& PUBLIC HEARING, TOWN OF WOODHULL September 12, 2012 The regular monthly meeting of the Town Board of the Town of Woodhull, County of Steuben and State of New York held at the Town Hall, 1585 Academy Street, Woodhull, New York on the 12 th day of September 2012. PRESENT: ABSENT: Scott E. Grant, Supervisor James R. Crans, Councilman Douglas S. O Brian, Councilman Arnold S. Herrington, Councilman L. Todd Housel, Highway Superintendent Sharon A. Brewer, Town Clerk Larry B. Guild, Councilman OTHERS PRESENT: Madeline E. Stewart, Woodhull Municipal Gas Company; Richard Knowles, Woodhull Municipal Gas Company; Gary Calkins, Assessor; Richard Harrison, Dog Control Officer; Betty Walden, Deputy Dog Control Officer; Jan Calkins, Planning Board; Sharon Calkins, Town Hall Custodian; Mike Rivers, Ambit Energy; Mary Shupp and Helen Colegrove, Woodhull Holiday Committee; Kenny Shupp; Fred & Betty Perry; and Donna Brass Woodhull Municipal Gas Company business transacted at 6:00 PM. Jim Crans, Gas Company Supervisor, met with Corning Natural Gas to go over some things that needed to be clarified on the contract with CNG. They will be on deck when an audit is done this fall. Jim is trying to get paperwork in line for this audit. CNG personnel were in town on August 18 th with the Lateral Gas Line Tracer. Some of the lines couldn t be located with this machine. Bob Bush of Corning Natural Gas will give a quote for CNG to do this line locating. Nikki Stewart reported that there have been very few calls regarding gas bills. Dick Knowles has not received all of the training that he needs. Nikki Stewart submitted a revised Abstract of Claims for August 2012. The amount of the payment to Corning Natural Gas changed. The revised total $15,150.02. The September abstract in the amount of $7,276.47 approved for payment. This included vouchers #12-101 12-115. Supervisor Grant called the Public Hearing on proposed Local Law #1 for 2012, known as the Local Road Use and Preservation Law, at 6:45 PM. He explained that this law is necessary to protect the town roads in the event of high intensity traffic associated with large construction projects. He explained that Delta Engineering paid to develop a law for the Local Road Use Agreement. Some neighboring towns have adopted a local law, and others have adopted the Steuben County Plan. The Public Hearing closed at 6:58 PM. Supervisor Grant called the monthly meeting to order at 7:00 PM with the Pledge of Allegiance to the Flag. He welcomed all who were present.

September 12, 2012 Page 2 RESOLUTION #35 APPROVAL OF MINUTES On a motion of Councilman Crans and second by Councilman Herrington, the following resolution ADOPTED Ayes 4 Grant, Crans, Herrington, O Brian RESOLVED that the minutes of the August 8, 2012 Monthly Board Meeting be approved as written. RESOLUTION #36 ADOPTION OF LOCAL LAW #1 FOR 2012 On a motion of Councilman Herrington and second by Councilman O Brian, the following resolution ADOPTED Aye Supervisor Scott Grant Aye Councilman James Crans Aye Councilman Arnold Herrington Aye Councilman Douglas O Brian RESOLVED that Local Law #1 for 2012, known as the Local Road Use and Preservation Law be adopted by the Town of Woodhull. GUESTS/RESIDENTS Kenny Shupp of Promotions & Consulting, LLC brought a proposal for free recycling services from his client, Swarthout Recycling. They propose to put five roll off 8 x 22 containers that are clearly marked for Cardboard, Glass, Plastic, Tin and Newsprint at the Town Barn. These would be emptied as needed with no charge to the Town. No discussion held on this matter. Mary Shupp and Helen Colegrove of the Woodhull Holiday Committee updated the Board on their progress. The new decorations have been received and are at the Town Barn. The older wreaths will be refurbished have new LED bulbs installed. The Committee has sent out requests for bids from three electricians to wire the receptacles to the poles. They have also sent out letters to area merchants asking for financial support or other participation in the Woodhull Winterfest to be held on November 17, 2012 from 5 9 PM. The committee advised to open a bank account, using the Town of Woodhull Federal Tax ID number. Donna Brass questioned if the MacDonald Health Center opening up full time as previously reported. The answer NO. She also questioned why additional funds had been added to the Contractual Accounts of the Supervisor, Assessor and Highway Superintendent. The transfers were made to cover the cost of the cell phones held by these persons. Mike Rivers of Ambit Energy present to explain his company to the Board members. He is an independent consultant for this company, and brought information stating that money could be saved on the delivery charge on electric bills. The amount saved would be 7% the first two months, then a minimum of 1% after that.

September 12, 2012 Page 3 REPORTS Rick Harrison, DOG CONTROL OFFICER, reported that he has sent out 14 pre-tickets for unlicensed dogs. The rabies clinic is scheduled for September 20 th from 6 to 8 PM at the Town Barn. Ray Orr, CODE ENFORCEMENT OFFICER, not present. Councilman Crans reported that the septic system problem on County Route 99 has been resolved after a meeting with the property owners, Tom Clasius of the NYS Dept. of Health, Jody Allen of Allen Engineering, Ray Orr and Jim Crans. The owners have an ok to finish the system, then Ray Orr will inspect. Councilman Crans left the meeting at 8:45 PM. Gary Calkins, ASSESSOR, had nothing to report. Sharon Calkins, TOWN HALL CUSTODIAN, reported that Jerry has contacted Corning Appliance to give him quotes on repairing or replacing the current heating system. Mast Roofing & Coatings from Penn Yan is currently working on the flat roof of the Town Hall. Councilman Crans has secured a bid for replacing the remaining portion of the Town Hall roof for a total price of $52,200. The bid is from Dan Ashbury of Hillside Builders of Corning, New York. This bid is to install shingles instead of the steel roofing. After some discussion, it decided that Supervisor Grant should go back to this company and ask for 5/8 tongue & groove OSB board with lifetime architectural shingles. Supervisor Grant reported that the appraisal of town property done on August 13 th. Results are pending, as some information is needed from Scott. Jan Calkins, PLANNING BOARD, reported that the food bank cancelled for September as the scheduled date fell on Labor Day. She reported that the website has been updated, and she thanked the Board for their support of the Senior Citizens group. The Seniors will be taking their second trip on October 8 th. The Planning Board minutes for this month outlined what improvements are needed in the Town Hall and the playground. SUPERVISOR S REPORT Supervisor Grant went over monthly correspondence. The 2013 2015 Union Contract signed on August 17, 2012. This contract goes into effect on January 1, 2013. J. C. Smith has secured at NYSDEC $2 million grant for the Town of Woodhull sewer project. He recently met with Supervisor Grant and Councilman Crans. Supervisor Grant asked for suggestions from the Board on who to appoint for a Health Officer. Sharon Brewer, TOWN CLERK, that she has received notification that the Dog Control Inspection completed on September 4 th and a satisfactory rating received. The Municipal Shelter Inspection also done on that date and a satisfactory rating received. Todd Housel, HIGHWAY SUPERINTENDENT, reported that the 2009 truck is in Rochester for warranty work.. The 2008 Ford F250 pickup has been cleaned up and touch-up painting done. It also has new brakes. He stated that the one ton Dodge truck needs to be replaced. This truck is used constantly,

September 12, 2012 Page 4 and money is available from FEMA reimbursement. He has several Welcome to Woodhull signs that will be put up where needed. Four roads are left to be graded Walrath, Little, Taft and Chapin. The FEMA check has not been received as of this date. Soil & Water people met with Todd this morning on the ditch on the Dane Stewart property. RESOLUTION #37 TRANSFER OF FUNDS On a motion of Councilman O Brian and second by Councilman Herrington, the following resolution ADOPTED Ayes 3 Grant, Herrington, O Brian NYs 0 RESOLVED that the following transfer of funds be made: FROM: D5130.43 (Stock & Maintenance) $3,929.33 TO: D5130.20 (New Machinery) Supervisor Grant has received notification that the Town of Woodhull needs to pass the Workplace Violence Policy Statement to be in compliance. This can be modeled after the Steuben County adopted statement. RESOLUTION #38 ADOPTION OF WORKPLACE VIOLENCE POLICY STATEMENT On a motion of Councilman Herrington and second by Councilman O Brian, the following resolution ADOPTED Ayes 3 Grant, Herrington, O Brian RESOLVED that the Town of Woodhull adopt the Workplace Violence Policy Statement and such notice to be posted on the Highway Department and on the Town Hall bulletin boards. (A copy of this statement is attached to the end of these minutes.) OLD BUSINESS Records Room Retention/Cleanup nothing new to report Town Hall Roof Repair Previously discussed Christmas Decorations Update previously discussed NEW ITEMS 2013 Budget Workshops were set up for Thursday, September 27, 2012 at 6:30 PM and October 4, 2012 at 6:30 PM. Councilman O Brian reported that work is being done on the cleanup of the Gary Dunn property. AUDIT OF HIGHWAY & GENERAL FUND BILLS Abstract #009 of the Highway Fund in the amount of $14,623.48 approved for payment. This included vouchers #120 130. Abstract #008 of the General Fund in the amount of $8,466.89 approved for payment. This included vouchers #172-190.
