I am an attorney-at-law in the State of New Jersey and a partner in the law firm of Tompkins, McGuire, Wachenfeld & Barry, LLP, counsel for plaintiff JPMorgan Chase Bank, National Association ( Plaintiff ) in the above-captioned matter. I submit this certification in response to the Court s administrative order requiring a certification setting forth the status of this matter. 2. Default was entered against defendant Wells Fargo Bank, N.A. fka Wachovia Bank, N.A. ( Wells Fargo ) in March 2014. In July 2014, the court entered an order establishing that Plaintiff held priority over Wells Fargo. 3. Final judgment was entered in Plaintiff s favor on July 7, 2015. 4. In February 2016, Wells Fargo moved to vacate default and the prior order

The motion was granted over Plaintiff s objection on March 22, 2016, and the case was consolidated with Wells Fargo s foreclosure proceeding under docket no. F-20415-14. 5. Ultimately Plaintiff and Wells Fargo engaged in discovery which culminated in both parties filing competing motions for summary judgment in May 2017. The court held argument in June 2017 and issued an order in August 2017 holding that Wells Fargo held priority over Plaintiff s mortgage. 6. Counsel did not receive electronic notice of the summary judgment order. It was not until Wells Fargo moved to enter judgment in F-20415-14 that counsel became aware that summary judgment had been denied. 7. At this time, Plaintiff is considering whether to: 1) seek reconsideration; 2) appeal from the summary judgment order on an interlocutory basis; 3) dismiss Wells Fargo and move to enter final judgment; or to take such other action as may be appropriate. 8. Due to the unique circumstances present in this case, Plaintiff requests that the case remain open. 9. The foregoing statements made by me are true.
