BE IT ENACTED BY THE TWENTIETH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE: 1 Section 1. Findings and Purpose. The Legislature finds that the Commonwealth 2 Healthcare Corporation Dental Clinic (CHCC Dental Clinic) and the Commonwealth Cancer 3 Association require funding for the provision of patient directed services, prevention care, 4 treatment, diagnosis and other related services. 5 The CHCC Dental Clinic is the only public health dental clinic in the CNMI. The 6 clinic addresses several focus areas including: 1) Integrating oral & primary care medical 7 delivery systems; 2) Community-based prevention services programs for underserved 8 population; and 3) Programs to establish or expand oral health services. 9 The Legislature further finds that oral cancer screenings are provided to all patients

HOUSE BILL 20-29, HDl, SD2 1 seen at the CHCC Dental Clinic in response to the high rate of oral cancer in the CNMI. 2 Studies show that early detection of cancer and precancerous tissue result in better treatment 3 outcomes. Therefore, it is vital that our community is able to access oral health services and 4 be provided the much-needed education regarding oral cancer prevention and detection. 5 The Legislature recognizes that Commonwealth Cancer Association (CCA) promotes 6 cancer awareness and prevention, provides patient support services, and advocates for cancer 7 issues in the Commonwealth. Therefore, it is just as vital to ensure that our community is 8 afforded with the resources and support needed to increase awareness and support services to 9 battle this deadly disease. 10 The purpose of this Act is to appropriate nine hundred thirty-one thousand, three 11 hundred forty dollars ($931,340) from the Cancer Fund Special Account, earmarked under 12 4 CMC 1402 (g) (2), to support and expand oral cancer awareness, detection and prevention 13 programs conducted by the CHCC Dental Clinic and the Commonwealth Cancer Association 14 respectively. 15 Section 2. Appropriation. Notwithstanding any laws, statutes, prov1s10ns or 16 regulations to the contrary, nine hundred thirty-one thousand, three hundred forty dollars 17 ($931,340) from funds earmarked to the Cancer Fund Special Account is hereby appropriated 18 19 20 21 22 23 24 25 26 27 28 29 as follows: (a) One hundred fifty thousand dollars ($150,000) to the Commonwealth Healthcare Corporation for the operations of the Division of Public Health Services' Dental Clinic Program. The Chief Executive Officer of the CHCC shall be the expenditure authority for the funds appropriated under this section. (1) Provided that the funds appropriated under this subsection, twentyfive thousand dollars ($25,000) shall go to the Second Senatorial District for Public Health Services' Dental Clinic Program and medical referrals to Saipan for dental services. The Resident Director of the Tinian Health Center shall be the expenditure authority for the funds appropriated under this subsection; and (2) Twenty-five thousand dollars ($25,000) shall go to the First Senatorial District for Public Health Services' Dental Clinic Program and 2

The Resident Director of the Rota Health Center shall be the expenditure authority for the funds appropriated under this subsection. (b) Three hundred fifty thousand dollars ($350,000) to the Commonwealth Cancer Association to support its patient support services. (1) Provided that, of the funds appropriated under this section, fifty thousand dollars ($50,000) shall be allocated for inter-island medical referral patient air transportation services in the First Senatorial District; and (2) Fifty thousand dollars ($50,000) shall be allocated for services in 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 the Second Senatorial District.,. as follows: (A) Twenty thousand dollars ($20,000) shall be used by the Mayor of Tinian and Aguiguan for Inter-island Medical Referral Supplemental Assistance; (B) Fifteen thousand dollars ($15,000) shall be used for the Voices of the CNMI, Tinian Chapter's awareness campaign, and other programs related to the organization's mission and objectives; (C) Fifteen thousand dollars ($15,000) shall be used to supplement Team CRADIC (Cancer, HIV, Aids & Diabetes Illness Coalition) for awareness campaign, and other programs related to the organization's mission and objectives; (D) The Mayor of Tinian and Aguiguan, in consultation with President or Chairperson of the respective organizations shall be the expenditure authority for the funds appropriated under this subsection; and (E) The respective organizations receiving funds under this subsection shall provide a report describing the expenditure of the funds within 30 days after the entire funds are expended. (c) Two hundred eighty-one thousand, three hundred forty dollars ($281,340) shall be used for the CNMI Medical Referral stipends for patients and escorts on 3

The expenditure authority shall be 2 the Director of the CNMI Medical Referral Office. 3 ( d) One hundred thousand dollars ($100,000) shall be used for Rota and 4 Tinian Inter-Island Medical Referral patient's lodging accommodations. The 5 expenditure authority shall be the Chief Executive Officer of the Commonwealth 6 Healthcare Corporation. 7 (e) Fifty thousand dollars ($50,000) shall be used for the Commonwealth 8 Healthcare Corporation's Betelnut Cessation Program. The expenditure authority 9 shall be the Chief Executive Officer of the Commonwealth Healthcare Corporation. 10 Section 3. Appropriation. Notwithstanding any laws to the contrary, four hundred 11 eighty-five thousand dollars ($485,000) from the Second Senatorial District's Solid Waste 12 Management Revolving Fund shall be used to pay Docomo Pacific, Inc. as the CNMI 13 Government's cost share for the installation and operation of a new fiber network on Tinian 14 as referenced in the Memorandum of Understanding between the Government of the CNMI 15 and Docomo Pacific, Inc dated March 10, 2016. 16 Section 4. Reprogramming. Notwithstanding any laws, provisions or regulations to 17 the contrary, funds appropriated under this Act shall not be reprogrammed for any other 18 purpose. 19 Section 5. Severability. If any provisions of this Act or the application of any such 20 provision to any person or circumstance should be held invalid by a court of competent 21 jurisdiction, the remainder of this Act or the application of its provisions to persons or 22 circumstances other than those to which it is held invalid shall not be affected thereby. 23 Section 6. Savings Clause. This Act and any repealer contained herein shall not be 24 construed as affecting any existing right acquired under contract or acquired under statutes 25 repealed or under any rule, regulation, or order adopted under the statutes. Repealers 26 contained in this Act shall not affect any proceeding instituted under or pursuant to prior law. 27 The enactment of the Act shall not have the effect of terminating, or in any way modifying, 28 any liability, civil or criminal, which shall already be in existence on the date this Act 29 becomes effective. 4
