Page 1 Minutes of the Regular Meeting of the Township Committee of the Township of Hillsborough, in the County of Somerset, State of New Jersey, held in the Municipal Complex at 7:30 p.m. on the above date. Upon call of the roll, the following Committee members were recorded present: Committeeman Carl Suraci, Committeeman Greg Burchette, Committeewoman Gloria McCauley, Deputy Mayor Doug Tomson and Mayor Frank DelCore. Also, in attendance were Attorney William Willard on behalf of Township Attorney Albert Cruz, Township Clerk Pamela Borek and Township Administrator Anthony Ferrera. SALUTE TO THE FLAG Following roll call, Mayor DelCore advised that notice of this meeting was made in accordance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Laws of 1975, by posting on the bulletin board at the Hillsborough Township Municipal Complex and notifying the officially designated newspapers that this meeting would take place at the Hillsborough Township Municipal Complex at 7:30 p.m. on January 8, 2013. APPROVAL OF MINUTES Approval of the November 27, 2012 Regular Meeting Minutes Upon motion by Deputy Mayor Tomson, seconded by Committeeman Suraci, the minutes of the November 27, 2012, Regular Meeting was approved upon the call of the roll. Abstain Burchette Approval of the December 11, 2012 Regular Meeting Minutes Upon motion by Committeewoman McCauley, seconded by Deputy Mayor Tomson, the minutes of the December 11, 2012, Regular Meeting Minutes was approved upon the call of the roll. Page 2 Committeeman Suraci informed residents of an upcoming free rabies vaccination clinic for cats and dogs. Deputy Mayor Tomson Deputy Mayor Tomson stated that he along with Committeeman Burchette attended some of the Reorganization meetings for various Boards and Commissions of the Township. Deputy Mayor Tomson also informed residents that the Health Office will now be open one evening a month. Deputy Mayor Tomson further informed residents that the Recreation Department is offering a floor hockey program. Mayor DelCore Mayor DelCore also thanked the Robo Raiders for their invitation this past weekend. Mayor DelCore stated that earlier in the day he had the very distinct honor in attending Governor Christie s State of the State address in Trenton. He stated that the address began with a somber note recalling the devastation to our fine state brought on by Hurricane Sandy. However, he stated that there was a bit of a silver lining as Governor Christie recognized some of the heroic efforts of emergency responders during the storm. Mayor DelCore stated that many of our Boards and Commissions are in the reorganization process of the year, with all our new appointments being sworn in and the first meetings of the year taking place. He further went on to thank the countless volunteers for the time and talents dedicated to all of the Boards & Commissions. Mayor DelCore stated that the permanent repair to the Buckeye line started yesterday and that the completion is expected within the next 10 days or so. Mayor DelCore stated that Buckeye will be at a future meeting to provide further information on the cleanup efforts. NEW BUSINESS None at this time PUBLIC COMMENT ON NEW BUSINESS AND MATTERS NOT ON THE AGENDA None at this time None at this time PUBLIC HEARINGS INTRODUCTION OF NEW ORDINANCES 2013-01 An ordinance repealing Chapter 92, titled Police Department, Section 22, titled Special Policemen, of the Code of the Township of Hillsborough, in its entirety. Further consideration of this ordinance and public hearing will be held on February 12, 2013. WHEREAS, it is the purpose of this Ordinance to repeal Chapter 92, titled Police Department, Section 22, titled Special Policemen of the Code of the Township of Hillsborough, in its entirety. NOW, THEREFORE, BE IT ORDAINED by the Township of Hillsborough, Somerset County, New Jersey, that Chapter 92, titled Police Department, Section 22, titled Special Policemen of the Code of the Township of Hillsborough, is hereby repealed in its entirety. BE IT FURTHER ORDAINED that this Ordinance shall take effect as provided by law. Mayor DelCore stated that last fall the Township Committee recognized the efforts of our Special Police with a presentation and a proclamation in honor of their service. Due to the training qualification requirement and the actual number of times that they were permitted to be used it was deemed that became cost prohibitive to continue at this time with this program. Committeeman Suraci moved that the aforesaid Ordinance be passed on first reading and that the Ordinance be further considered at a public hearing held on February 12, 2013 at 7:30 p.m. Said motion was seconded by Committeeman Burchette and unanimously approved upon call of the roll.

Page 4 CONSIDERATIONS 1. Resolution authorizing the re-appointment of Megan Troeller as a part time floater for the Township of Hillsborough at an hourly rate of $14.50 per hour, not to exceed 29 hours per week, through July 31, 2013. WHEREAS, there is the need for a part time floater for the Township of Hillsborough; and WHEREAS, the Administrator recommends the appointment of Megan Troeller to the position of part time floater for the Township of Hillsborough at an hourly rate of $14.50 per hour, not to exceed 29 hours per week, through July 31, 2013. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the recommendation of the Administrator is hereby accepted and approved, and Megan Troeller be appointed to the position of part time floater for the Township of Hillsborough at an hourly rate of $14.50 per hour, not to exceed 29 hours per week, through July 31, 2013. Mayor DelCore stated that Ms. Troeller started as an intern with the Township. Mayor DelCore reminded everyone that part time employees do not accrue benefit costs and provide a budget savings to the Township. This resolution extends Ms. Troeller s part time appointment. Upon motion by Committeeman Burchette seconded by Committeeman Suraci, the aforesaid resolution was unanimously approved upon call of the roll. 2. Resolution requesting approval of the Director of the Division of Local Government Services to establish a Dedicated Trust by Rider for Uniform Construction Code penalty fees collected by the Building Department. WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance; and WHEREAS, N.J.S.A. 40A:4-39 provides that the Director of the Division of Local Government Services may approve expenditures of monies by dedication by rider; NOW, THEREFORE, BE IT RESOLVED, by the governing body of the Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. The Township of Hillsborough will be receiving monies to be used for training, education, technical support programs, certification, new equipment and transportation in the Building Department;

Page 5 2. The governing body hereby requests permission of the Director of the Division of Local Government Services to pay expenditures for the Building Department as per N.J.S.A. 40A:4-39; and 3. The Municipal Clerk of the Township of Hillsborough is hereby directed to forward two certified copies of this resolution to the Director of the Division of Local Government Services. Mayor DelCore stated that Ordinance 2012-34 was adopted at December 18, 2012 Township Committee Meeting. The ordinance stated that fees collected from penalties shall be retained by the Building Department and placed in a special trust fund to be applied to the cost of training, education, etc. In order to establish a special trust fund, a resolution must be passed by the governing body, after which the request is forwarded to the Division of Local Government Services for approval. Upon motion by Committeeman Suraci seconded by Committeeman Burchette, the aforesaid resolution was unanimously approved upon call of the roll. 3. Resolution accepting the Central Jersey Housing Resource Center - CJHRC proposed 2013 Affordable Housing Agency agreement, effective January 1, 2013 through December 31, 2013 and authorizing the Mayor and the Township Clerk to enter into said agreement with CJHRC for existing affordable housing rental units at New Center Greens and Crestmont Hills and the resale units at Hearthstone at Hillsborough, in an amount not to exceed $13,900.00. WHEREAS, the Central Jersey Housing Resource Center (CJHRC) has submitted the following Affordable Housing Agency Proposals: the 2013 Affordable Housing Independent Agency Agreement for the administration of the affordable housing rental units at New Center Greens, Claremont Hills and Crestmont (Hills) Village and the resale units at Hearthstone at Hillsborough; and WHEREAS, this agreement will be effective January 1, 2013 through December 31, 2013; and WHEREAS, the Township Planner recommended that the Township approve said agreements as to ensure continued compliance with the applicable affordable housing requirements; and WHEREAS, funds are available and have been certified as such by the Chief Finance Officer and said certification is attached to this resolution. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the Mayor and the Township Clerk are hereby authorized to enter into an Affordable Housing Independent Agency Agreement for New Center Greens, Claremont Hills, Crestmont (Hills) Village and Hearthstone at Hillsborough, with CJHRC not to exceed $13,900.00

Page 6 Mayor DelCore state this is a professional services agreement for management services for the units at Hearthstone at Hillsborough, Crestmont Hills and New Center Greens for 2013. Central Jersey Housing Resource Center provided these services in the past. This is a highly technical service provided and it is recommended by our Township Planner that CJHRC again provide these administrative services. These costs are paid from the Affordable Housing Trust Account, not utilizing tax dollars. Upon motion by Committeeman Suraci seconded by Committeewoman McCauley, the aforesaid resolution was unanimously approved upon call of the roll. 4. Resolution dissolving the GSA Depot Parks and Recreation Advisory Committee, effective January 1, 2013. WHEREAS, the Township Committee of the Township of Hillsborough, State of New Jersey, County of Somerset had previously created a GSA Depot Parks and Recreation Advisory Committee comprised of local residents to solicit public opinion including input from the various parks, recreation, sports, and open space advocates within the Township, and to advise the Township Committee on the development of the site for parks and recreation use; and WHEREAS, the Township Committee is of the opinion that this task has been successfully completed; and WHEREAS, the Township Committee desires to dissolve the GSA Depot Parks and Recreation Advisory Committee, effective January 1, 2013. NOW, THEREFORE, be it resolved by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the GSA Depot Parks and Recreation Advisory Committee is dissolved, effective January 1, 2013. Mayor DelCore stated as the Township is moving to the next phase with respect to the GSA project and the services of this advisory committee are no longer needed. He thanked the individuals, who over the years have served the Township on this advisory committee. Upon motion by Committeewoman McCauley seconded by Committeeman Suraci, the aforesaid resolution was unanimously approved upon call of the roll. 5. Resolution amending Sustainable Hillsborough Steering Committee appointments and eliminating alternate Seats #3 and #4, effective January 1, 2013. WHEREAS, the Township Committee of the Township of Hillsborough, State of New Jersey, County of Somerset had previously established by Resolution the Sustainable Hillsborough Steering Committee as the official coordinating body of the strategic plan for a Sustainable Hillsborough;

Page 7 WHEREAS, the Township Committee desires to amend the number of years for the term served from a two (2) year appointment to a one (1) year appointment; and WHEREAS, the Township Committee also desires to amend the membership of this committee by reducing the number of alternate seats from four (4) to two (2) alternate seats, effective January 1, 2013. NOW, THEREFORE, be it resolved by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the Sustainable Hillsborough Steering Committee shall have only two (2) alternate seats and all appointments shall be for one (1) year terms, effective January 1, 2013. Mayor DelCore stated this resolution authorizes the term of office for the Sustainable Hillsborough Steering Committee to be a one year term and also eliminates alternate seats #3 and #4. Upon motion by Committeewoman McCauley seconded by Committeeman Burchette, the aforesaid resolution was unanimously approved upon call of the roll. CONSENT 1. Resolution ratifying and confirming the 2013 Resolution 5K Run & Walk which was held in Hillsborough Township on Tuesday, January 1, 2013, pursuant to the requirements outlined by Chief Paul Kaminsky. WHEREAS, the Resolution Run requested to hold their 2013 Resolution 5K Run & Walk on Tuesday, January 1, 2013, in Hillsborough Township; and WHEREAS, the 2013 Resolution 5K Run & Walk Director has produced a certificate of insurance naming the Township of Hillsborough as an insured; and WHEREAS, Chief Kaminsky and Hillsborough Township Police Department s Traffic Safety Bureau have determined that the planned route will provide an acceptable level of safety for the runners. NOW, THEREFORE, be it resolved by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the 2013 Resolution 5K Run & Walk was hereby authorized to hold a race in Hillsborough Township on January 1, 2013. 2. Resolution authorizing the installation of one new street light at the intersection of River Road and Roycefield Road pursuant to the recommendation of the Chief of Police and Assistant Township Engineer.

Page 8 WHEREAS, Assistant Township Engineer Thomas Belanger and the Township of Hillsborough Police Chief Paul Kaminsky recognize the need for a street light at the intersection of River Road and Roycefield Road; and WHEREAS, Assistant Township Engineer conducted a field survey and identified utility pole No. 6665HB as able to accommodate a streetlight; and WHEREAS, Public Service Electric & Gas Corp. advised that in order to initiate the installation of the street light the Township must commit to the payment of the associated annual electrical costs of approximately $300.00 a year for the operation of the street light; and WHEREAS, Assistant Township Engineer Thomas Belanger recommends that the Township Committee commit to pay the annual electrical costs for the operation of the street light in order to initiate the installation of the street light. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Assistant Township Engineer and the Hillsborough Township Police Chief Pau Kaminsky be and hereby accepted and approved. Upon motion by Committeewoman McCauley, seconded by Committeeman Burchette, the consent agenda was unanimously approved upon call of the roll. CLAIMS LISTS Mayor DelCore presented Claims Lists 2013-01. Upon motion by Committeeman Burchette, seconded by Committeewoman McCauley, Claims List 2013-01 was unanimously approved upon call of the roll. EXECUTIVE SESSION RESOLUTION WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12 (b) (1-9), Chapter 231, Public Laws of 1975, permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, the Township Committee is of the opinion that such circumstances exist. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough in the County of Somerset, State of New Jersey, as follows: 1. The public shall be excluded from discussion of and action upon the hereinafter specified subject matters.

Page 9 2. The general nature of the subject matter to be discussed is as follows: a. Pending Litigation: State of New Jersey (Township of Hillsborough) v. Hercules Enterprises 3. The Township Committee may take official action on those items discussed in Executive Session upon completion of the Executive Session. 4. The minutes of the discussions shall be made available to the public as soon as the matters under discussion are no longer of a confidential or sensitive nature. 5. This Resolution shall take effect immediately. Upon motion by Deputy Mayor Tomson seconded by Committeeman Burchette, the aforesaid resolution was unanimously approved upon call of the roll. Committeeman Suraci motioned to reopen the public meeting after the executive session adjourned. The motion was seconded by Committeeman Burchette, and was unanimously approved upon call of the roll. ADJOURNMENT Upon motion by Committeewoman McCauley, seconded by Committeeman Suraci, the meeting duly adjourned at 8:54p.m. Said motion was carried unanimously upon voice vote.
