Corbett on May 4, 2017 at 7:31 p.m. in the Municipal Building at 300 West Thirteen Mile Road, Madison Heights, Michigan. Present: Chairwoman L. Corbett, Vice Chairman Oglesby and members: R. 17-03. Election of Chairperson. Chairwoman Corbett called for nomination for the position of Chairperson of the Board. Motion by Ms. Kehoe, seconded by Mr. Kimble, to nominate Linda Corbett as Chairwoman for a one-year term to expire on February 1, 2018. There being no further nominations, the vote was called. Rear Yard Setback 108 E. Kalama. Application #17-01 Chairwoman Corbett opened the public hearing at 7:35 p.m. to hear comment, if any, on application #17-01 Kristin Frankin, 108 E. Kalama, Madison Heights stated she would like add a sunroom to the back of the house and she would like to include a swim spa in the sunroom. She stated this would be an improvement for her health, the property, and to the neighborhood. Ms. Franklin 2 05-04-17 ZBA
indicated that she does not have a garage as most of the other homes in the area do and this addition would be in place of a garage. Ms. Franklin provided the board with a photo of what the sunroom would look like along with signed letters from her neighbors indicating that they do not have any issues with the addition to her home. Additionally, she stated that the homes on either side of her are rental homes and she has spoken to the landlords of both properties and neither has an issue with the addition, and both landlords have indicated they would be happy to see the improvement to the property. There being no further comments, the public hearing was closed. Motion by Mr. Corbett, Seconded by Mr. Kimble, WHEREAS, an application has been filed by Kristin Franklin, the Petitioner and homeowner of 108 E. Kalama is requesting a variance from Section 10.401 of the Zoning Ordinance to allow expansion of a structure (existing home) to extend 12 into the required 35 rear yard setback; and WHEREAS, a notice of public hearing was published in the Madison Park News on April 19, 2017 and 246 notices were mailed to property owners within 500 feet of the aforementioned property; and WHEREAS, a report has been received from the Community Development Department stating that: RELEVANT INFORMATION 1. The applicant is the property owner. 2. The proposal is to add a sunroom, which would encroach 12 into the required rear yard. In other words, the setback from the rear property line will be 23. where 35 is required. SITE PLAN COMMITTEE ACTION Staff notes that the proposal is to enclose an 8 x 14 swim spa. An inground pool could occupy the majority of the rear yard, and could include an attached or detached cabana-like structure larger than proposed. Therefore, staff has no objections to the proposal, subject to a condition that no additional accessory structures be constructed. 3 05-04-17 ZBA

NOW, THEREFORE, BE IT RESOLVED, that the Madison Heights Zoning Board of Appeals approves a variance from Section 10.401 of the Zoning Ordinance to allow expansion of a structure (existing home) to extend 12 into the required 35 rear yard setback as requested; as it will enhance the homes usefulness, the economic value of the property and is harmonious with the neighborhood; with a condition that no additional accessory structures be constructed. A variance from Section 10.804 (2) is requested to allow storage at a property currently zoned M-1, which does not allow outside storage. Property is located at 30200 Stephenson. RELEVANT INFORMATION 1. The applicant is not the property owner, but rather a potential tenant. 2. The proposal is to allow the storage of new vehicles for a period of six months. None. PREVIOUS ACTIONS SITE PLAN COMMITTEE ACTION The Site Plan Committee has reviewed this request. The Committee has the following three recommendations to be placed if the ZBA were to approve the request. 1. There to be no Parking with-in the required front yard setback. 2. The approval to cease at a date six months from the approval date. 3. The approval to become void upon the issuance of a Certificate of Occupancy to the Building on site.
