HARVEY CEDARS, NJ Tuesday, May 15, 2018 The regular meeting of the Board of Commissioners of the Borough of Harvey Cedars, NJ was called to order by Mayor Oldham at 4:35pm. Commissioners Gerkens and Garofalo were present. The Mayor asked all to rise for the Pledge of Allegiance. Pursuant to the applicable portions of the New Jersey Open Public Meetings Act, adequate notice of this meeting has been given. The schedule of this meeting of the Board of Commissioners of the Borough of Harvey Cedars is listed in the notice of meetings posted on the bulletin board located in the Borough Hall and the Borough s website and was published on December 14, 2017 in the Beach Haven Times and the Asbury Park Press. Motion to approve the minutes of the previous meeting, May 4, 2018, was made by Commissioner Garofalo, seconded by Commissioner Gerkens. The Mayor read the following resolutions by title only and asked for motions to adopt after reading each title. RESOLUTION #2018-052 AUTHORIZE FIREWORKS DISPLAY IN THE BOROUGH OF HARVEY CEDARS WHEREAS the Board of Commissioners of the Borough of Harvey Cedars, Ocean County, New Jersey, wishes to engage in a custom fireworks display for the Borough to be held on September 1, 2018; and WHEREAS the Harvey Cedars Activity Committee, along with the approval of the Harvey Cedars Board of Commissioners, has recommended the award of a contract to International Fireworks Company, Inc. of Pennsylvania to render the necessary services in said project. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Commissioners of the Borough of Harvey Cedars, County of Ocean, hereby authorize a fireworks display on September 1, 2018 and award a contract in an amount not to exceed Eighteen Thousand Dollars ($18,000.00) to International Fireworks Mfg. Co., PO Box 6, Douglassville, PA 19518.

RESOLUTION #2018-053 RESOLUTION OF THE BOROUGH OF HARVEY CEDARS APPROVING ACCEPTANCE OF THE COPS IN SHOPS INCENTIVE GRANT FROM THE NEW JERSEY DEPARTMENT OF LAW AND PUBLIC SAFETY WHEREAS the Bureau of Alcoholic Control of the NJ Department of Law and Public Safety administers the federal grant entitled Cops in Shops Spring Incentive Fiscal Year 2018 Grant # ; and WHEREAS this grant program was established to prevent young people from obtaining alcohol and possibly becoming a danger to themselves and others; and WHEREAS the Borough of Harvey Cedars was approved for a grant of $3,080.00 for the period year 2018. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Commissioners of the Borough of Harvey Cedars, County of Ocean, hereby accepts the Cops in Shops Incentive grant in the amount of $3,080.00 to aid in preventing young people from obtaining alcoholic beverages.

RESOLUTION #2018-054 RESOLUTION SUPPORTING THE CLICK IT OR TICKET MOBILIZATION OF MAY 21 JUNE 3, 2018 WHEREAS there were 626 motor vehicle fatalities in New Jersey in 2017; and WHEREAS a large percentage of the motor vehicle occupants killed in traffic crashes were not wearing a seat belt; and WHEREAS use of a seat belt remains the most effective way to avoid death or serious injury in a motor vehicle crash; and WHEREAS the National Highway Traffic Safety Administration estimates that 135,000 lives were saved by safety belt usage nationally between 1975-2000; and WHEREAS the State of New Jersey will participate in the nationwide Click It or Ticket seat belt mobilization from May 21 June 3, 2018 in an effort to raise awareness and increase seat belt usage through a combination high visibility enforcement and public education; and WHEREAS the Division of Highway Traffic Safety has set a goal of increasing the seat belt usage rate in the state from the current level of 94% to 95.5%; and our roadways. WHEREAS a further increase in seat belt usage in New Jersey will save lives on NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Harvey Cedars declares its support for the Click It or Ticket seat belt mobilization both locally and nationally from May 21 June 3, 2018 and pledges to increase awareness of the mobilization and the benefits of seat belt use.

RESOLUTION #2018-055 CHAPTER 159 ITEM OF REVENUE INSERTION IN THE SUM OF $5,500.00 CLICK IT OR TICKET WHEREAS NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS the Director may also approve the insertion of an item of appropriation for an equal amount. NOW, THEREFORE, BE IT RESOLVED that the Commission of the Borough of Harvey Cedars, in the County of Ocean, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2018 in the sum of $5,500.00, which is now available from the National Highway Traffic Safety Administration (through the State of New Jersey, Division of Highway Traffic Safety) Click It or Ticket 2018 Seat Belt Mobilization. BE IT FURTHER RESOLVED that the sum of $5,500.00 is hereby appropriated under the caption: 8. General Appropriations (A) Operations excluded from CAPS Public and Private Programs offset by Revenues: Click It or Ticket 2018. BE IT FURTHER RESOLVED that the above is a result of Federal funds obtained through the Division of Highway Traffic Safety as a State grant.

RESOLUTION #2018-056 PROCLAIMING THE MONTH OF JUNE 2018 AS TICK AWARENESS MONTH WHEREAS Master Gardeners of Ocean County, Inc. was formed in 1990 and is a nonprofit organization working in cooperation with the Ocean County Board of Freeholders and Rutgers NJ Agricultural Experiment Station to promote the mission of the Rutgers Master Gardener volunteer program by utilizing research-based information to educate the public throughout Ocean County on best practices in consumer horticulture and environmental stewardship; and WHEREAS the Master Gardeners of Ocean County, Inc., under the direction of the Rutgers Master Gardener Program, provides services for tick identification and have tracked the tick population in Ocean County since 2010; and WHEREAS over the past five years, Master Gardeners of Ocean County, Inc. has tracked an increase in the tick population; and WHEREAS while Lyme Disease cases are reported on in the Ocean County and New Jersey area, the U.S. Department for Human Services, Center for Disease Control and Prevention has updated its pamphlet Tickborne Diseases of the United States A Reference Manual for Healthcare Providers to include additional less known diseases that impact the health of our citizens; and WHEREAS these additional diseases include Anaplasmosis which is most frequently reported in areas that correspond with the known geographic distribution of Lyme disease; Babesiosis which is most frequently reported from the northeastern and upper midwestern United States; Ehrlichiosis most frequently reported from the southeastern and south-central United States, from the eastern seaboard extending westward to Texas; Rocky Mountain Spotted Fever cases have been reported throughout most of the contiguous U.S.; Powassan virus infections have been reported primarily from Northeastern States and the Great Lakes region; and WHEREAS the Master Gardeners of Ocean County, Inc. are committed to provide tick identification and preventative information, as well as promote the awareness of diseases set forth by the Center for Diseases and Prevention to citizens of Ocean County. NOW, THEREFORE, THE GOVERNING BODY of the BOROUGH OF HARVEY CEDARS, COUNTY OF OCEAN, STATE OF NEW JERSEY does hereby proclaim JUNE 2018 as TICK AWARENESS MONTH and further expresses sincere appreciation for the commitment and dedication demonstrated by these volunteer citizens of Ocean County.

RESOLUTION #2018-057 APPOINTMENT OF CLASS I SPECIAL OFFICER FOR THE BOROUGH OF HARVEY CEDARS WHEREAS it is the desire of the Borough of Harvey Cedars to employ seasonal police officers; and WHEREAS the Harvey Cedars Police Chief has recommended to the Board of Commissioners to appoint a Class I Special Officer for the 2018 season. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars that Robert Peschko is hereby appointed as a Class I Special Officer for the Borough of Harvey Cedars, effective May 21, 2018. BE IT FURTHER RESOLVED as follows: 1. The above-appointed Special Officer is hereby authorized to attend the Class I Police Academy in Beach Haven, NJ. 2. The duties of the above-appointed Special Officer shall be limited and confined to crowd control, traffic control, and enforcement of regulations and special duties assigned by the Chief of Police. 3. A certified copy of this resolution shall be forwarded to the New Jersey Police Training Commission (NJPTC).

RESOLUTION #2018-058 APPOINTMENTS OF POLICE MATRONS FOR THE BOROUGH OF HARVEY CEDARS WHEREAS pursuant to N.J.S.A. 40A:14-140 the governing body of any municipality may appoint other personnel for the Police Department or force, which includes matrons ; and WHEREAS the Chief of Police recommends the appointment of the following individuals to the position of part-time Police Matron: Julie Oldham Anna Grimste NOW, THEREFORE, BE IT RESOLVED by the governing body of the Borough of Harvey Cedars that the above individuals be hereby appointed part-time Police Matrons for an annual term to expire on December 31, 2018.

RESOLUTION #2018-059 RECOGNIZING THE BOROUGH OF HARVEY CEDARS PARTICIPATION IN THE NATIONAL FLOOD INSURANCE PROGRAM AND THE MULTI-JURISDICTIONAL PROGRAM FOR PUBLIC INFORMATION (PPI) WHEREAS the Borough of Harvey Cedars is enrolled in the National Flood Insurance Program (NFIP) to provide flood insurance for the residents of Harvey Cedars; and WHEREAS the Borough of Harvey Cedars takes part in the Community Rating System (CRS) program that is a voluntary component of the NFIP; and WHEREAS Harvey Cedars Class 8 Rating currently provides for $119,279 in flood insurance discounts for its residents and businesses; and WHEREAS the Borough of Harvey Cedars disseminates flood hazard information that not only is beneficial to the residents through mitigation of the hazardous effects of flooding, but is also beneficial in maximizing credit in the CRS program. NOW, THEREFORE, BE IT RESOLVED, by completing a flood insurance assessment (FIA), a copy of which is attached hereto, marked Exhibit A, in accordance with the 2013 CRS Coordinator s Manual, it has been determined that 87% of the properties in Harvey Cedars, located on a barrier island, are insured through the National Flood Insurance Program, and that by completing the Island-wide program for Public Information and executing that program, this level of coverage will remain high due to the fact that insurance is mandatory for properties that have federally backed mortgages in the special flood hazard area, and furthermore, post Sandy, that flood insurance is a wise investment for all property owners including year round renters.

RESOLUTION #2018-060 AUTHORIZING THE EXTENSION OF A SHARED SERVICES AGREEMENT WITH THE TOWNSHIP OF LONG BEACH FOR CONTINUED WIRELESS COMMUNICATIONS SERVICES WHEREAS the Uniform Shared Services and Consolidation Act, NJSA 40A:65-1 et. seq., authorizes municipalities to agree to provide shared services when approved by resolution under NJSA 40A:65-5; and WHEREAS pursuant to Resolution #2011-051 passed on April 1, 2011, Long Beach Township and the Borough of Harvey Cedars agreed to the installation of a technological upgrade to the existing communications system on the Harvey Cedars water tower between the Township and the Borough for police services with the capability of transmitting video, voice, and mobile data; and WHEREAS the Township and the Borough have continued with the terms of the Wireless Communications Services Agreement past the termination date and desire to extend the term to run concurrently and become incorporated into the Shared Services Agreement for Dispatching Services effective through 12/31/2020 as well as future such agreements. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars that the Mayor and Municipal Clerk are hereby authorized to execute an amended Dispatch Services Agreement to include communications equipment and the continuation of wireless communication services effective through December 31, 2020 in order to coincide with the term of the Shared Services Agreement with the Township of Long Beach, a copy of which is on file in the office of the Municipal Clerk.

RESOLUTION #2018-061 AUTHORIZING THE EXECUTION OF A CONTRACT FOR TELECOMMUNICATION SERVICES WHEREAS on June 1, 2012, Resolution #2012-067 was adopted authorizing the execution of a telecommunication service and equipment contract with Magellan Hill Technologies (now known as Line Systems, Inc.) effective July 2012 for a four year period; and WHEREAS said contract has expired and quotes were received for new internet based phone system; and WHEREAS it is the desire of the Municipal Clerk, Police Chief and DPW Superintendent to award a telecommunications contract to Line Systems, Inc. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Harvey Cedars that the Municipal Clerk is hereby authorized to execute a contract with Line Systems, Inc. for a 3 year contract term commencing May 1, 2018. A copy of said contract is on file in the office of the Municipal Clerk.
