SAIPAN AND NORTHERN ISLANDS LEGISLATIVE DELEGATION Third Senatorial District Nineteenth Northern Marianas Commonwealth Legislature SIXTH SPECIAL SESSION, 2015 HOUSE LOCAL BILL NO. 19-30, SI D8 A LOCAL APPROPRIATION BILL FOR AN ACT FOR THE THIRD SENATORIAL DISTRICT To appropriate the sum of One Million Dollars from the Exclusive Gaming Annual License Fees allotted to the Third Senatorial District under Public Law No. 18-56, for the Feasibility study of the Northern Marianas Cultural Center, for the promotion and preservation of the Carolinian culture and heritage, and for various improvement projects in Precincts I, II, III, IV and V. BE IT ENACTED BY THE THIRD SENATORIAL DISTRICT DELEGATION PURSUANT TO CHAPTER 4, DIVISION 1, TITLE 1 OF THE COMMONWEALTH CODE: 1 SECTION 1. FINDING AND PURPOSE. 2 The Exclusive Gaming Annual License Fees, pursuant to Public Law 18-56, Section 7, 3 2307 (d) (2), allocates one million dollars to the Third Senatorial District for appropriation by 4 the Saipan and Northern Island Legislative Delegation (SNILD). Therefore, it is the intent of 5 SNILD to use and provide such needed funds for the feasibility study of the Marianas Cultural 6 Center on Saipan, for the promotion and preservation of the Carolinian culture and heritage, 7 and various improvement projects in Precincts I, II, III, IV and V. 8 SECTION 2. APPROPRIATION.
1 There is hereby appropriated the sum of one million dollars to be used for the following 2 purposes: 3 "(a) $75,000.00 for the feasibility study of the Northern Marianas Cultural Center. 4 (1) The Secretary of Finance shall reserve this fund and shall disburse it only 5 upon the request of the entity that is established by law to create, manage, and operate 6 the Northern Marianas Cultural Center in the interest of promoting the indigenous 7 culture, tradition, tourism and the economy. 8 (b) $50,000.00 for the "Refaluwasch in the Marianas" celebration. 9 (1) The expenditure authority for this fund shall be the Secretary of the 10 Department of Finance. 11 (c) $73,000.00 for the repair of facilities at the Northern Marianas Trades Institute 12 damaged as a result of Typhoon Soudelor. 13 (1) The expenditure authority for this fund shall be the Secretary of Finance. 14 (d) $50,000 for the Saipan and Northern Islands Legislative Delegation Operations. 15 (1) The expenditure authority for this fund shall be the Chairman ofsnild. 16 (e) $19,570 for the Office of the Governor for reimbursement for the CNMI All Star 17 Senior Division's participation in the 2016 Asia Pacific Regional Tournament. 18 (f) $22,600 for the Mayor of Saipan for the payment of the outstanding amount owed 19 to IT&E. 20 (1) The expenditure authority for this fund shall be the Mayor of Saipan. 21 (g) $26,625.00 for the CNMI Boys' U17 National Teams to compete in the upcoming 22 Micronesian Basketball Confederation (MBC) 17U Western Division Basketball Tournament. 23 (1) The expenditure authority for this fund shall be the Secretary of the 2
1 Department of Finance. 2 (h) $106,241.00 for the repair and drainage and resurfacing of Tuturam Road in 3 Precinct 1. 4 (1) The expenditure authority for this fund shall be the Secretary of the 5 Department of Public Works. 6 (i) $106,241.00 for a drainage system; for pathways and sidewalks; for the renovation 7 of social halls and basketball courts; for the rehabilitation of Pacho' s Park and Sugar Dock, and 8 for the construction and instillation of stop signs within the villages all located in Precinct II. 9 (1) The expenditure authority for this fund shall be the Secretary of the 10 Department of Public Works. 11 G) $106,241.00 for the As Falape Road water booster pumps in Precinct III. 12 (1) The expenditure authority for this fund shall be the Executive Director of 13 the Commonwealth Utilities Corporation, or hislher designee. 14 (k) $40,000.00 to procure and install water pumps, water lines, and any additional 15 materials needed in Precinct IV. 16 (1) The expenditure authority for this fund shall be the Executive Director of 17 the Commonwealth Utilities Corporation, or hislher designee. 18 (1) $56,266.00 for the repair of roads in Precinct IV. 19 (1) The expenditure authority for this fund shall be the Secretary of the 20 Department of Public Works. 21 (m) $9,975.00 for the renovation of the Gregorio T. Camacho Elementary School 22 entrance walkway. 23 (1) The expenditure authority for this fund shall be the Secretary of the 3
1 Department of Public Works. 2 (n) $45,000.00 for the repair and upgrade of the Kagman Elementary School Baseball 3 field in Precinct V. 4 (1) The expenditure authority for this fund shall be the Secretary of the 5 Department of Public Works. 6 (0) $71,241.00 for the Mayor of Saipan for the procurement of a heavy truck; the 7 expenditure authority shall be the Mayor of Saipan. 8 (P) $15,000.00 to the Inetnon Arnot Yan Kutturan NatibulMwiischil Safey Me Kkoor 9 Aramasal Faluw to continue editing the updated/revised Chamorro-English Dictionary. 10 (1) The expenditure authority for this fund shall be the Secretary of the 11 Department of Finance. 12 (q) $5,000.00 for the Inaugural year of the Marianas Trench Fishing and Seafood 13 Festival. 14 (1) The expenditure authority for this fund shall be the Secretary of the 15 Department of Finance. 16 (r) $47,000.00 for the Saipan Municipal Council for building repairs; the expenditure 17 authority shall be the Secretary of the Department of Public Works. 18 (s) $20,000.00 for the Mayor of the Northern Islands to fund the "Too Beautiful to 19 Bomb" film project; the expenditure authority shall be the Mayor of the Northern Islands. 20 (t) $55,000.00 to the Division of Parks and Recreation for: 21 (a) $40,000.00 for procurement of a 4x4 pick up truck 22 (b) $10,000.00 for procurement of riding mower parts and accessories for 23 maintenance of parks and ground maintenance on Saipan. 4
1 (c) $5,000.00 for trash receptacles for Saipan beaches. 2 (1) The expenditure authority shall be the Secretary of the Department of 3 Finance." 4 SECTION 3. REPORTING. 5 Each respective expenditure authority under Section 2 of this Act shall submit to the 6 Chairperson of the Saipan and Northern Islands Legislative Delegation a detail report showing 7 the expenditure of the funds 30 days after the end ofthe fiscal year. 8 SECTION 4. SEVERABILITY. 9 If any provision of this Act or the application of any such provision to any person or 10 circumstance should be held invalid by a court of competent jurisdiction, the remainder of this 11 Act or the application of its provisions to persons or circumstances other than those to which it 12 is held invalid shall not be affected thereby. 13 SECTION 5. SAVINGS CLAUSE. 14 This Act and any repealer contained herein shall not be construed as affecting any 15 existing right acquired under contract or acquired under statutes repealed or under any rule, 16 regulation or order adopted under the statutes. Repealers contained in this Act shall not affect 17 any proceeding instituted under or pursuant to prior law. The enactment of the Act shall not 18 have the effect of terminating, or in any way modifying, any liability, civil or criminal, which 19 shall already be in existence on the date this Act becomes effective. 20 SECTION 6. EFFECTIVE DATE. 21 This Act shall take effect upon its approval by the Governor or its becoming law 22 without such approval. 5
