avoid disproportionately high and adverse effects on minority and low-income populations. 2035 Winston-Salem Urban Area LRTP Environmental Planning Environmental Justice Plan - 2

GOALS Compliance Goals To certify compliance with Title VI and address EJ, it is requested of the MPO to do the following: Enhance analytical capabilities to ensure that the long-range transportation plan and the transportation improvement program (TIP) comply with Title VI. Identify residential, employment, and transportation patterns of MLI populations so that their needs can be identified and addressed, and the benefits and burdens of transportation investments can be fairly distributed. Evaluate and improve, where necessary, public involvement processes to eliminate participation barriers and engage MLI populations in transportation decision making. Planning Process Goals With the inception of Title VI and EJ, greater emphasis has been placed on effective transportation decision-making and coordinating the unique needs of different socioeconomic groups. The MPO s planning process goals of addressing EJ during the transportation decision making process will: Make better transportation decisions that meet the needs of all people. Design transportation facilities that fit more harmoniously into communities. Enhance the public-involvement process, strengthen community-based partnerships, and provide MLI populations with opportunities to learn about and improve the quality and usefulness of transportation in their lives. Improve data collection, monitoring, and analysis tools that assess the needs of, and analyze the potential impacts on MLI populations. Partner with other public and private programs to leverage transportation-agency resources to achieve a common vision for communities. Avoid disproportionately high and adverse impacts on MLI populations. Minimize and or mitigate unavoidable impacts by identifying concerns early in the planning phase and providing offsetting initiatives and enhancement measures to benefit affected communities and neighborhoods. MINORITY AND LOW INCOME POPULATION IDENTIFICATION Minority Persons and Populations DOT Order 5610.2 and FHWA Order 6640.23 specifically define a minority as a person who is: American Indian and Alaskan Native - a person having origins in any of the original people of North America and who maintains cultural identification through tribal affiliation or community recognition Asian American - a person having origins in any of the original peoples of the Far East, Southeast Asia, the Indian subcontinent, or the Pacific Islands Black - a person having origins in any of the black racial groups of Africa Hispanic - a person of Mexican, Puerto Rican, Cuban, Central or South American or other Spanish culture or origin, regardless of race Note: For WSMPO purposes and analysis, the Hawaiian Pacific Islander population has been separately identified. 2035 Winston-Salem Urban Area LRTP Environmental Planning Environmental Justice Plan - 3

DOT and FHWA do not define any percentage thresholds for defining a minority population. FHWA guidance does indicate that a minority population cannot be eliminated from consideration because it is very small in size. In the WSMPO area, American Indian, Asian, and Hawaiian Pacific Islander populations have been individually identified and mapped in addition to Black and Hispanic. However, their combined population is less than 2% and therefore, additional analysis has not been incorporated into this document. Data may be made available upon request. Low-Income Persons and Populations A Low Income person is defined as a person whose median household income is at or below the US Department of Health and Human Services poverty thresholds. See Table 3: Poverty Thresholds by Size of Family and Number of Related Children Under 18 Years. WS MPO MLI Demographics A recommendation from the 2004 Certification Review was to identify MLI populations. This has been completed graphically using 2000 Census data provided at the block level and aggregated up to the Traffic Analysis Zone level. The accompanying maps and spreadsheets are provided as a guide for project planning, implementation, and EJ coordination. The maps include identification of American Indian, Asian, Black, Hawaiian Pacific Islander, Hispanic and Low Income populations by Traffic Analysis Zones. There is also an overall TAZ map, population summary sheets, and Black, Hispanic, and Low Income population summary tables. The summary tables are sorted by percent with the Black Summary Table beginning at 10%, the Hispanic beginning at 6%, and the Low Income beginning at 10.00%. As previously mentioned, the data used for determining the WSMPO MLI demographics was provided by the US Census Bureau. The data was provided at the block lever, which allows for detailed analysis at the TAZ level. However, data provided by Caliper Corporation displays current and future estimates and projections for the MPO s MLI populations. See Table 2: WSMPO Estimates and Projections. In the table, the 2000 information was provided in the census shapefile format and the 2006 and 2008 data are Caliper estimates and projections, respectively. TRANSPORTATION PLANNING APPLICATIONS The MPO works to not only consider EJ populations on a project by project level but to incorporate EJ in all transportation processes including the development of the MPO s work program. Unified Planning Work Program Title VI and EJ actions listed in the Unified Planning Work Program (UPWP) identifies the MPO s plans to make improvements to existing activities. The following are current EJ and Title IV related task categories listed in the WSUA UPWP. This document is updated annually. III-C-1 Title VI Provide update of Civil Rights Statistics Report to FTA to determine MPO compliance with Civil Rights provisions. III-C-2 EJ Plan/implement recommendations from Federal Triennial Review; Update maps and materials on locations of minority and low-income (MLI) populations from 2000 US Census; Develop EJ plan and General Public Opinion Survey; Identify service inequities; Attend training as needed; Develop a position or policy statement regarding Title VI and EJ; Include EJ in project selection process Long Range Transportation Plan and Transportation Improvement Program The development of the Long Range Transportation Plan (LRTP) and the Transportation Improvement Program (TIP) is an appropriate time to ensure MLI populations are involved in the planning process. The WSMPO LRTP contains an EJ section which is a summary of this document. It identifies the MPO s policy on Title VI and EJ, the MPO s compliance goals, and a variety of maps locating high density MLI populations with LRTP Projects. Also included in the LRTP is the WSUA Fiscally Constrained Transportation Plan 2007-2035 Street and Highway table (Appendix A), which cross-references the LRTP projects with affected low-income, Black and Hispanic traffic analysis zones. The table identifies if the project is located in an EJ area with a tier designation of EJ-I, EJ-II, or EJ-III. The tiers represent the level of public participation outreach techniques that shall be used for projects that are located in an identified MLI population area. An explanation of the tiers is listed in the Public Participation section on page 33. The following figures and tables depict the analysis of LRTP projects with MLI populations and their corresponding traffic analysis zones (TAZ). They are a representation of how Title VI and EJ are included in the development of the LRTP and TIP. In the WSMPO area, American Indian, Asian, and Hawaiian Pacific Islander populations are previously identified and mapped in addition to Black and Hispanic populations. However, the combined population for American Indian, Asian, and Hawaiian Pacific Islander is less than 2%; therefore, additional LRTP analysis has not been incorporated into this document. Certification Review In August of 2004, the Winston-Salem Urban Area MPO received its first certification review with Title VI and EJ as important elements to the review. One commendation and seven recommendations were provided by FHWA as a result of the review. The list of recommendations and a status for each recommendation is provided in Appendix B. Transit Planning In order to comply with the requirements for obtaining Federal Transit Authority (FTA) Capital and Operating Assistance, the Winston-Salem Transit Authority (WSTA) performs an annual Title VI Assessment. The objectives included in the Title VI Assessment cover goals of service equity, access mobility, public participation, and corrective actions to prevent discriminatory treatment all without regard to race, color, or national origin. WSTA also undergoes a triennial FTA Certification review. This certification review includes the necessity for WSTA to comply with Title VI and EJ regulations. In 2005 with the inception of SAFETEA-LU, a federal mandate was established to require that a human service transportation coordination plan be developed by transportation providers. The objective of this requirement is to afford elderly citizens, persons with disabilities, and low income populations greater access to transportation services. In March 2008, the MPO completed and adopted the Winston-Salem Urban Area Human Services Transportation Plan. The plan identifies the disabled, elderly, and low income populations within the MPO and it utilized an extensive public involvement process to develop guiding principles, strategies, and recommendations for funding and coordinating transportation services. Service Equity The MPO s analytical process for assessing service equity for EJ populations is currently included in the project selection process by adding an EJ category to the project ranking table and to the LRTP Street and Highway Table. Additionally, the MPO will consider analyzing the following to determine service equity based on two categories: Maintenance Pavement Management System Street, sidewalk, and lighting repair Safety Program improvements deficient sidewalk New Service Bond project selection process Highway vs public transit capital cost sidewalk in MLI Annual Capital Improvement Program WSTA monitors its service equity and quality by using a number of measures identified in its Title VI Assessment. These measures include Load Factors, Vehicle Assignment Records, a Travel Time Matrix, and an overview of the Fixed Route System. Most of these measures identify which routes are minority and non-minority. PUBLIC INVOLVEMENT Public Participation Policy Public participation as it relates to all transportation processes is based on the WSUA MPO s Public Participation Policy adopted September 2007. The policy recognizes the need to meet EJ requirements. It includes public outreach strategies, for during the adoption of plans policies, and programs, such as the distribution of notices to MLI populations through community organizations, community leaders, and minority news media. Public Participation Outreach Tiers/Techniques An additional way that the MPO is responding to Title VI and EJ in the Transportation Planning Process Project development is by developing a tiered approach for public involvement to encourage more participation from MLI populations. This tiered approach is applied specifically to Black, Hispanic and Low-Income populations. Tier I Advertise in Minority targeted media such as the Winston-Salem Chronicle, and Que Pasa. Distribute public outreach information through community organizations and community leaders. Tier II In addition to Tier I, identify minority stakeholders and community institutions and provide personal invitations to attend and participate in the project selection, scoping, and planning processes. Work with elected officials to identify the stakeholders. Tier III In addition to Tiers I and II, plan meetings to be held at times and in locations that are most accommodating to the affected populations; offer child care by soliciting request in advertisements and notifications; offer round trip transportation; provide snacks/meals; and intensify presentation visual aids. Inclusion of MLI populations in the public participation process and project impact analysis shall be conducted on a project-by-project case by the project manager, whether it be MPO staff, NCDOT, or a consultant. The project manager shall use this EJ plan as a reference and guide for complying with the MPO s policy. Transportation Survey In order to identify the needs of MLI populations in the MPO area, the WSDOT distributed a Transportation Services Survey by various methods. The purpose of the survey was to give citizens an opportunity to share their thoughts about the transportation services and to encourage more citizen participation in the transportation planning and development process. To encourage MLI participation, the survey was personally distributed at ten scheduled sites located in high density MLI areas and through nine MLI interest groups. To accommodate the Hispanic communities, a Spanish version of the survey was made available and Spanish interpreters were employed to assist in various capacities. The detailed process is included in a summary report in Appendix C. The MPO plans to provide similar surveys at all public meetings to continually evaluate the services provided and to regularly obtain input on its planning processes and activities. 2035 Winston-Salem Urban Area LRTP Environmental Planning Environmental Justice Plan - 37

LIMITED ENGLISH PROFICIENCY In 2001, a supplementary survey conducted by the US Census Bureau identified that 33% of Spanish speakers and 22.4% of Asian and Pacific Island language speakers reported that they spoke English not well or not at all. With the limited ability to read, write or speak English they are considered limited English proficient (LEP). To ensure that LEP persons may effectively participate and benefit from federally funded programs, Executive Order 13166 was issued under Title VI by President Clinton in August 2000, which requires recipients of federal assistance to provide meaningful access to LEP populations. In order to comply with Executive Order 13166, the WSTA developed a Limited English Proficiency Plan in December 2005. The plan ensures equal access to transit related services for LEP populations through needs assessment, assistance measures, training, and monitoring. The Limited English Proficiency Plan identified as part of its needs assessment that Winston-Salem had a Hispanic population of 20,249 based on 2000 Census Data. It identifies assistance measures such as Oral Language Interpretation and Written Language Interpretation. Training measures include an employee incentive program to learn a foreign language, plans to implement an informative DVD on LEP issues and sensitivity training, and plans to introduce the use of pocket translators. For monitoring purposes the plan identifies that a review of effectiveness will be conducted each August and will include corrective actions and strategies. The plan can be found in Appendix D. FUTURE INITIATIVES Identify evaluation measures and benchmarks and provide a biannual report card. Map completed projects for past 10 years with MLI populations. Determine the level of public knowledge and awareness by working with a citizen advisory group. Identify business centers within MLI populated areas. Perform travel time studies to determine if there are any inequities for major destinations such the hospital or key shopping area.
