On June 19, 2017, the Regional Municipality of Durham approved Amendment No. 107 to the Municipality of Clarington Official Plan ("OPA 107"). Oral submissions were made to the Special Planning and Development Committee of the Municipality of Clarington on October 24 1,, 2016. An oral deputation (3.20 in the Meeting Minutes) and a written submission (#WS-86) were also made in regards to Report PSD-060-16, respectfully disagreeing with Staff's recommendations to designate the Subject Site as Environmental Protection under proposed Clarington OPA 107. On behalf of Mr. R. Wannack we are appealing the OPA 107 designation of Environmental Protection, and requesting that a site-specific assessment be conducted to determine the significance of the wooded area and potential wetland on the Subject Site. Under the recently amended Municipality of Clarington Official Plan (2014), the Subject Site was designated as Green Space outside of the Urban Area Boundary for both Courtice and Bowmanville. Under this Official Plan (2014), areas designated Green Space were intended to link other significant components of the Municipality's Open Space System, including the Natural Core Area, Natural Linkage Area, the Lake Ontario Greenway and stream valleys. These areas are also intended to function as urban area separators. Under OPA 107, the Subject Site is designated Environmental Protection. In the Plan more generally, the Green Space designation was removed and replaced by more detailed designations of predominantly Rural, Prime Agricultural Area, Environmental Protection, Natural Core Area and Natural Linkage Area. THE BIGLIERI GROUP LTD. 2 significant components of the Municipality's natural environment, and are to be preserved and protected from the effects of human activity. Based on Ministry of Natural Resources and Forestry (MNRF) mapping, the Subject Site is designated as a Provincially Significant Wetland (PSW). In order for lands to be considered a PSW, an evaluation under the Ontario Wetland Evaluation System (OWES) must be completed. In accordance with the OWES Southern Ontario Manual (2014), evaluations must include ground-truthing. The manual states, "In all cases, field checking is necessary to determine the presence of wetlands." Mr. Wannack has not been notified or aware of any field visits by representatives of MNRF, the Municipality of Clarington or the Central Lake Ontario Conservation Authority (CLOCA). Mr. Wannack has noted that upon purchase of these lands in 197 4, the Subject Site was actively farmed for agricultural crop production and did not exhibit any characteristics of a wetland. This also confirms that the wooded area on the Subject Site. is not considered old-growth forest. The Environmental Protection designation under OPA 107 should not be expanded onto the Subject Site based solely on high-level mapping studies. It is our respectful opinion, that a site-specific assessment should be conducted to justify the Environmental Protection designation on the Subject Site. We are planning on conducting a site staking exercise of the Subject Site in late July 2017 with MNRF, CLOCA and our retained Environmental Consultant, and therefore, are open to mediation with the Municipality of Clarington in regards to this appeal. Enclosed with this Notice of Appeal is a certified cheque in the amount of $300.00, payable to the Minister of Finance, representing the filing fee associated with processing this appeal along with the 0MB Appeal form. In addition, please find enclosed authorization from Robert Wannack for The Biglieri Group to submit this Notice of 0MB Appeal on his behalf, in addition to a copy of the Continuing Power of Attorney for Property- General, giving Robert Wannack power of attorney for the Subject Site owner Gerhard Wannack.
