BY-LAW NO. 2017-256 A by-law of the City of Ottawa to amend By-law No. 2005-208 and By-law No. 2013-416 respecting certain property maintenance and property standards issues in Sandy Hill. The Council of the City of Ottawa enacts as follows: 1. Section 1 of By-law No. 2005-208 entitled A by-law of the City of Ottawa respecting refuse or debris, clearing and cleaning of land and snow and ice removal, as amended, is amended by adding the following definitions: occupant means any person or persons over the age of eighteen (18) years in possession of the property; owner includes, (a) the person for the time being managing or receiving the rent of the land or premises in connection with which the word is used, whether on the person s own account or as agent or trustee of any other person, or who would receive the rent if the land and premises we let; and (b) the lessee or occupant of the property who, under the terms of a lease, is required to repair and maintain the property in accordance with the standards for maintenance and occupancy of the property; 2. The said By-law No. 2005-208 is amended by inserting the following heading and Sections immediately following Section 3A: GARBAGE DISPOSAL IN THE SANDY HILL WASTE AREA 3A1. (1) For purposes of this Section, a receptacle means a solid metal or plastic container for receiving garbage or refuse, or recyclable materials, such as a blue or black box, or compostable materials, such as a green bin. (2) Despite Section 3A, every owner or occupant shall ensure that all outdoor receptacles for the storage and pick-up of waste and refuse, and of recyclable materials, such as a blue box or black box, and of compost, such as a green bin: (a) (b) (c) be stored in the rear yard of the dwelling and, if there is insufficient space to do so there, in the side yard, and, if there is insufficient space to do so there, in the front yard,

provided that the receptacles are not visible from the highway, with the exception of one (1) green bin which may be stored in the front yard, including on a porch. (3) The receptacles pursuant to subsection (2) shall not be adjacent to any combustible structure. (4) Every owner or occupant shall ensure that, where the number of outdoor receptacles on the property exceeds eight (8) in total, they must be enclosed regardless of their location on the property. (5) Subsections (1), (2), (3) and (4) shall apply to owners and occupants in the Sandy Hill Waste Area, attached hereto as Schedule AA and deemed to be incorporated into the bylaw. (6) The heading Garbage Disposal in the Sandy Hill Waste Area and Section 3A1 are repealed on July 12, 2019. 3. Section 6 of the said By-law No. 2005-208 is amended by adding the following subsections immediately following subsection (2): (3) A Notice of Violation issued by registered mail pursuant to subsection (1) is deemed to have been served upon the recipient on the third day following mailing. (4) For purposes of Schedule AA, the Sandy Hill Waste Area, a Notice of Violation issued under Section 6(1) may be posted on site on the lands to which it relates but such posting shall not be a substitute for issuance of the Notice of Violation by registered mail or direct delivery. (5) Subsection (4) is repealed on July 12, 2019. 4. By-law No. 2013-416 entitled A by-law of the City of Ottawa to provide for standards under which properties are maintained is amended by adding the following heading and Section immediately following Section 12: GARBAGE DISPOSAL IN THE SANDY HILL WASTE AREA 12A. (1) For purposes of this Section, a receptacle means a solid metal or plastic container for receiving garbage or refuse, or recyclable materials, such as a blue or black box, or compostable materials, such as a green bin. (2) Despite Sections 12(7), 12(8) and 12(9), every owner or occupant shall ensure that all outdoor receptacles for the

storage and pick-up of waste and refuse, and of recyclable materials, such as a blue box or black box, and of compost, such as a green bin: (a) (b) (c) be stored in the rear yard of the dwelling and, if there is insufficient space to do so there, in the side yard, and, if there is insufficient space to do so there, in the front yard, provided that the receptacles are not visible from the highway, with the exception of one (1) green bin which may be stored in the front yard, including on a porch.
