WHEREAS, the City Council of the City of Selma adopted Ordinance #021215-01 on February 12, 2015, by which Ordinance #021215-01, the International Building Code, 2012 Edition, Page 1 of 12
including selected appendices, as published by the International Code Council, Inc., was adopted as the Building Code for the City of Selma; and Building Code, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the International Residential Code for One- and Two-family Dwellings, 2012 Edition, including selected appendices, as published by the International Code Council, Inc., as the Residential Code for One- and Two-family Dwellings for the City of Selma; and Residential Code for One- and Two-family Dwellings, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the International Energy Conservation Code, 2012 Edition, as published by the International Code Council, Inc., as the Energy Conservation Code for the City of Selma; and Energy Conservation Code, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the International Fuel Gas Code, 2012 Edition, including all appendices, as published by the International Code Council, Inc., was adopted as the Fuel Gas Code for the City of Selma; and Fuel Gas Code, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the International Mechanical Code, 2012 Edition, including Appendix A, as published by the International Code Council, Inc., as the Mechanical Code for the City of Selma; and Mechanical Code, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the International Property Maintenance Code, 2012 Edition, as published by the International Code Council, Inc., as the Property Maintenance Code for the City of Selma; and Property Maintenance Code, 2012 Edition, and WHEREAS, said Ordinance #021215-01 also adopted the NFPA 70 2011, also known as the 2011 National Electrical Code, including Appendix H, as published by the National Fire Protection Association, as the Electrical Code for the City of Selma; and Page 2 of 12
WHEREAS, said Ordinance #021215-01 also adopted local amendments to the NFPA 2011, also known as the 2011 Electrical Code; and WHEREAS, said Ordinance #021215-01 also adopted the International Plumbing Code, 2012 Edition, as published by the International Code Council, Inc., as the Plumbing Code for the City of Selma; and Plumbing Code, 2012 Edition; and WHEREAS, said Ordinance #021215-01 also adopted the International Fire Code, 2012 Edition, including Appendices B, C, D, E, F, and G, as published by the International Code Council, Inc., as the Fire Code for the City of Selma; and Fire Code, 2012 Edition; and WHEREAS, said Ordinance #021215-01 also adopted the International Existing Building Code, 2012 Edition, as published by the International Code Council, Inc., as the Existing Building Code for the City of Selma; and Existing Building Code, 2012 Edition; and WHEREAS, the City Council of the City of Selma has been informed that the International Code Council has provided certain information regarding the adoption by Ordinance of the International Building Code, 2015 Edition and other ancillary codes; WHEREAS, the City Council of the City of Selma believes that it is in the best interest of the City to adopt by Ordinance (1) the International Building Code, 2015 edition, (2) the International Residential Code, 2015 Edition, (3) the International Energy Conservation Code, 2015 Edition, (4) the International Fuel Gas Code, 2015 Edition, (5) the International Mechanical Code, 2015 Edition, (6) the International Property Maintenance Code, 2015 Edition, (7) the 2017 NFPA 70: National Electrical Code, (8) the International Plumbing Code, 2015 Edition, (9) the International Fire Code, 2015 Edition, (10) the International Existing Building Code, 2015 Edition, and (11) local amendments to certain of such Codes, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SELMA, TEXAS, that Chapter 66 of the Code of Ordinances is amended as follows: Section 1. Article I, In General, Section 66-2, is hereby added to read as follows: Sec. 66-2. Notice of Violations, Penalties. Any person who violates a provision of this Chapter or fails to comply with any of the requirements the Codes referenced herein or is in violation of the approved construction documents or a directive of the building official, or of a permit, or Page 3 of 12
certificate issued under the provision of this chapter, shall, upon conviction, be punished as provided in Section 1-13 of the Code of Ordinances of the City of Selma. Section 2. Article I, In General, Section 66-3, is hereby added to read as follows: Sec. 66-3. Responsible Party. The ultimate responsibility for compliance to the requirements of this chapter falls to the owner or developer of the property or structure regulated by this chapter. If at any time it is found that any feature of a building or structure is not in compliance with the requirements of this chapter, that feature shall be corrected to be in compliance with the requirements of this chapter. Section 3. Article II, Division 2, Section 66-51, Adoption, of the Code of Ordinances of the City of Selma is hereby amended to read as follows: Department of the City of Selma, Texas, being marked and designated as the International Building Code, 2015 Edition including all chapters and the following appendices: Appendix F; Appendix G; Appendix J; and Appendix K, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Selma, Texas for regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as therein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the Permits & Inspections Department of the City of Selma, Texas are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 4 of this ordinance. Section 4. Article II, Division 2, Section 66-52, Amendments to the International Building Code, of the Code of Ordinances to the City of Selma is hereby amended to read as follows: 101.1 Title. These regulations shall be known as the Building Code of the City of Selma, Texas, hereinafter referred to as this code. Section 101.4: Change to read as follows: 101.4 Referenced codes. The codes listed in Sections 101.4.1 through 101.4.7, as published in 2015, and as referenced elsewhere in this code, shall be considered part of the requirements of this code to the prescribed extent of each such reference. Whenever amendments have been adopted to the referenced codes and standards, each reference to said code and standard shall be considered to reference the amendments as well. Any reference to the ICC Electrical Code shall mean NFPA 70-2017, also known as the 2017 National Electrical Code (NEC). Page 4 of 12
Section 107.1: Change to read as follows: 107.1 Submittal documents. Submittal Documents consisting of construction documents, statement of special inspections, geotechnical report, drainage study, and traffic impact analysis, each as may be required for the issuance of a building permit, and other data shall be submitted in quantities and formats as stipulated in department policies with each permit application. The construction documents shall be prepared by a registered design professional where required by the Texas Engineering Practice Act or the Texas Board of Architectural Examiners, as applicable. Building foundation plans or plans for modifications to a building foundation must be prepared by a Professional Engineer registered in the State of Texas. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional. Exception: The building official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of construction documents is not necessary to obtain compliance with this code. Add new Section 110.7 to read as follows: 110.7 Inspection by engineer of record. The engineer of record may conduct required inspections in lieu of the building official unless proscribed by State Law or the Texas Board of Professional Engineers. The building official may require that certain inspections be performed or attested to by the engineer of record as a condition for permit approval. Alternatively, the engineer of record may submit a request to the building official to perform specific inspections before or after a permit is issued. The building official may require such post-inspection documentation as he deems necessary, including a letter signed by the engineer of record and having his seal affixed thereto, that the construction was in compliance with the approved construction plans, specifications, or instructions and all applicable Code requirements. If the letter provided by the engineer of record is attesting to inspections done on behalf of the engineer of record, the letter shall name the inspector, document his qualifications to perform the inspections, and include all test reports. The building official may require any additional documents as he deems necessary and may also require notice at least 24 hours prior to each inspection. Section 202: Add new definition to read as follows: Engineer of record. The engineer whose signature and seal is affixed to a specific set of construction plans, specifications, or instructions. Section 1612.3: Change to read as follows: 1612.3 Establishment of flood hazard areas. To establish flood hazard areas, the applicable governing authority shall adopt flood hazard maps and supporting data. The flood hazard maps shall include, at minimum, areas of special flood hazard. These areas are identified by the Federal Emergency Management Agency in an engineering report entitled The Flood Insurance Study for Bexar County, Texas, dated effective September 29, 2010, with accompanying Flood Insurance Rate Maps and/or Flood Boundary-Floodway Maps (FIRM and/or FBFM), also dated effective September 29, 2010, and any revisions thereto for Bexar County, and an engineering report entitled The Flood Page 5 of 12
Insurance Study (FIS) for Guadalupe County, dated effective November 2, 2007, with accompanying Flood Insurance Rate Maps and/or Flood Boundary-Floodway Maps (FIRM and/or FBFM), also dated effective November 2, 2007, and any revisions thereto for Guadalupe County, and an engineering report entitled The Flood Insurance Study (FIS) for Comal County, dated effective September 2, 2009, with accompanying Flood Insurance Rate Maps and/or Flood Boundary-Floodway Maps (FIRM and/or FBFM), also dated effective September 2, 2009, and any revisions thereto for Comal County, are hereby adopted by reference and declared to be part of this section. Section 5. That ordinance #21215-01 of the City of Selma, which adopted the 2012 International Building Code and local amendments thereto, and ancillary 2012 Codes and local amendments thereto, and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. Article II, Division 3, Section 66-71, Adoption, of the Code of Ordinances of the City of Selma is hereby amended to read as follows: Department of the City of Selma, Texas, being marked and designated as the International Residential Code, 2015 Edition including all chapters and the following appendices: A, B, C, D, E, G, M, N, O, and P, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Selma, Texas for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal, and demolition of detached one and two family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with separate means of egress as therein provided; providing for the issuance of permits and collection of fees therefore; and each and all of these regulations, provisions, penalties, conditions, and terms of said Residential Code on file in the office of the Permits & Inspections Department of the City of Selma, Texas are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance with the additions, insertions, deletions, and changes, if any, prescribed in Section 7 of this ordinance. Section 7. Article II, Division 3, Section 66-72, Amendments to the International Residential Code, of the Code of Ordinances to the City of Selma, is hereby amended to read as follows: Section R101.1: Change to read as follows: R101.1 Title. Article IV, Section 66-171, Adoption, of the Code of Ordinances of the City of Selma is hereby amended to read as follows: Department of the City of Selma, Texas, being marked and designated as the International Fuel Gas Code, 2015 Edition, including all appendices, as published by the International Code Council, be and is hereby adopted as the Fuel Gas Code of Selma, Texas for regulating and governing fuel gas systems and gas-fired appliances as therein provided; providing for the issuance of permits and collection of fees therefore; and each and all of these regulations, provisions, penalties, conditions, and terms of said Fuel Gas Code on file in the office of the Permits & Inspections Department of the City of Selma, Texas are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance with the additions, insertions, deletions, and changes, if any, prescribed in Section 13 of this ordinance. Section 19. Article XI, Section 66-391, Adoption, of the Code of Ordinances of the City of Selma is hereby adopted to read as follows: Department of the City of Selma, Texas, being marked and designated as the International Existing Building Code, 2015 Edition, as published by the International Code Council, be and is hereby adopted as the Existing Building Code of the City of Selma, Texas for regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings, including historic buildings, as therein provided; providing for the issuance of permits and collection of fees therefore; and each and all of these regulations, provisions, penalties, conditions, and terms of said Existing Building Code on file in the office of the Permits & Inspections Department of the City of Selma, Texas are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance with the additions, insertions, deletions, and changes, if any, prescribed in Section 24 of this ordinance. Section 24. Article XI, Section 66-392, Amendments to the International Existing Building Code, of the Code of Ordinances to the City of Selma is hereby adopted to read as follows: 101.1 Title. This code shall be known as the International Existing Building Code of the City of Selma, Texas, and shall be cited as such and will be referred to herein as this code. Section 25. That if any section, subsection, sentence, clause, or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Selma hereby declares that it would have passed this ordinance, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional. Section 26. That nothing in this ordinance or in any of the codes hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action or existing, under any act or ordinance hereby repealed by this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance. Section 27. That the City Secretary or Assistant City Secretary of the City of Selma is hereby ordered and directed to cause the caption of this ordinance to be published in the official newspaper of the City of Selma. Section 28. That this ordinance and the rules, regulations, provisions, requirements, orders, and matters established hereby shall effect and be in full force one day after the date of publication of the caption of this ordinance in the official newspaper of the City of Selma.
