Motions and Notices of Motion Moved by: Councillor Gary Accursi Seconded by: Councillor Marv Junkin Whereas the Town of Pelham has decided to construct a sidewalk for pedestrians and bicycles along the south side of Hwy 20 from EL Crossley school to Timmsdale Crescent; And whereas the Town of Pelham is encouraging street faced commercial development in the new East Fonthill Development; And whereas the Town of Pelham is an active community, promoting active transportation and an active life style; And whereas the Town of Pelham anticipates that the sidewalks along Highway 20 will be heavily utilized by pedestrians in the area between EL Crossley and Rice Road; And whereas the traffic volume and the rate of speed of vehicles travelling this portion of Hwy 20 are both high and both of these factors present significant risk to the individuals using this walkway; And Whereas Council is concerned for the safety of those individuals Page 4 of 5
utilizing this sidewalk; And whereas the Region of Niagara is the Municipal Authority having jurisdiction over this highway; And whereas the Highway Traffic Act grants authority to such a municipality to make decisions as to safety and to the determination of speeds and/or the creation or designation of some or all of a highway as a School Zone, or a Community Safety Zone to ensure the safety of all users of the highway; It is hereby resolved that; The Council of the Town of Pelham requests that the Region of Niagara take such measures as are necessary to ensure the safety of the pedestrians utilizing the sidewalks adjacent to Highway 20 from West of EL Crossley School to Rice Road. Such measures may include a significant speed reduction to 40 km per hour, the declaration that this stretch of highway as either a school zone or a community safety zone or such other measures that the Region deems appropriate to accomplish the stated objective of pedestrian safety. 17.
