OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS May 17th, 2017 Minutes MEMBERS PRESENT: Commissioners Scott, Pelton, Kleemann and Dukart. OTHERS PRESENT: Auditor Dolezal, States Attorney Merriman, Road Superintendent Zimmerman, Del Olson and Jeremy Wood. The meeting was called to order at 9:00 a.m. by Vice-Chairman Scott. Jeremy Wood, Northern Plains Engineering appeared to report on the projects his firm is working on. The federal aid bid opening for the South Heart road and Gas Plant/Tank Battery Chip Seal projects was held on May 12 th with the NDDOT. Asphalt Technologies was the low bidder at $375,792.65. Engineer Wood recommended signing the construction contract with Asphalt Technologies. The federal aid bid opening for the Little Missouri Bay road was also held on May 3 rd with the NDDOT. Park Construction, Minneapolis, MN was the low bidder at $355,685.65. Engineer Wood recommended signing the construction contract with Park Construction. Auditor Dolezal noted that the contracts have not been received from the DOT yet. 19 th St and 101 st Ave: Martin Construction has indicated a tentative starting date in mid-june. Kovash Road: Bid opening is set up for June 7 th. Wierson Road: Bid opening is tentatively planned for June 21 st. Motion by Commissioner Pelton, seconded by Commissioner Dukart, to remove from the table discussion on easement negotiations on the Wierson Road. All voted aye, and the motion carried. Engineer Wood discussed options for design without requiring permanent right of way on the Zabolotny parcel. Mr. Zabolotny is requesting $5000 for a temporary payment. Following discussion, motion by Commissioner Dukart, seconded by Commissioner Pelton, to offer a$5000 lump sum payment per landowner for temporary easements on the Wierson Road. Upon roll call vote, Commissioners Dukart Pelton, and Scott voted aye, and Commissioner Kleemann voted nay. The motion carried. Engineer Wood will finalize the negotiator s worksheets and proceed to bid the project. Del Olson appeared to report on the road department. Crews are working on graveling and applying mag chloride. Six road department employees attended a LTAP culvert class in Stark County.

Motion by Commissioner Kleemann, seconded by Commissioner Dukart to approve the utility permit. All voted aye, and the motion carried. The Road Department is planning to participate in the Killdeer School Career Day. Jarod Danzeisen, appeared to discuss reclamation on the Schmalz gravel pit. The County s gravel lease agreement with the Schmalz Trust addresses the reclamation plan. The gravel lease agreement was prior to Mr. Danzeisen s purchase of the property. States Attorney Merriman will review the correspondence sent to Mr. Danzeisen and get back to him. Mike Nash, Whiting Petroleum, appeared to request a section line encroachment for the Two Shields Butte 14-21 pad expansion located in section 21-149-92 on the Ft. Berthold Reservation. The wells were approved several years ago, prior to the NDIC requirement of county approval Motion by Commissioner Kleemann, seconded by Commissioner Dukart, to approve the encroachment with the condition to maintain existing access. All voted aye, and the motion carried. Sandy Rohde and Matt Hegstad appeared to discuss the 911 Coordinator position moving from the Sheriff s office into Planning and Zoning. The consensus of the Commission is to have Commissioner Dukart and a Planning Commission member meet with Sheriff Coker and Administrator Rohde to discuss the transition before moving forward. Code Administrator Rohde presented the CUP applications from the May 9 th Planning & Zoning hearing. Motion by Commissioner Kleemann seconded by Commissioner Pelton, to approve the following applications: 1. Mike Dewald of Bismarck ND, representing Petro-Hunt, LLC filed a Conditional Use Permit for a Temporary Water Pumping station. The property is located in the NE4SW4 of section 20-145-97, zoned Rural Preservation and owned by Greg Schneider. 2. Phillip Olson or Arick Grim of Killdeer ND, representing Missouri Basin Energy Services filed a Conditional Use Permit for a Temporary Water Pumping Station located in the W2NW4 of section 14-143-95. The property is zoned Rural Preservation and owned by Harlan Rebsom. 3. Phillip Olson or Arick Grim of Killdeer ND, representing Missouri Basin Energy Services filed a Conditional Use Permit for a Temporary Water Pumping Station located in the SW4SW4 of section 35-144-96. The property is zoned Rural Preservation and owned by Seth & Chantel Murphy. 4. Phillip Olson or Arick Grim of Killdeer ND, representing Missouri Basin Energy Services filed a Conditional Use Permit for a Temporary Water Pumping Station located in the NE4NE4 of section 6-146-96. The property is zoned Rural Preservation and owned by Allen Bang. 5. Phillip Olson or Arick Grim of Killdeer ND, representing Missouri Basin Energy Services filed a Conditional Use Permit for a Temporary Water Pumping Station located in the NE4NW4 of section 31-147-96. The property is zoned Rural Preservation and owned by Allen Bang 6. John or Rita Truchan of Killdeer ND, representing John Truchan Construction filed a Conditional Use Permit for Temporary Water Pumping Station piped to well sites with of up to 10 Frac Tanks. The property is located in the NE4NE4 of section 32-145-95, zoned Rural Development and owned by John & Rita Truchan.

All voted aye, and the motion carried. Discussed requesting a hearing in Dunn County with the Department of Health regarding a Radiation Control Program Radioactive Materials License to operate a mobile processing machine in accordance with the ND Radiological Health Rules. Motion by Commissioner Dukart, seconded by Commissioner Kleemann, to forward a letter to the DOH requesting a hearing to be held in Dunn County. All members voted aye, and the motion carried. Auditor Dolezal will draft the letter and forward to the DOH. Discussed nominations for the 2017 ND Association of Counties Employee of the Year award. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to nominate Code Administrator, Sandy Rohde as the nominee from Dunn County. All members voted aye, and the motion carried. Motion by Commissioner Pelton, seconded by Commissioner Kleemann, to approve the chip seal agreements for the South Heart Road and the Gas Plant/Tank Battery Road. All voted aye, and the motion carried. The Courthouse expansion and remodel building committee will be meeting on May 22 nd. The Airport Authority is planning a Fly-In for June 12 th. Trees were planted at the airport by the Boy Scouts and Girl Scouts. Nicole Smith, Extension Service FNP appeared to update the Commission on the Extension Office. Chemical Sales will be held on May 18 th, June 15 th and August 24 th and pre-orders can be made by contacting the Extension Office or Diane Allmendinger. No word yet from NDSU on the Ag Agent position. Commissioner Kleemann left meeting at 11:33 a.m. Weed Control Officer, Diane Allmendinger appeared to discuss Southwest Water s pipeline weed reclamation program. They are asking that landowners call in with concerns individually and they will address the concerns.
