Committee on the Elimination of Discrimination against Women Status of submission of overdue reports by States parties under article 18 of the Convention Report of the Secretariat of the Committee 1. Rule 49 of the rules of procedure of the Committee on the Elimination of Discrimination against Women provides that, at each session, the Secretary-General shall notify the Committee of the non-submission of any report that States parties are required to submit under article 18 of the Convention on the Elimination of All Forms of Discrimination against Women. In practice, this information is provided annually. 2. Annex I to the present report contains a list of 48 States parties whose reports are due or overdue and had not been submitted as at 31 December 2011. In some cases, the Committee has modified the date of submission calculated in accordance with article 18, paragraph 1, of the Convention, and this is reflected in the report. 3. Annex II to the present report contains a list of 13 States parties (out of the 48 States parties mentioned above) whose reports are five years or more overdue. Of these 13 States, 4 States are scheduled to be considered in the absence of a report at upcoming sessions of the Committee based upon previous decisions of the Committee (Central African Republic, Saint Vincent and the Grenadines, Senegal and the Solomon Islands). 4. The above overdue reports also include initial reports. Initial reports have not yet been received from the Cook Islands, Dominica 1, Kiribati, Micronesia, Monaco, San Marino, Sao Tome and Principe, Solomon Islands, and Swaziland. 5. It is further noted that from 1 January to 31 December 2011, 30 reports were received. During the same time period, the Committee considered 23 reports. At present 42 reports are awaiting consideration by the Committee (See Annex III). 6. In March 2011, the Secretariat transmitted reminders to the Permanent Missions of 34 States parties 2 with overdue reports. Of the 34 States parties contacted, 11 States submitted their overdue reports, including: Afghanistan, Benin, Bosnia and Herzegovina, Cameroon, Cyprus, Dominican Republic, Hungary, Iraq, Qatar, Senegal and Tajikistan. 7. Reminders were sent to the following remaining States with overdue reports in January 2012: Belize, Bolivia, Cook Islands, Croatia, Eritrea, Georgia, Ghana, Guinea, India, Ireland, Malaysia, Maldives, Mauritania, Mozambique, Namibia, Peru, Romania, Saint Lucia, and Viet Nam. 1 The combined initial to seventh periodic report were considered in the absence of a report at the 43 rd session of the Committee. The eighth periodic report was due on 31 December 2010. 2 Afghanistan, Antigua and Barbuda, Barbados, Benin, Bosnia and Herzegovina, Brunei Darussalam, Cyprus, Dominica, Dominican Republic, Federated States of Micronesia, Gabon, Gambia, Hungary, Iraq, Latvia, Mali, Marshall Islands, Monaco, Nicaragua, People s Republic of China, Philippines, Poland, Qatar, Saint Kitts and Nevis, San Marino, Sao Tome and Principe, Senegal, Solomon Islands, Suriname, Swaziland, Tajikistan, Thailand, Trinidad and Tobago and Venezuela. 1

8. With respect to exceptional reports. The exceptional report of the Democratic Republic of the Congo was due on 16 November 2010. A reminder was transmitted to the Permanent Mission dated 15 November 2011. The exceptional report of Guinea was due on 10 November 2009. Reminders were sent to the Permanent Mission dated 10 October 2010 and 16 November 2011. Recommendations 9. It is recommended that the Committee take a decision with respect to the following 5 States with overdue periodic reports of 5 years or more to submit all overdue reports within two years and failing receipt of the reports, and as a last resort, the Committee would proceed with consideration of the implementation of the Convention in those States parties in the absence of a report (Antigua and Barbuda (4 to 6), Barbados (5 to 7), Democratic Republic of Korea (2 and 3), Saint Kitts and Nevis (5 to 7), and Trinidad and Tobago (4 to 6). 10. Moreover, the Committee may wish to provide the above States with the option of using the List of Issues Prior to Reporting (LOIPR) approach in such cases, i.e., long overdue reports. The LOIPR approach already reflects the practice of the Committee in large part regarding consideration of States parties in the absence of a report. With the LOIPR approach, however, the State party concerned can opt for the LOIPR approach instead of providing a report. In addition, with the LOIPR approach, the list of issues and replies thereto constitute the report. 11. With respect to the remaining reports that are 5 years or more overdue, which contain initial reports (Kiribati (1 and 2), San Marino (1 and 2), Sao Tome and Principe 1 and 2), and Swaziland (1 and 2), it is suggested that reminders be transmitted to the Permanent Missions requesting their overdue reports, including initial reports. It is further noted that the Committee has considered a State party in the absence of a report that had not submitted its initial report (Dominica was considered at the 43 rd session). In that case, however, the report was more than 20 years overdue. The Committee may also wish to provide the above States with the LOIPR option. 2
