HENRY COUNTY FISCAL COURT REGULAR MEETING SEPTEMBER 18, 2007 The Henry County Fiscal Court met in a regular session on September 18, 2007 at the Courthouse in New Castle, Kentucky with the following in attendance: Honorable John L. Brent, Judge Executive Honorable Peggy V. Bryant, Deputy Judge Executive Honorable Virginia Harrod, County Attorney Esquire Jerry Beasley Esquire David Brown Esquire Guy Coombs Esquire Mike Fisher Esquire Wayne Gunnell Esquire Nick Hawkins RE: PLEDGE OF ALLEGIANCE Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag. RE: PRAYER & PREPARATION Silent prayer was observed in preparation for the meeting. RE: CALL TO ORDER Judge Brent called the meeting to order and noted everyone was present. RE: APPROVAL OF MINUTES Upon motion by Esq. Beasley and seconded by Esq. Hawkins, it is ordered by the Court to approve the minutes from the August 21, 2007 regular meeting. RE: OLD BUSINESS RE: PUBLIC HEARING AND 2 ND READING OF 2007/2008 TAX RATES Judge Brent opened the meeting to the public for comments on the 2007/2008 tax rates. There being no comments Judge Brent called for a vote. Upon motion by Esq. Brown and seconded by Esq. Hawkins, it is ordered by the Court that the County tax levy remain the same as last year at 11.7 per hundred dollars on all real property in

Henry County, 15.9 per hundred dollars on all personal property in Henry County, and 11.9 per hundred dollars on all vehicles and watercraft for 2007. RE: SECOND READING OF THE FIVE YEAR SOLID WASTE PLAN 1. Committee Report Judge Brent reported the County had received a letter from the State saying we are in compliance with our Solid Waste Plan, which is good news. The committee met on the 5 year plan and reported only one major change and that was the intention of making those who own rental property be responsible versus the renter for the garbage bill. Judge Brent noted this was at his suggestion as many times the renter moves and leaves an unpaid bill. Esq. Beasley and Esq. Fisher expressed their concerns about this change. Judge Brent stated this issue would be addressed in 2008 when the garbage comes up for bid again. 2. Adoption by Resolution Judge Brent read the Resolution to the Court and then called for a vote. Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to adopt the Area Solid Waste Management Plan. RE: NEW BUSINESS RE: ROADS 1. Supervisor Update Henry County Road Supervisor Glenn Baxter noted the road department was basically through blacktopping this year and they came in under budget. Glenn had received a request from Esq. Hawkins to do a project on Flatrock Road at a cost of less than $4000.00. Glenn reminded the Court of the dates for the metal recycle and tire amnesty collection. Esq. Gunnell requested weight restriction signs be posted on Giltner Road as semi-trucks are still crossing it. 2. Flatrock Request-Magistrate Nick Hawkins Esq. Hawkins explained to the Court that he was not aware of the need for this blacktopping when he designated the projects he wanted for his district in this year s resurfacing budget. He would like to request this project since we were under budget and the money is there. Upon motion by Esq. Hawkins and seconded by Esq. Fisher, it is ordered by the Court to improve Flatrock Road s first stretch of blacktop.

3. Establishment of Committee to Address Road Adoption/Closure Policies Judge Brent suggested the Court establish a Committee to address the road adoption/closure policies. He noted the Court does not have set guidelines to help in making these decisions. The committee will consist of Glenn Baxter, Virginia Harrod, Esq. Beasley, Esq. Fisher, and Esq. Hawkins. 4. Upper Bolin Branch Road Request-Tabled Motion Judge Brent reminded the Court of last month s road request to maintain Upper Bolin Branch Road. He asked if there was a motion to take the issue off the table for discussion. Upon motion by Esq. Hawkins and seconded by Esq. Coombs, it is ordered by the Court to take off the table the decision to maintain the upper section of Bolin Branch Road. Judge Brent gave the public the opportunity to offer input regarding the road. Donna Grant who resides on the adjoining road of Hickory Corner stated she did not want this road maintained and passable. She noted when the road was passable she had problems with folks coming to her door at all hours of the night and noise from 4-wheelers. Pam Beck who is a property owner in this area stated she opposed maintaining the road as 4-wheelers had been a problem for her as well. Reba Rye and her family stressed their desires to maintain this road so it is passable in case of an emergency. Henry County Road Supervisor Glenn Baxter noted Judge Brent and every Magistrate had traveled the road. He estimated the cost for materials and rock was $30,000.00 to get started and $50,000.00 plus to make the road passable. After much discussion Esq. Fisher asked to withdraw his motion from the previous meeting to maintain this road noting the high cost. Judge Brent accepted the withdrawal of the motion. RE: EMS/PARAMEDICS 1. Supervisor Update Judge Brent gave an update to the Court. He noted all is going well with the EMS/Paramedic Service. Software Development Inc. (SDI) has new rates for the coming year and Scott recommends the Court adopt these new Medicare rates. 2. Proposed New EMS BLS/ALS Rate (Medicare/Medicaid Allowables) Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court to accept the new EMS BLS/ALS proposed rate. Yes-Brown, Coombs, Fisher, Gunnell, Hawkins No- Beasley Motion carried

RE: CELL PHONE TOWER COMMITTEE UPDATE Judge Brent informed the Court that two sites have been chosen for the location of the cell phone tower and he felt all was a go. Virginia Harrod reported she is working with the attorney from Verizon to approve the contract. Esq. Hawkins suggested the Court split the revenues received from the rent on the cell tower 50/50 with the fair and parks accounts. He noted the proceeds from the Henry County Fair were down. The Court discussed the expenses of the fairgrounds and the sources of income that are given to that account. Esq. Hawkins made a motion to split the revenues collected from rent of the cell phone tower 50/50 with the fair and park accounts. After some discussion Esq. Hawkins noted his involvement with the Lions Club may be a conflict of interest so he withdrew the motion. Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court that all rental from the 4-H Building go in the fair account. RE: LIBRARY BOARD APPOINTMENTS- BETTY WILSON & NANCYE CHILTON RECOMMENDATIONS Upon motion by Esq. Beasley and seconded by Esq. Coombs, it is ordered by the Court to accept the recommendations for Library Board Appointments of Betty Wilson and Nancye Chilton. RE: OLDHAM COUNTY AIRPORT UPDATE Barbara Campbell informed the Court that she had made several calls for information on the Oldham County Airport but at present time she has no new information. Judge Brent noted at the last scheduled meeting they did not have a quorum and he would check with the Oldham County Judge Executive for an update. RE: GENERAL FUND TO FAIR FUND CASH TRANSFER REQUEST Judge Brent reviewed the fair fund account with the Court. He noted we have not over spent the budget we just haven t received the anticipated cash from the ADF funds at the present time. He requested the Court approve the cash transfer of $19,200.00 from the general fund to the fair fund. Judge Brent noted when we receive the ADF funding of $19,200.00 it will be paid back to the general fund. Upon motion by Esq. Hawkins and seconded by Esq. Gunnell, it is ordered by the Court to do a cash transfer of $19,200.00 from the general fund to the fair fund.

RE: CLAIMS & TRANSFERS Upon motion by Esq. Beasley and seconded by Esq. Hawkins, it is ordered by the Court to approve the following claims and transfers: General Fund $191,785.81 Road & Bridge 148,401.01 Jail 38,517.72 LGEA Fund 200.00 Federal Grant Fund 45.00 Litter Grant Fund 891.48 911-EMS Fund 6,414.94 CDBG Grant/Sr. Project 149,327.50 Fair Fund 6,382.26 Total Expenditure $541,965.72 RE: COURT COMMENTS Transfers From: 01-9200-999 (Reserve for Transfers) To: 01-9100-599 (Miscellaneous) $1,000.00 From: 80-9200-999 (Reserve for Transfers) To: 80-9400-201 (Social Security) 861.00 Eminence Mayor Jim Pettit thanked the Court and the Henry County Sheriff s Department for their support of the Apollo Choppers Event. He invited everyone to come to the Renaissance on October 31 st for their Halloween Festival. Esq. Brown suggested Glenn Baxter might want to go to Frankfort for the State Surplus Property Sale. RE: ADJOURNMENT Upon motion by Esq. Beasley and seconded by Esq. Coombs, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
