CIRCUS CIRCUS - RENO 24-HOUR MURAL MARATHON CONTEST OFFICIAL RULES NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS INTENDED FOR THOSE WHO QUALIFY IN THE UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY, EXCEPT WHERE PROHIBITED BY LAW AND WILL BE GOVERNED BY NEVADA LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND NOT LOCATED IN THE UNITED STATES OR THE DISTRICT OF COLUMBIA AT THE TIME OF ENTRY. ELIGIBILITY: CIRCUS CIRCUS - RENO MURAL CONTEST (the Contest ) is open only to individuals who are legal residents of the United States or the District of Columbia, twenty-one (21) years or older at the time of entry. Employees, officers, directors and representatives of CC-Reno, LLC., and teach of its respective parent and affiliate companies, divisions and advertising/promotion agencies involved in the Contest as well as the immediate family (spouse, parents, siblings and children and each of their respective spouses, children and siblings) and household members of each of the above are not eligible to enter or win. Subject to all applicable federal, state, and local laws and regulations. Void outside the United States and the District of Columbia, and where prohibited by law. Participation constitutes entrant s full and unconditional agreement to these Official Rules and sponsor s decisions which, subject to NRS 463.362, are final and binding in all matt related to the Contest. Winning and receiving a prize is contingent upon fulfilling all requirements set forth herein. SPONSOR: Circus Circus - Reno, 500 N. Sierra Street, Reno, NV 89503 ENTRY PERIOD: Entry period to be selected for the contest begins at 12:00 a.m. March 23, 2018 and ends at 12:00 a.m on April 30, 2018 (the Promotion Period ). Sierra Arts Foundation computer is the official time-keeping device for the contest. If you are selected, the completion phase of the Contest will occur June 30 - July 1, 2018. HOW TO ENTER: Each individual may submit no more than two (2) concepts. Each concept submitted need not be fully completed work, but should illustrate clearly to the selection committee what your finished piece would look like. Each entrant is required to provide name, address, contact information and a biography or artist statement. You
need to provide three (3) samples of your past work along with up to two (2) concepts. The entry should be submitted electronically using Wetransfer.com to eric@sierra-arts.org. Alternatively, it may be mailed to the attention of Eric Brooks, Sierra Arts Foundation 17 S. Virginia St. Ste. 120 Reno, NV 89501. You are responsible for delivery of your entry package within the entry period. PROPOSED NAME GUIDELINES: The proposed concepts must be original and entry may not contain material that violates or infringes any third party s rights, including but not limited to privacy, publicity, or intellectual property. The entry must not contain or be confusingly similar to any third party s product names, brand names, or trademarks. The entry must not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, or libelous. The entry must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age. The entry must not contain material that is unlawful, in violation of the laws or regulations in any state where the entry is created. Sponsor is not responsible for late, lost, mis-directed, or invalid entries. Once you submit your entry, you will be officially entered into the Contest. Entries cannot be revised or altered once submitted. Once submitted, all submitted components become the property of the Sponsor. Automated means of entry and entries by any means which subvert the entry process are prohibited and all such entries will be void. PRIZE: Grand prize for the winning entry is Three Thousand Dollars ($3,000.00), and a certificate of recognition. Second Place will receive Two Thousand Dollars ($2,000.00) and Third Place will receive One Thousand Dollars ($1,000.00). The total value of all prizes is Six Thousand Dollars ($6,000.00) ODDS: The odds of winning the prize depend on the number of entries to the Contest. INITIAL SELECTION: After close of the Entry Period, a panel of judges consisting of art leaders, members of the Artown Board, and members of select Downtown Reno businesses, including Sponsor ( Committee ), will review the concepts and select up to seven (7) Artists to compete for the prizes totaling $6,000.00. Selection of the seven Artists is in the sole and absolute discretion of the Committee. If you are selected, you will be requested to paint a mural nineteen feet seven inches (19 7 ) wide by fourteen feet (14 ) tall on an area of Sponsor s building as selected by Sponsor. You shall be required to provide all materials, supplies and tools including ladder, scaffold or lift to enable you to paint the mural on the building. All muralists will be provided a hotel room
for 3 nights, a $750.00 stipend for materials, and $50.00 per day in food credits to use during the competition. WINNER NOTIFICATION AND ACCEPTANCE: There will be three (3) winners. The winners will be notified in person at the mural location on Virginia Street in Reno, Nevada, at 12:00 p.m. on July 1, 2018 or through contact information the contestant provides to Sponsor. The winning mural will be chosen by the same method as used to select the Artists painting the murals in the sole and absolute discretion of the committee. The winner is solely responsible for the reporting and payment of any taxes on the prize. Each winner may waive his or her right to receive the prize. Prizes are non-assignable and non-transferable. All costs and expense not specified are the sole responsibility of the winner. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. Sponsor reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest. ASSIGNMENT OF RIGHTS TO MURALS: The Artist retains all intellectual property rights including, without limitation, all trademark and copyright in the mural. The Artist agrees to grant Sponsor a license to reproduce, display, distribute, sell, and create derivative works of the mural. LATE, LOST, & MISDIRECTED ENTRIES: Sponsor reserves the right to permanently disqualify from this Contest any person it believes has violated these Official Rules. Sponsor reserves the right to terminate, cancel, suspend or modify the Contest if any fraud or other problem corrupts the administration, security, or proper completion of the Contest, as determined by Sponsor its sole discretion. RELEASE AND LIMITATIONS OF LIABILITY: By entering, each entrant agrees (and each selected winner agrees to confirm in writing) to release, discharge, indemnify and hold harmless CC-Reno, LLC. dba Circus Circus - Reno, and each of its respective parent companies, subsidiaries, affiliates, divisions, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective officers, directors, members, employee, representatives and agents (collectively, the Released Parties ) from and against any claim, cause of action, damage and/or liability involving or arising out of: (i) any injuries, death, losses, costs, expenses or damages to
person or property of any kind caused, in whole or in part, directly or indirectly, by participating in the Contest or any Contest related activity; (v) inability to participate in the Contest; or (vi) any printing, typographical, human, administrative or technological errors in any material associate with the Contest. PUBLICITY: Except where prohibited, participation in the Contest constitutes participants consent to Sponsor s and is agents use of name, likeness, photograph, voice, mural image, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. GENERAL CONDITIONS: By participating in this Contest, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects and cannot be appealed. Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Contest (or any portion of the Contest) should an error, virus, bug, computer problem, fraud, technical failure or other cause or problem corrupt, inhibit or impair the administration, security or proper operation of the Contest and, in such situation, to select the winner(s) from the remaining eligible non-suspect Entries received prior to and/or after such action, or in such manner as deemed fair and appropriate by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify and individual if finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. DISPUTES: Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, (2) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Nevada without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction and venue of federal, state and local courts located in Washoe County, Nevada. Notwithstanding the above, this promotion is governed by Nevada Revised Statute 463.362.
