October 12, 2015 The Board of Ellis County Commission was called to order by Chair Martha L. McClelland on Monday, October 12, 2015 in the Commission Chambers, Administrative Center, 718 Main, Hays, Kansas at 5:11 p.m. The meeting opened with everyone standing and saying the Pledge of Allegiance. Commissioners present: Chair Martha L. McClelland and Commissioner Dean F. Haselhorst were present. Commissioner Barbara K. Wasinger was absent. It was noted that a quorum was present. Also present were County Counselor Bill Jeter and County Clerk Donna J. Maskus. ORDER OF BUSINESS No changes were noted on the Order of Business. APROVAL OF PRIOR MINUTES Chair McClelland asked for any changes to the regular meetings of October 5, 2015; with none the minutes stand approved as presented per Chair McClelland. ISSUES FROM PERSONS NOT ON THE ORDER OF BUSINESS No issues were presented that were not on the order of business. County Fire Department Resolution on Consolidation Resolution 2015-21 to consolidate the Rural Fire Department has been reviewed by County Counselor Bill Jeter with no concerns. Approve Resolution 2015-21, to provide provisions to update the rural fire district for the best protection and services in providing fire protection as deemed necessary. Resolution No. R-2015-21 Resolution of the Board of County Commissioners Ellis County, Kansas A resolution replacing resolution by the Board of County Commissioners dated December 30, 1991, and any and all other resolutions relating to the Rural Fire District in the County of Ellis, Kansas, its organization, government and regulation. PURPOSE: BE IT RESOLVED, by the Board of County Commissioners of Ellis County, Kansas: ARTICLE I To establish a rural fire district in accordance with the provisions of K.S.A 19-3601 et seq.; to update as necessary the existing divisions of the rural fire district so the citizens thereof may have the best possible fire protection; and further, to establish such other services, emergency or otherwise, now and in the future that are normally provided by a fire protection unit and as are or may be deemed necessary to the citizens of the fire district. AREA TO BE COVERED: ARTICLE II The area to be covered shall be titled as Fire District No. 1, County of Ellis, Kansas. The area will be known as Ellis County Fire Department. LOCATION OF FIRE STATIONS: ARTICLE III
There are to be six fire stations located throughout Ellis County. The location of these fire stations are: Company 2 Catherine Company 4 Victoria Company 5 Hays Company 6 Ellis Company 8 Schoenchen Company 9 Munjor SALARIES AND FEES ARTICLE IV Compensation for the Fire Chief, Company Chiefs and Volunteer Firefighters shall all be determined by the Board of County Commissioners. FIREFIGHTERS RELIEF ASSOCIATION: ARTICLE V The Ellis County Firefighters Relief Association and its bylaws shall be recognized by the Board of County Commissioners. EQUIPMENT: ARTICLE VI All fire apparatus and equipment shall remain in its assigned station unless released by the Ellis County Fire Chief. McClelland, Chair /S/ Barbara Wasinger /S/ Dean Haselhorst Catherine Fire Station Rural Fire Chief Darin Myers stated now with the consolidation of fire stations he will have an extra fire truck, and would like to operate it out of the Catherine Station. Myers was given the approval to go forward in getting bids to add a bay onto the Catherine Fire Station. Rural Fire property at 2150B Saline River Road, Plainville, Kansas Rural Fire Chief Darin Myers reported that the fire station property located at 2150B Saline River Road with land owned by Schmeidler Ranch and the building is owned by the County. Myers shared pictures of the fire station and reported that it is in poor condition. Commissioners decided that the building should go to Schmeidler Ranch. County Counselor Jeter stated that a bid process would not be necessary with the building value less than $1,000. Jeter will prepare a bill of sale for Chair McClelland to sign.
To dispose of the County s building at 2150B Saline River Road, which has served as the Rural Fire Station Company Number 3. The property will go back to Glenn and Mary Jane Schmeidler. Chief Myers announced that the new truck for Fire Station Number 5 has arrived and he is very pleased and thanked the Commission. Noxious Weed proposals for sprayer components to build 300-gallon skid mounted sprayer Noxious Weed Control Supervisor Gary Haas presented bids on sprayer components to build a 300 gallon skid mounted sprayer on his new 2016 pickup. Bids received: Fairbanks Equipment, Wichita, Kansas bid price $10,613.48. Simpson Farm Enterprises, Incorporated bid price $9,522.88 (bid exceptions). Simpson Farm Enterprises, Incorporated bid price $11,020.16 (new total with exception included). To purchase sprayer components to build a 300 gallon skid mounted sprayer for the Noxious Weed Department out of Fund 16 from Fairbanks Equipment, Wichita, Kansas, at $10,613.48. Sale of Emergency Medical Services Property at 1009 Cody Avenue, Hays To approve selling the Emergency Medical Services property at 1009 Cody Avenue, Hays. Motion carried on a voice vote of two to zero. Contract with APAC Kansas Incorporated and Sporer Land Development on Highway 40 Project, Yocemento to Ellis Tom Bennett, Vice-President of BG Consultants, Incorporated, presented contracts on the approved Old Highway 40 Improvement Project from Yocemento to Ellis. The APAC Kansas Incorporated contract was $1,132,667 and Sporer Land Development $609,995. Jail Equipment Sheriff Ed Harbin presented a bid from Treasure Electronics, Incorporated, Tulsa, Oklahoma, for security detection equipment that will be used in the Courthouse for $33,241. This includes the security system with the metal detectors and services. The concealed carry fees of $31,321.01 will be paid out of Fund 114 and civil process fees out of the Sheriff s General Fund at $1,919.99. Cereal Malt Beverage License Knights of Columbus
To approve the Cereal Malt Beverage Retail Dealer s License for Knights of Columbus number 11492, consumption on the premises, November 10, 2015, Unrein Building at the Ellis County Fairgrounds. September Financial Report The September Financial Reports were presented. County Commission Reports Chair McClelland stated that correspondence had been received from the Kansas Association of Counties (KAC) asking for nominations for a Northwest Kansas representative to the Kansas Association of Counties Board. Schedule a Special Commission Meeting on Thursday, October 15, 2015 for an Executive Session Chair McClelland announced that they will hold a Special Session on Thursday, October 15, 2015 for an Executive Session on a non-elected personnel matter. Executive Session No Executive Session was called.
