Lefkow Magistrate Judge Nan R. Nolan CONSENT JUDGMENT OF NON-INFRINGEMENT Plaintiff, Thermapure, Inc. and Defendant, Servpro Industries, Inc. (collectively, the Parties having considered the facts and applicable law and having agreed to the entry of this Consent Judgment, it is therefore found, adjudged, and decreed as follows: FINDINGS OF FACT 1. Plaintiff Thermapure, Inc. ( Thermapure is a California corporation having its principal place of business at 180 Canada Larga Road, Ventura, California 93001. 2. Defendant Servpro Industries, Inc. ( Servpro is a Nevada corporation having its principal place of business at 801 Industrial Boulevard, Gallatin, Tennessee 37066. 3. Thermapure is the owner of all right, title and interest is U.S. Patent Nos. 6,327,812 (the 812 patent. 4. On July 28, 2010, in the United States District Court for the Northern District of Illinois (the Illinois Action, Thermapure filed claims against Servpro for alleged infringement

On November 16, 2010, Servpro filed counterclaims against Thermapure for non-infringement of the 812 patent and that the 812 patent was invalid. 5. The Parties now desire to terminate this litigation through this Consent Judgment and an associated Covenant Not To Sue. 6. Any Finding of Fact that is deemed to be a Conclusion of Law is hereby adopted as such. CONCLUSIONS OF LAW 7. This is an action for patent infringement arising under the patent laws of the United States, 35 U.S.C. 271 et seq. This Court has jurisdiction over the subject matter of this action pursuant to 28 U.S.C. 1331, 1338(a and 2201. 8. This Court has personal jurisdiction over the Parties, and venue is proper in this district pursuant to 28 U.S.C. 1400(b. 9. Servpro has not directly infringed and is not directly infringing the 812 patent through making, using, selling, offering to sell, or importing any Servpro product or service. Servpro has not induced or contributed to and is not inducing or contributing to the infringement of the 812 patent by another through any teaching or other act of Servpro or through the sale or offer for sale of any Servpro product or service. 10. This Consent Judgment shall finally conclude and dispose of this litigation as to Thermapure and Servpro. This Consent Judgment shall be entitled to issue and claim preclusion effect against the Parties hereto and their successors and assigns in any future litigation related to the 812 patent. 11. Any Conclusion of Law that is deemed to be a Finding of Fact is hereby adopted as such. - 2 -

This Court retains exclusive jurisdiction of this action for the purpose of insuring compliance with this Consent Judgment and associated Covenant Not To Sue. B. Judgment is entered for Servpro and against Thermapure on Thermapure s claims of infringement of the 812. C. No appeal shall be taken by any party from this Consent Judgment, the right to appeal being expressly waived by all Parties. D. This Consent Judgment shall finally conclude and dispose of all claims against Servpro by Thermapure with prejudice. Servpro s counterclaims against Thermapure are dismissed without prejudice. E. Each party shall bear its own costs and attorney s fees. F. This final Consent Judgment shall be entered hereto, forthwith, without further notice.
