BOROUGH OF AVALON REGULAR COUNCIL MEETING December 20, 2016 The Meeting was called to order at 7:00 pm with President Joshua Klicker presiding, leading the Meeting in the Pledge of Allegiance. A prayer followed by Mayor David Haslett. A moment of silence was held in memory of Ethel Howie, a long time employee of Avalon Borough. Roll Call of those present: Victoria Donnelly, Joshua Klicker, Thomas Lloyd, Shawn McWilliams, Patrick Narcisi, Lee Nelson, William Pascale, John Vetterly. Also present: Solicitor Ott, Engineer Scally, Chief Kokoski, Deborah Grass and Lorraine Makatura. Absent: Ralph Cortese, Tax Collector, Klicker. Nelson moved: To accept the Minutes of the November 15, 2016 Avalon Borough Council Meeting. Pascale moved: Donnelly abstained. To accept the Tax Collector s Report as submitted for December 20, 2016. To approve the List of Bills as submitted for December 20, 2016, in the amount of $510,396.85. Pascale clarified the amount - $100,000 was a final payment to Brindlee Mountain for the purchase of the firetruck, and $247,997.86 for the S. Brimingham Road repair. To approve the Treasurer s Report as submitted for December 20, 2016. McWilliams 2 nd 1

To adopt the 2017 Budgets as advertised and displayed. General Fund $3,061,750 Sewer Fund $1,318,095 Fire Truck Fund $ 69,870 Health & Sanitation $ 5,000 Liquid Fuels Fund $ 120,000 Donnelly 2 nd To adopt Ordinance No. 1368 establishing the real estate tax rate for 2017 at 9.83 mills. Commented that this is not a tax increase. Donnelly 2 nd Mayor Haslett swears in Leo DiCesare as a Police Officer of Avalon Borough Police Department. Officer DiCesare takes a moment to thank Chief Kokoski and Council and introduce his family. PUBLIC COMMENT (Agenda Items): Kevin Moss 706 Sedalia Avenue Presented the story of his brother, Pete Moss, killed a fallen Avalon Firefighter. A Go Fund Me account has been opened to raise money for a memorial in his honor. Looking for approval to place the memorial in front of the Borough Hall. President Klicker and Narcisi noted that this had been discussed prior to the meeting and Council is in favor of the memorial. Mr. Moss will continue to advise as funds become available and he is closer to installation. President Klicker was given a request to purchase or match funds to purchase benches and trash cans at every bus stop. Councilman Narcisi announced the results of Avalon Volunteer Fire Department s annual election and introduced the new Fire Chief, Charles Berie. Mr. Berie served as Assistant Chief for 10 years. Chief Berie took a moment to address council. Received and opened one bid for the Mini-pumper from Andy Bordt in the amount of $1,801.00. 2

MAYOR: Ø Request received to participate in the National School Choice Week officially recognizing January 22-28, 2017. Recommends submitting a proclamation supporting National School Choice Week. SECRETARY/MANAGER: Merry Christmas and happy holidays! ENGINEER: Report submitted. Spruce Run / Ball Field Culvert Repair Project (Contract 2016-02) G. Salandro Landscaping, LLC has completed the project in its entirety. Paving was not required at the entrance therefore was removed from the contract. Contractor provided additional electrical work that was required within the site limits. The total cost of the project was reduced from $67,000 to $57,605. Recommendation for payment to Contractor for Payment Application Number 2 in the amount of $13,005.00 QVCOG CD No. 41-3.11.4 - Demolition of 214 Cleveland Ave. Residence Continental Construction authorized to start construction. Awaiting a start date from the Contractor. QVCOG CD No. 41-7.7 - ADA Ramps ADA Handicap Ramps Bids due at the QVCOG office no later than 10 AM December 28, 2016 QVCOG CD No. 42-3.11.4-423 Florence Demolition 423 Florence Demolition Preparing bid package now (looking to complete this project in Dec 2016 or Jan 2017 if needed). Interim Consent Decree Source Reduction Study Progress Report submitted to ACHD and ALCOSAN on 12/1/16. ALCSOAN has been televising the interceptors along Spruce Run Meeting with Tim Prevost of ALCOSAN held on December 8 th to discuss ALCOSAN s plan to flow monitor Spruce Run. 3-4 locations selected. Plan to install this month for monitoring to begin in early January. Installations will be done during the day. 3

ALCOSAN will add O-20 to the monitoring list to assist with a potential Demonstration Project. Some monitoring could occur in the evening. Municipal Separate Storm Sewer System (MS4) Public Participation update - School presentation held on December 1 st - Avalon Elementary 4th grade students applied Avalon s MS4 permit concepts through student projects and presentations. Presentations simulated real-life effects of hydrology to the local environment in Avalon Borough and throughout the ALCOSAN region. 221 South Chestnut Street Demolition On Nov 21 st, Chester, Avalon Borough, and the ACHD conducted a pre-bid site visit with reputable asbestos contractors to review the asbestos abatement requirements. The previously selected general contractor and a recommended low-bid asbestos contractor will be performing the work, assuming all contract documentation is successfully processed. After contract documents are successfully processed, the next intended step is to arrange for the pre-construction meeting with both contractors and issue the notice to proceed to complete the work. SOLICITOR: Ø Announced Executive Session held immediately prior to the Council meeting to discuss labor negotiations and legal matters. FINANCE: Pascale moved: To adopt Resolution No. 1131 approving a vacant property application for Jennifer Reisdorf Parcel 214-L-236 on Spruce Run Road. To accept a proposal from Wesbanco for the Tax and Revenue Anticipation Note (TAN Loan) in the amount of $300,000 at a rate of 2.25% and to adopt Resolution No. 1132 approving the borrowing and establishing the terms and conditions of the loan. Donnelly 2 nd Thank you for Council and Administration Office for completing the budget. 4

SAFETY: Narcisi moved: To accept the bid from Andy Bordt for the purchase of 1978 GM Fire Department mini-pumper for $1,801.00. To accept the resignation letter from Anthony Ricchiutto from employment as a full-tome police officer with the Borough of Avalon Police Department. Donnelly 2 nd To appoint Leo DiCesare to a position as a full-time police officer with the Borough of Avalon Police Department, effective January 1, 2017, conditioned on the successful completion of physical and psychological examinations as required by the Civil Service Commission regulations. To appoint Christopher Rossetti to a position as a designated part-time police officer with the Borough of Avalon Police Department effective January 1, 2017, pursuant to an agreement with the Borough. To request that the Civil Service Commission void the current police eligibility list and request that a new test be administered. To authorize final payment in the amount of $100,000.00 to Brindlee Mountain for the fire pumper truck. President Klicker commented to reach out to the AVFD Treasurer on future payments. Klicker commented on the stop signs at Fisk and Florence. Debby Grass stated we did not locate an ordinance issuing any stop signs. Suggested to the Chief, as a project to be included as part of the codification, we identify all the stop signs and one way streets. 5

Solicitor Ott stated the Mayor can issue temporary stop sign locations. Further discussion on what needs to be done, (traffic study) to establish the 4-way stop at Fisk Avenue and Florence Avenue. Solicitor will work on the ordinance and work with the Mayor, and issue by resolution. STREETS: Vetterly moved: To approve the collective bargaining agreement with Teamsters Local Union 249 for January 1, 2015 through December 31, 2018 and execute related Settlement Agreement. To authorize an agreement with the Borough of Ben Avon Heights for one-call and public works services for 2017 contingent on the Borough approving same. To authorize an agreement with Kilbuck Township for one-call and public works services for 2017 contingent on the Township approving same. President Klicker that new agreements were created where there were none in place. To approve a change order reducing the Spruce Run Pipe Repair contract by $9,395 for G. Salandro Landscaping. To approve final payment in the amount of $13,005 to G. Salandro Landscaping for the Spruce Run Road Pipe Repair. To approve payment in the amount of $247,997.86 to Mele & Mele & Sons for the S. Birmingham Road Project. 6

Pascale noted that this number is inflated somewhat due to Columbia Gas doing their restoration at the same time, their portion being approximately $87,000 and storm line repair of approximately $27,000 covered from the sewage surcharge account. BOROUGH DEVELOPMENT: McWilliams moved: To authorize a 3 year lease agreement with Middle Atlantic Services for office space at the David Mayernick Building pending final approval of the Solicitor. Lloyd 2nd Discussion on the lease and changes to the rental agreement. To accept the low bid for asbestos removal at 221 Chestnut Street in the amount of $17,050 from Top Sipes Demolition. Clarified that this is for asbestos removal only. 4 th of July: Nelson moved: To authorize payment in the amount of $201.54 to the Fourth of July Committee to reimburse the Committee for 2016 expenses. LIBRARY: Mr. Lloyd read a letter from Santa thanking the Borough for all the work done in preparation for and during the Avalon Now for Brighten the Season. Library is working on adopting updating bylaws for working with the county library system. Debby Grass and I will be meeting with COG to discuss the issues Avalon Borough has with the COG 7

COUNTY: Christmas Party was held, no meeting at this time. NEW BUSINESS: o Ron Ganza, PSAB, issues regarding advertising in newspapers vs. online. Contact your state representative, Fontana, to support the bill to be passed regarding this issue. President Klicker commented that this body has seen trauma and change, thank you to all. Proud in what we have done and the direction we are moving and the synergy in working together to make the Borough a better place. Lloyd moved to adjourn at 7:53 pm.
