Republika e Kosovës Republika Kosovo - Republic of Kosovo Kuvendi - Skupština - Assembly Law No. 04/L-126 ON AMENDING AND SUPPLEMENTING THE LAW NO. 03/L-099 ON IDENTITY CARD Assembly of Republic of Kosovo; Based on Article 65 (1) of the Constitution of Republic of Kosovo, Approves LAW ON AMENDING AND SUPPLEMENTING THE LAW NO. 03/L-099 ON IDENTITY CARD Article 1 1. Article 2 of the basic Law, definition Identity Card shall be amended and reworded as Identity Card - means a public document that contains personal data in physical and electronic form that are stored in the chip, issued to the citizen of the Republic of Kosovo that certifies the identity and citizenship of the bearer of document. 2. Article 2 of the basic Law, definition Identity card for foreigners shall be amended and reworded as Identity card for foreigners - means a public document that contains personal data in physical and electronic form that are stored in the chip, issued to the foreign citizens and stateless persons who have regulated the residence in the Republic of Kosovo according to the respective Laws into force. 1
3. Article 2 of the basic Law, definition Resident shall be amended and reworded as Citizen of Kosovo - means person who have citizenship of Republic of Kosovo according to the Law on Citizenship. 4. Article 2 of the basic Law, definition Days shall be deleted from the text of the Law. 5. Article 2 of the basic Law, after definition Permanent stay there shall be added a new definition Chip with the following text: Chip - means electronic device incorporated in the Identification card in which the data of Identification card holder is put electronically. Article 2 Article 4 of the basic Law, paragraph 4.2 shall be reworded as 4.2. Foreign nationals and stateless persons who reside in the Republic of Kosovo, Identity cards are given on the basis of relevant Laws into force. Article 3 1. Article 8 of the basic Law, paragraph 8.2 shall be reworded as 8.2. Identity card shall contain: a) emblem of the Republic of Kosovo; b) name of the state; c) name of the document; d) surname; e) name; f) citizenship; g) gender; h) date of birth; i) place of birth; 2
j) expiration date; k) photography; l) date of issue; m) issuing body; n) personal number; o) number of the municipal center of registration; p) ID number; q) residence; r) signature of applicant; s) machine readable zone of data. 2. Article 8 of the basic Law, paragraph 8.3 shall be reworded as 8.3. Identification Card shall contain electronic chip in which except data from Article 8 paragraph 8.2, the face image, finger prints and residence addresses are saved. 3. Article 8 of the basic Law, paragraph 8.7 shall be reworded as 8.7. Identity card forms and Identity card are produced by the legal person authorized by the Ministry. Article 4 Article 9 of the basic Law shall be reworded as Forms and Identity cards are printed in the official languages in accordance with the Law on the Use of Languages. Article 5 Article 13 of the basic Law, paragraph 13.1. the term from thirty ( 30) days shall be replaced with the term from fifteen (15) days. 3
Article 6 Article 15 of the basic Law, paragraph 15.2. shall be reworded as 15.2. Citizens younger then eighteen (18) years and citizens who are not capable to act, at the moment of application should be accompanied by legal representative. Article 7 1. Article 16 of the basic Law, paragraph 16.2, point d) "temporary residence" shall be deleted from the text of the Law. 2. Article 16 of the basic Law, paragraph 16.7. term from thirty (30) days shall be replaced by term from ninety (90) days. Article 8 Article 19 of the basic Law shall be reworded as State institutions depending on authorization determined by the Law, may use data from the records for identity cards issued in accordance with the Law on Protection of Personal Data. Article 9 Article 21 of the basic Law, paragraph 21.1 first part of paragraph shall be reworded as 21.1. With fine of twenty-five (25) up to one hundred (100) Euro, the citizen shall be punished for offense: Article 10 Article 23 of the basic Law shall be reworded as All revenues that are realized by implementation of this Law shall be deposited in the Budget of the Republic of Kosovo. 4
Article 11 Article 25 of the basic Law shall be reworded as Identity cards of the Republic of Kosovo shall be used until the expiry of their validity. Article 12 Entry into force This Law shall enter into force fifteen (15) days after publication in the Official Gazette of the Republic of Kosovo.
