LIBERTY TOWNSHIP BOARD OF TRUSTEES MINUTES OF THE REGULAR MEETING TUESDAY FEBRUARY 16, 2016 PRINCETON PIKE CHURCH OF GOD 6101 PRINCETON-GLENDALE ROAD LIBERTY TOWNSHIP OH 45011 WORK SESSION 4:00 P.M. On Tuesday February 16, 2016 at 4:00 P.M., the Liberty Township Board of Trustees met this day for a special meeting. Upon call of the roll, Mrs. Matacic present, Mr. Schramm present, Mr. Farrell present. Also present: Pam Quinlisk, Kristen Bitonte, Melanie Hermes, Caroline McKinney, Bryan Behrmann, and Jose Castrejon. A work session to discuss the future Millikin Road Development. REGULAR MEETING 6:00 P.M. On Tuesday February 16th, 2016 at 6:00 P.M., the Liberty Township Board of Trustees met this day for a regular meeting. Upon call of the roll, Mrs. Matacic present, Mr. Schramm present, Mr. Farrell present. Mr. Farrell led the Pledge of Allegiance. APPROVE MINUTES Mrs. Quinlisk requested a motion to approve the Minutes from the Regular Meeting, February 2, 2016. Ms. Matacic MOVED TO APPROVE THE MINUTES FROM THE REGULAR MEETING, FEBRUARY 2, 2016. Mr. Schramm seconded. The motion passed unanimously. PUBLIC HEARING ZC Case # 16-001: Welsh Development Company is requesting a Zone Change from R- RE and RA-1 to R-1 for a 103.2 acre single-family residential development. The subject properties are located north of Millikin Road, west of Princeton Glendale Road, Parcel

Mr. Juengling presented the Staff Report. Mr. Juengling stated that the purpose of the meeting tonight is to clarify the zoning districts into one zone. Currently the area is zoned R1, RA-1 and R-RE. The goal is to have the entire area zoned R-1. He also noted that the development can be built under the current zoning classifications. We are here tonight to make the zoning consistent. Terri Corner from Beyer Becker, 6900 Tylersville Road, was available to answer any questions. Comments in Favor: No comments. Comments Neutral to Proposal: Gary Dickerson, 5944 Norvel Lane, made a comment that the whole point of the zone change is logical because it will enforce larger lot sizes. Comments for Opposition: Lymen Smith, 4551 Harvest Avenue, would like the Trustees to meet with the County to discuss the safety and traffic concerns at County View and Millikin Road. Bobby Ward, 5892 Country View Drive, is worried about children s safety and would like to stop the through traffic on Harvest Avenue. Kitty Wells, 5845 Country View, would like to mention there are no sidewalks or street lights in their neighborhood. She is also concerned about County View and Millikin Roads having a line of sight issue when exiting the subdivision. She would urge the developer to use the existing Vista Verde entrance at the main entrance/exit. Pam Wright, 4882 Millikin Road, immediately west of the proposed new entrance/exit questioned the applicant if the additional entrance to the subdivision is already approved. According to the Applicant yes it is in the process of being purchased and is approved. Pam Rebar, questioned why they are all here if the subdivision can go in as planned already. Kristen Wells, Oakview Court, has concerns about no sidewalks, streetlights and overcrowding of schools. Gary Dickerson, 5944 Norvel Lane, was informed by the Butler County Engineer s Office the line of site for an entrance at the Vise Verde golf course is inadequate for an entrance. Dave Plotts, 5854 Happy Court, would like to know the County s process for approval. Steve Lennartz, 47512 Millikin Road, would like to know if a buffer zone is required in the zoning code between the new and older homes. Mr. Behrmann stated that there is no buffer zone requirement in the zoning code when residential abuts residential. Bob Niehaus, 4581 Harvest Ave, was told Welsh Developers was supposed to be at this meeting to answer any homeowner s concerns. He also has questions on where the

Minutes 2-16-2016 Page 3 construction traffic will enter. He wished the Developer would have been in attendance to answer any questions. He requested that the vote be tabled. Ms. Corner said the construction traffic would most likely enter off Millikin but did not elaborate on exact location. Brian Motolik, 5942 Country View, would like the developer to consider the golf course entrance for the main entrance instead of Harvest Lane. Pam Wright, 4882 Millikin Road, asked if there are plans for a turn lane on Millikin Road and whose property are they going to take to make it happen? The Applicant stated that the BCEO is requiring turn lanes. Ms. Corner has no details on how the turn lanes will be installed. Lyman Smith, 4551 Harvest Ave, would like to see this process slow down and have a conversation with the developer. Ms. Matacic MOVED TO CLOSE THE PUBLIC HEARING ON ZC CASE # 16-001: WELSH DEVELOPMENT COMPANY IS REQUESTING A ZONE CHANGE FROM R- RE AND RA-1 TO R-1 FOR A 103.2 ACRE SINGLE-FAMILY RESIDENTIAL DEVELOPMENT. THE SUBJECT PROPERTIES ARE LOCATED NORTH OF MILLIKIN ROAD, WEST OF PRINCETON GLENDALE ROAD, PARCEL ID# D2010-007-000-002, SECTION 9, TOWN 2, RANGE 3, LIBERTY TOWNSHIP, BUTLER COUNTY, OHIO AND D2020-030-000-023 AND D2020-031-000-017, SECTION 3, TOWN 2, RANGE 3, LIBERTY TOWNSHIP, BUTLER COUNTY, OHIO. Mr. Schramm seconded. The motion passed unanimously. Trustee Comments Ms. Matacic would like staff to look into how we can notify residents when the county does not. She would also like a speed study completed when the development is complete to see if the speed can be reduced on Millikin Road. She does feel that extra entrances can be a benefit to the residents in the long run. She would like to remind everyone in attendance we are dealing with personal property rights of the individual selling the property and the State of Ohio takes these rights very seriously. Mr. Farrell was very disappointed that the developer did not attend the meeting to answer the simple questions the residents have. This is not being a good neighbor. He would like staff to set up a meeting with the developer to answer these simple questions and then disseminate the answers to residents. Mr. Schramm was disappointed with the timing of the project. He feels these projects get way down the track before the Township is notified. The Trustees stated they prefer the PUD process instead of straight zoning because it gives the Trustees more input on the process. Ms. Matacic MOVED TO APPROVE A RESOLUTION TO ACCEPT THE RECOMMENDATION OF THE LIBERTY TOWNSHIP ZONING COMMISSION NOTICE OF DECISION FOR CASE ZC16-001, APPLICANT: WELSH DEVELOPMENT, TO APPROVE THE REQUEST FOR THE ZONING MAP AMENDMENT FROM R-RE, RESIDENTIAL RURAL ESTATE DISTRICT AND RA-1, RESIDENTIAL AGRICULTURAL DISTRICT TO R-1, SUBURBAN RESIDENCE DISTRICT AS ATTACHED (2016-032). Mr. Schramm seconded. The motion passed unanimously. Mrs. Quinlisk requested a Resolution to declare the 1997 Ford F-350 Truck with dump bed and lift gate included designated as Services Truck # 11, the 1994 Sutphen Deluge Pumper, and the 1999 Horton Ambulance as not needed and / or unfit for Township use, and shall be properly disposed of pursuant to Ohio Revised Code 505.10(3). RESOLUTION NO. 2016-032 Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION TO ACCEPT THE RECOMMENDATION OF THE LIBERTY TOWNSHIP ZONING COMMISSION NOTICE OF DECISION FOR CASE ZC16-001, APPLICANT: WELSH DEVELOPMENT, TO APPROVE THE REQUEST FOR THE ZONING MAP AMENDMENT FROM R-RE, RESIDENTIAL RURAL ESTATE DISTRICT AND RA-1, RESIDENTIAL AGRICULTURAL DISTRICT TO R-1, SUBURBAN RESIDENCE DISTRICT AS ATTACHED RESOLVED by the Board of Township Trustees of Liberty Township, Butler County, Ohio that WHEREAS, the Butler County Planning Commission conducted a public hearing for the proposed request on Tuesday, December 8, 2015 and made a motion to recommend approval of the Zoning Map Amendment; WHEREAS, the Liberty Township Zoning Commission conducted a public hearing for the proposed request on Monday, January 4, 2016 and made a motion to recommend approval for the request for a Zoning Map Amendment from R-RE, Residential Real Estate District and RA-1, Residential Agricultural District to R-1, Suburban Residence District for the subject properties (Parcels: D2010 007.000 002; D2020 030.000 023; and D2020 031.000 017) as proposed; WHEREAS, a public hearing was conducted by the Liberty Township Board of Trustees on Tuesday, February 16, 2016 at 6:00 p.m. to review the proposed Zoning Map Amendment; WHEREAS, all those present for the hearing who wished to be heard voiced their opinions with respect thereto; and WHEREAS, said application was reviewed by the Board of Township Trustees and determined to be consistent with the Liberty Township Comprehensive Plan; now THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees does hereby approve the request for the Zoning Map Amendment as attached.

Trustee Matacic made a motion to accept the recommendation of the Liberty Township Zoning Commission s Notice of Decision for Case # ZC 16-001, Applicant Welsh Development, to approve the request for the Map Amendment to the Liberty Township Zoning Resolution. RESOLUTION NO. 2016-033 Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION TO AUTHORIZE THE TOWNSHIP ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH ELLIOTT DAVIS DECOSIMO FOR THE PREPARATION OF THE 2015 BASIC FINANCIAL STATEMENTS FOR AN AMOUNT NOT TO EXCEED $3,750.00 FROM ACCOUNT # 1000-110-312 RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that WHEREAS, Carolyn Cifuentes, Liberty Township Financial Specialist, requests the Liberty Township Board of Trustees authorize the Township Administrator to execute an agreement with Elliott Davis Decosimo for the preparation of the basic financial statements as of and for the year ended December 31, 2015 of Liberty Township; and WHEREAS Liberty Township would pay an amount not to exceed $3,750.00 for the preparation of statements from account # 1000-110-312; THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees hereby authorizes the Township Administrator to execute an agreement with Elliott Davis Decosimo for the preparation of the 2015 basic financial statements for an amount not to exceed $3,750.00 from account # 1000-110-312. RESOLUTION NO. 2016-034 Board of Trustees, Liberty Township Butler County, Ohio RESOLUTION TO DECLARE THE 1997 FORD F-350 TRUCK WITH DUMP BED AND LIFT GATE INCLUDED DESIGNATED AS SERVICES TRUCK # 11, THE 1994 SUTPHEN DELUGE PUMPER, AND THE 1999 HORTON AMBULANCE AS NOT NEEDED AND / OR UNFIT FOR TOWNSHIP USE, AND SHALL BE PROPERLY DISPOSED OF PURSUANT TO OHIO REVISED CODE 505.10(3) RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that WHEREAS, Ohio Revised Code Section 505.10 outlines the acceptance and disposition of property; WHEREAS, Fiscal Officer Pam Quinlisk requests the Liberty Township Board of Trustees declare the 1997 Ford F-350 Truck with dump bed and lift gate included designated as Services Truck # 11, the 1994 Sutphen Deluge Pumper, and the 1999 Horton Ambulance as not needed and / or unfit for Township use; WHEREAS, these items shall be properly disposed of pursuant to Ohio Revised Code 505.10(3); THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees hereby declares the 1997 Ford F-350 Truck with dump bed and lift gate included designated as Services Truck # 11, the 1994 Sutphen Deluge Pumper, and the 1999 Horton Ambulance as not needed and / or unfit for Township use, and shall be properly disposed of pursuant to Ohio Revised Code 505.10(3).
