AMENDMENT APPLICATION FORM Application Form for Amendment of Environmental Authorisation and Environmental Management Programme in terms of National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended and the Environmental Impact Assessment Regulations, 2014 Application Reference Number: NEAS Reference number: Date Received: For official use only Kindly note that: 1. This application form is current as of December 2014. It is the responsibility of the applicant to ascertain whether subsequent versions of the form have been published or produced by the competent authority. 2. This form must be used to apply for the amendment of an environmental authorisation or Environmental Management Programme. An amendment includes adding, substituting, removing or changing a condition or requirement, updating and changing details and correcting a technical error. 3. An amendment application for an Environmental Authorisation is only provided for in law if the Environmental Authorisation is still valid. The subject amendment application should thus be submitted at least 3 months prior to the expiry of the validity period of an Environmental Authorisation; failure to submit the amendment application within the said period prior to the expiry of the validity period of an Environmental Authorisation may result in the competent authority not being able to process the application for amendment in time and thus resulting in the lapsing of the Environmental Authorisation 4. No amendment to a valid Environmental Authorisation is provided for in terms of the 2014 EIA Regulations, if such amendments applied for will constitute a listed or specified activity; in this case an application for Environmental Authorisation for listed or specified activity in terms of Chapter 4 of the EIA Regulations, 2014. 5. A copy of the Environmental Authorisation and /or approved Environmental Management Programme (EMPr) which is the subject of the amendment application must be submitted together with this form. 6. An application for amendment lapses if the applicant fails to meet any of the timeframes prescribed in terms of the 2014 EIA Regulations. If authorisation is required from a number of different authorities, the authorities might also require that an integrated process be followed. 7. The application must be typed within the spaces provided in the form. The sizes of the spaces provided are not necessarily indicative of the amount of information to be provided. Spaces are provided in tabular format and will extend automatically when each space is filled with typing. 8. The use of the phrase not applicable in the form must be done with circumspection. Should it be done in respect of material information required by the competent authority for assessing the application, it may result in the refusal of the application. 9. Three copies of this form must be submitted at the offices of the relevant competent authority as detailed below. 10. No faxed or e-mailed applications shall be accepted. Only hand delivered, couried or posted applications will be accepted 11. 7 AMENDMENTS APPLIED FOR IN TERMS OF PART 1 AMENDMENT PROCESS Describe the amendments being applied for and motivation as to why the amendments are required,. Amendment requested An Amendment to the description and site layout plan for the upgrade of the Cavalier Abattoir is requested. Reason why amendment is required The applicant proposes relocating the administrative building from its current location to another site on the property. The new site will include all administrative and office related activities which do not require direct access into the abattoir building itself. This will ensure that the biosecurity at the abattoir will not be affected by staff, visitors nor vehicles that have no direct reason for being in the working areas of the abattoir. The new site is still located on Portion 83 of 288 Tweefontein. Please see the attached Location Plan for site coordinates. The new admin building site will be approximately 4100m² in size. Figure 2: Location of proposed new administrative building Please provide reasons why the amendment will not change the scope of Environmental Authorisation, why the amendment will not increase the level or nature of impact, which impact was assessed and considered when application was made for an Environmental Authorisation and as well as how such impact will affect the Interested and Affected Parties The amendment proposes the relocation of the administrative building from its original site as per the existing EA to another location on the property. Undertaken alone, the construction of the new premises will not require Environmental Authorisation from GDARD, however, given its relevance to the abattoir and subsequently the approved EA, it has been recommended that this Amendment Application be completed. The impact of the premises has been evaluated (see Specialist Report in Annexure 6) in terms of fauna and flora and the ratings have been determined to be Low. Some mitigations have been recommended as part of Best Practice Principles. Not granting amendment: Not granting the amendment will have no further impact on the environment than those identified for the abattoir upgrade.
