INTRODUCTION A. Statistics Attached is the Department of Police Accountability s 1 (DPA) statistical report for the second quarter of 2017. The DPA received an adjusted total of 120 complaints of police misconduct or failure to take action and closed 180 complaints. The DPA sustained allegations in 14 complaints against San Francisco police officers, which is an 8% sustained rate. The DPA mediated 10 cases during the second quarter. II. ORGANIZATIONAL AND BUDGET MATTERS A. Budget On July 26, 2016, the Board of Supervisors adopted the budget for Fiscal Year (FY) 2016-17, which Mayor Edwin Lee signed on August 1, 2016. The DPA s approved budget for FY 2016-17 is $7,770,373. Consistent with the Board of Supervisors Budget and Finance Committee s recommendation, the budget was enhanced by $1,744,993. The enhancement included a $276,158 increase in the professional services and equipment account, which allowed for the purchase of transcription services and a vehicle for fieldwork and on call Officer- Involved shooting response. The remaining increase allowed the DPA to hire four (4) additional 8124 Investigators and one (1) 8126 Senior Investigator. 1 The Office of Citizen Complaints was renamed the Department of Police Accountability pursuant to a 2016 amendment to the City and County of San Francisco Charter.

B. Staffing The DPA s approved budget for fiscal year 2016-17 is $7,770,373 with 44.01 budgeted positions. Of the budgeted positions, nine (9) 8124 Investigator positions were vacant and two (2) Clerk Typist positions were vacant. C. Technology During the second quarter, Information Systems (IS) Analyst Chris Wisniewski and IS Analyst Assistant Eric Ho assembled data for the quarterly and annual reports. They continued to distribute ios recording devices to the investigative staff and upgraded the shared query terminal computers. They also developed plans and templates for distributing new desktop computers to the staff. D. Training During the second quarter, Kathryn Olson of Change Integration Consulting, LLC, provided DPA investigators and senior investigators training on credibility assessment. SFPD Lieutenant Wilfred Williams and Officer Alberto Duarte provided DPA staff training on SFPD General Order 10.11, Body Worn Cameras. Five (5) DPA investigators attended the Internal Affairs Investigation training offered by the Alameda County Sheriff s Office. In addition, five (5) DPA investigators and one (1) DPA Attorney attended a Use of Force Training hosted by Americans for Effective Law (AELE). Lastly, eight (8) DPA investigators attended the Advanced Officer/Continuing Professional Training at the San Francisco Police Academy. III. INVESTIGATION OF CASES A. Case Inventory The DPA opened 126 new cases, with an adjusted total of 120 new cases. 2 The DPA closed 180 cases, leaving 363 cases pending at quarter end, 34 less than were pending at the close of the second quarter of 2016. Of the 363 pending cases, 197 were opened in 2017, 143 were opened in 2016, 19 were opened in 2015, two (2) were opened in 2014, one (1) was opened in 2013, and one (1) was opened in 2011. B. Caseloads and Disposition of Cases The average caseload per investigator was 24 cases compared with 28 cases during the second quarter of 2016. 3 Of 180 total closed cases, DPA investigators closed 101 cases (56% of cases) within 270 days. The DPA s goal is to conclude investigations within 270 days. The DPA took more than a year to close 40 cases (22% of cases). 2 The adjusted total reflects cases that were withdrawn, merged, or voided based on clerical or other errors. 3 In its January 27, 2007, audit report on the DPA, the Controller s CSA division found that 16 cases per investigator was a best practice caseload for civilian oversight investigators. 2

One or more allegations of misconduct were sustained in 14 of the 180 closed cases, resulting in a 8% sustained rate. Of the 477 allegations investigated, 132 allegations resulted in Proper Conduct findings; 26 allegations resulted in Sustained findings; 51 allegations resulted in Unfounded findings; 48 allegations resulted in No Finding/Withdrawn dispositions; and 220 allegations resulted in Not Sustained findings. C. Chief of Police s Adjudication of DPA Sustained Cases When a sustained case warrants a suspension of ten days or more, the DPA can recommend that the Chief of Police file charges with the Police Commission. If the Chief of Police declines to file charges with the Police Commission after meeting and conferring with the DPA, the DPA can file charges on its own with the Police Commission. Alternately, the DPA can determine that a case warrants a suspension of ten days or fewer. When the DPA determines that sustained misconduct warrants no more than ten days of suspension, the Chief of Police determines whether or not to sustain the DPA s findings and what level of discipline to impose. Although the DPA recommends specific levels of discipline for each case, the Chief of Police determines if, in his opinion, the sustained allegations are merited and what level of discipline or corrective action to impose. The Chief of Police also adjudicates challenges. While police officers may appeal the Chief s discipline to the Police Commission, neither Charter section 4.136 nor the Administrative Code provide for the DPA Director to appeal the Chief s decision. During the second quarter, the Chief of Police imposed discipline in seven (7) DPA sustained cases as follows: In April 2017, Chief William Scott proposed discipline in two (2) cases determined by the DPA to have sustainable allegations. The DPA s findings and recommended discipline and the Chief s proposed discipline are as follows: 1. Conduct Reflecting Discredit An officer made inappropriate comments and engaged in inappropriate behavior in violation of SFPD General Order 2.01, General Rules of Conduct; and Neglect of Duty An officer failed to comply with Department Bulletin No. 14-059, Traffic Stop Data Collection Program Information. The DPA recommended a written reprimand. The Chief of Police found insufficient evidence to sustain the Conduct Reflecting Discredit allegation. The Chief of Police imposed a written reprimand and retraining for the Neglect of Duty allegation. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a written reprimand for a first offense. 3

2. Neglect of Duty An officer failed to comply with Department Bulletin No. 14-059, Traffic Stop Data Collection Program Information. Based on the officer s disciplinary history, the DPA recommended a threeday suspension. The Chief of Police imposed a written reprimand and retraining. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a three-day suspension for a second offense. In May 2017, Chief William Scott proposed discipline in one (1) case determined by the DPA to have a sustainable allegation. The DPA s finding and recommended discipline and the Chief s proposed discipline are as follows: 1. Neglect of Duty An officer wrote an inaccurate or incomplete citation in violation of SFPD Department General Order 2.01, General Rules of Conduct, and Department Bulletin No. 14-034, Correctable Violations and Proper Completion of Traffic Citations. The DPA recommended an admonishment. In concurrence with the DPA, the Chief of Police imposed an admonishment and retraining. In June 2017, Chief William Scott proposed discipline in four (4) cases determined by the DPA to have sustainable allegations. The DPA s findings and recommended discipline and the Chief s proposed discipline are as follows: 1. Neglect of Duty An officer failed to issue the complainant a Certificate of Release in violation of SFPD General Order 5.03, Investigative Detentions. The DPA recommended an admonishment. The Chief of Police imposed a written reprimand and retraining. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a written reprimand for a first offense. 2. Unwarranted Action An officer detained the complainant without justification in violation of SFPD General Order 5.03, Investigative Detentions. Neglect of Duty An officer failed to issue a Certificate of Release and failed to write an incident report in violation of DGO 5.03. 4

The DPA recommended a one-day suspension. The Chief of Police found insufficient evidence to sustain the Unwarranted Action allegation. The Chief of Police imposed a written reprimand and retraining for the Neglect of Duty allegations. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a written reprimand. 3. Conduct Reflecting Discredit An officer behaved inappropriately and made inappropriate comments in violation of SFPD General Order 2.01. Neglect of Duty An officer failed to write an incident report in violation of DGO 2.01. Based on the officer s lack of disciplinary history, the DPA recommended an admonishment. The Chief of Police found insufficient evidence to sustain the Conduct Reflecting Discredit allegation. The Chief of Police imposed a written reprimand and retraining for the Neglect of Duty allegation. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a written reprimand. 4. Unwarranted Action An officer cited the complainant without cause. The DPA recommended a written reprimand. The Chief of Police imposed an admonishment and retraining. According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D unwarranted action is a written reprimand. Neglect of Duty Another officer failed to properly supervise in violation of SFPD General Order 2.01 and the Peace Officer Field Training Manual. The DPA recommended a written reprimand and retraining. The Chief of Police imposed an admonishment and retraining. 5

According to the Police Commission Disciplinary Penalty and Referral Guidelines, the penalty for Class D neglect of duty is a written reprimand. IV. SECOND QUARTER COMPLAINTS OF NOTE A. San Francisco Police Handling of Alzheimer s Patient At the end of the second quarter, the DPA continued to investigate a complaint regarding a 72-year-old disabled woman who was placed on a 5150 involuntary psychiatric evaluation after San Francisco police officers responded to a physical altercation between two residents of an elder-care home. B. Officer-Involved Shootings Seven (7) officer-involved shooting investigations remained open at the end of the second quarter 2017. C. Single Room Occupancy Hotels The DPA continued to investigate one of two complaints filed in 2011 involving multiple officers regarding unlawful entries and searches of single room occupancy (SRO) hotel rooms. Other allegations in these complaints include unlawful searches of persons, unlawful detentions and arrests, failure to properly process property including laptops and cameras, failure to investigate, failure to supervise and inappropriate behavior. D. San Francisco Woman Shot and Killed by Her Ex-boyfriend The DPA continued to investigate a complaint regarding a San Francisco woman who was shot and killed by her ex-boyfriend before he fatally turned the gun on himself. The woman was shot in her home, from which there had been a series of calls for help. E. Racist and Homophobic Text Messages By Members of the San Francisco Police Department The DPA continued to investigate a complaint regarding racist and homophobic text messages by members of the San Francisco Police Department. V. STATUS OF CURRENT DPA CASES THE KEANE REPORT At the beginning of the second quarter, the investigative staff had completed intake on all but two (2) of its 2016 cases and had closed 81% of them, leaving 116 or 19% of the 2016 cases pending. 6

VI. LEGAL UNIT Five attorneys staff the DPA s Legal Unit under the supervision of the Executive Director. Attorneys John Alden, Ines Vargas Fraenkel and R. Manuel Fortes are trial attorneys. They also conduct sustainability reviews, review reports of sustained misconduct for legality, prepare legal opinions, and manage records requests, including subpoenas, Pitchess motions, Sunshine Ordinance requests, and Public Records Act requests. Additionally, Attorney John Alden trains investigators and provides policy analysis. Attorney Samara Marion conducts the bulk of DPA s policy work, conducts sustainability reviews, reviews sustained reports legality, prepares legal opinions, and conducts investigator trainings. The DPA s policy work is outlined in section VII. Attorney Donna Salazar coordinates DPA s mediation and outreach programs and her work is outlined in sections VIII and IX of this report. The Legal Unit reviewed, revised, and submitted nine (9) sustained reports for approval by the DPA Executive Director, each of which involved one or more sustained allegations against one or more officers. Additionally, Deputy Director Erick Baltazar reviewed, revised and submitted five (5) sustained reports for approval by the DPA Executive Director. The trial attorneys defend DPA s misconduct findings in matters investigated and determined by the DPA to prove misconduct or failure to perform a required action. They present cases to the Chief of Police when officers object to proposed discipline of up to ten days suspension. They present cases before the Police Commission when the proposed discipline is greater than 10 days suspension up through termination. DPA attorneys defended seven (7) cases at Chief s Hearings during this quarter. VII. POLICY ANALYSIS Policy work is an essential aspect of the Department of Police Accountability s mission. The San Francisco City Charter requires the DPA to present quarterly recommendations concerning SFPD s policies or practices that enhance police-community relations while ensuring effective police services. Attorneys Samara Marion and John Alden lead the DPA s policy work. During the second quarter 2017, the DPA s policy work focused primarily on the Department of Justice s Collaborative Reform Initiative involving 272 recommendations and 94 findings to improve trust between the SFPD and the community it serves. 4 The DPA participated in SFPD s Executive Sponsor Working Groups that addressed policies and practices concerning the use of force, biased policing, complaint and disciplinary processes, and community policing. In response to the DOJ s recommendations to improve the timeliness of Department General Order revisions and to discontinue using Department Bulletins as a workaround for the 4 See COPS Office. 2016. Department General Order approval process, 5 the DPA worked with SFPD on revising Department General Order 3.01 (Written Communication System). DPA s recommendations limit the use of Department Bulletins and require the Police Department to bring before the Police Commission revisions to the relevant Department General Order within six months of the Police Commission s approval of a Department Bulletin. On June 2, 2017, the DPA made the following written recommendations to enhance the DPA-SFPD approach to the DOJ Collaborative Approach Initiative: A. Update Department General Order 2.04 and SFPD-DPA Document Protocol The DPA recommended that SFPD assign higher level command staff with decisionmaking authority to work with the DPA to immediately revise Department General Order 2.04 (Citizen Complaints Against Officers) and SFPD-DPA s document protocol. These documents are fundamental to the complaint, investigation and disciplinary processes, establish key aspects of the roles and responsibilities of both agencies, and have not been updated for decades. Department General Order 2.04 sets forth the duties of officers for receiving, investigating and processing citizen complaints against officers and describes the Department of Police Accountability s investigative procedures and findings. DGO 2.04 has not been updated since 1994 and does not accurately reflect DPA s investigative authority and SFPD s responsibilities that were added by Proposition G on November 6, 2016. The SFPD-DPA Document Protocol as required by San Francisco Administrative Code section 96.3 similarly needs to be updated to reflect the DPA s city charter mandate to conduct performance audits of SFPD every two years. Additionally, to conduct complaint investigation, recommend discipline and perform audits, DPA needs direct and immediate electronic access to SFPD documents and databases. Revising DGO 2.04 and the Document Protocol will enhance the complaint and disciplinary process, improve the working relationship between IAD and DPA, and address DOJ Finding 64, and DOJ Recommendations 64.1, 64.3-64.5 and 56.6 6. The team found that Department Bulletins updating provisions within Department General Orders were repeatedly renewed to meet the two year sunset, often without receiving any substantive updates and in place of addressing the issue within the appropriate Department General Order. DOJ Recommendation 75.2 states, The Written Directives Unit should be tasked to work with subject matter experts from OCC and the Police Commission to ensure policies are adopted in a timely manner and appropriately updated. 6 DOJ Finding 64 states, The SFPD does not routinely collaborate with the Office of Citizen Complaints. The transparency of the complaint and disciplinary process is negatively affected by the working relationship between SFPD IAD and OCC. The lack of engagement undermines the effectiveness of both in fulfilling their respective 8

command staff with decision-making authority to work with the DPA, a more efficient and successful revision process will be accomplished. B. Implement Quarterly Meetings Between SFPD and DPA to Review Sustained Cases for Policy and Training Issues and Complaint Trends. In October 2016, the Department of Justice recommended immediate implementation of DPA s 2015 recommendation for quarterly meetings with the Police Chief and key command staff to discuss discipline, policy and training issues. The DPA recommended that SFPD assign higher level command staff with decision-making authority to work with the DPA to convene a quarterly discipline, policy and training panel that includes the Chief, Assistant Chief of Staff, Officer-in-Charge of Risk Management, the Police Academy Captain and DPA Director and DPA Policy Attorney. The DPA suggested that the quarterly meeting goals include: 1) evaluating whether any training, policy or procedure of the Department needs to be revised, added or reissued; and, 2) if so, to make written recommendations that include the manner in which the recommendations can be implemented, and a timeline for completion. In light of DOJ s recommendations to regularly review and analyze trends in complaints and employee misconduct in order to identify priorities for intervention in workforce culture, training, policy clarification and leadership development, the DPA suggested that the quarterly meetings also include a trends analysis of complaints consistent with DOJ Findings 65 and 67 and DOJ Recommendations 65.1, 65.2, and 67.1. 7 roles and responsibilities. Issues with respect to information sharing between the two entities, timeliness of complaint investigations, and basis for recommending progressive discipline potentially impede the investigative and adjudication processes, potentially eroding the overall integrity of the public complaint resource. DOJ Recommendation 64.1 states, The SFPD should convene a joint review process within 90 days of the issuance of this report, co-chaired by OCC and SFPD senior staff, to evaluate existing complaint and disciplinary processes, policies, and liaison relationships to enhance trust and legitimacy around these issues. DOJ Recommendation 64.3 states, The SFPD should work with OCC to develop standards regarding timeliness of complaint investigations, and consistency of investigative findings and practices to ensure progressive discipline is appropriately recommended. DOJ Recommendation 64.4 states, The SFPD should seek to improve interagency communications and identify ways of improving collaboration on investigative practices to ensure timely conclusion of investigations, shared information on prior complaints and finding of misconduct, and appropriate entry of discipline designed to improve the overall discipline system that holds officers to account. DOJ Recommendation 64.5 states, The SFPD should engage with OCC to ensure that the classification for complaints and their findings are reported consistently between the two agencies to ensure better transparency. DOJ Recommendation 56.6 states, The SFPD should encourage the OCC and IAD to identify obstacles that interfere with optimal complaints investigations and accountability, with a goal of implementing changes to better support their intended missions. 7 DOJ Finding 65 states, The SFPD does not sufficiently analyze Office of Citizen Complaints reports and analysis of its complaints, investigations, and case dispositions. This information is shared with the SFPD and largely available publicly on the OCC website. However, the SFPD rarely uses complaint information or aggregated data to inform change management priorities in areas such as professional conduct, community and police relations, training and policy. DOJ Recommendation 65.1 states, The SFPD should develop a department-internal priority to regularly review and analyze OCC complaint reporting to identify priorities for intervention in terms of workforce culture, training, policy clarification, or leadership development. 9

C. Reinstitute Meetings Between DPA and the Department s Chief of Staff toaddress the Sparks Report and DPA s Policy Recommendations. Policy work is an essential aspect of the Department of Police Accountability s mission. The San Francisco City Charter requires the DPA to present quarterly recommendations concerning SFPD s policies or practices that enhance police-community relations while ensuring effective police services. (See City Charter section 4.136 (h)). The DPA provides to the Police Commission and the Police Department policy and training recommendation in its quarterly reports. The DPA also makes policy and training recommendations when appropriate at the conclusion of its complaint investigation. Additionally, the DPA makes recommendations through its participation in the Firearm Discharge Review Board, the Language Access Working Group and the Crisis Intervention Team Working Group. Police Commission Resolution No.27-06 requires the Police Department and the DPA to provide a quarterly report to the Police Commission concerning the status of revisions to Department General Orders, new General Orders and DPA policy recommendations. To advance the policy work of both agencies, on March 8, 2016, the Police Department and the DPA instituted biweekly meetings between the Police Department s Chief of Staff and the DPA policy attorney to address the DPA s policy and training recommendations, Department General Order revisions, the Sparks Report and other policy-related projects. This practice enabled both agencies to work closely to complete priority projects such as the drafting of the Crisis Intervention Team Department General Order, the Use of Force General Order, the Resolution for Semiannual and Annual Reporting to the Police Commission on the Department s Collection and Analysis of Sexual Assault Kit Evidence and Reporting of Results to Sexual Assault Victims. The DPA recommends that consistent with the previous practice instituted in March 2016, the DPA policy attorney and Police Department s Chief of Staff meet the 1st and 3rd week of each month to discuss DPA policy and training recommendations, DGO revisions and the Sparks Report. Additionally, the DPA recommends that the Department modify its submission on DOJ Recommendations 66.1, 66.2, and 66.3 8 to the Department of Justice to state that it has reopened these recommendations to conduct further work with DPA on these matters. DOJ Recommendation 65.2 states, The SFPD should raise district captains awareness of this information by requiring IAD to present a trends analysis report of OCC case activity, emerging issues, and concerns at CompStat meetings every quarter. DOJ Finding 67 states, The SFPD does not analyze trends in complaints, situations that give rise to complaints, or variations between units or peer groups in relation to complaints and misconduct. In part, this is because the SFPD does not have appropriate data systems to allow for data-led management and policing decisions. DOJ Recommendation 67.1 states, The SFPD must work to develop practices that measure, analyze, and assess trends in public complaints and employee misconduct. 8 DOJ Finding 66 states, The SFPD is not required to take action on the recommendations put forth in the Office of Citizen Complaints Sparks Report. OCC provides the Sparks Report quarterly to the Police Commission. The Sparks Report provides recommendations on policy and revisions. DOJ Recommendation 66.1 states, SFPD should meet with OCC on a quarterly basis following the release of the Sparks Report to discuss the recommendations. DOJ Recommendation 66.2 states, SFPD should require Principled Policing Bureau to review Sparks Report and direct action where appropriate. 10

As a participant in the Police Commission s Working Group on Tasers (Electronic Control Weapons), the DPA compiled two suggested lists of reading materials on ECWs. 9 In response to members requests for information about previous hearings before the San Francisco Police Commission on the topic of Electronic Controlled Weapons, the DPA submitted a summary covering February 17, 2010 until June 22, 2016 with links to the televised Police Commission hearings, caption notes and minutes. D. Language Access Recommendations. The Department of Police Accountability provided the following recommendations to Chief Scott in a letter dated May 8, 2017 following Chief Scott s attendance at the Language Access Working Group s meeting on April 18, 2017. The Language Access Working Group comprises domestic violence and sexual assault service providers, language access advocates, city agencies, Police Commissioner Sonia Melara and the Police Department, and meets monthly, a practice the DPA initiated in 2012 to enhance SFPD s language access services. 1. Interpreter Training For Certified Bilingual Officers. It is well established that being an interpreter requires skills and training beyond bilingualism. To ensure that certified bilingual officers receive interpreter training, Department General Order 5.20 (Language Access Services for Limited English Proficient (LEP) Persons) specifically requires the Department to provide interpreter training for certified bilingual officers on interpreting techniques, roles, terminology and ethics in accordance with confidentiality and impartiality rules. (See DGO 5.20 (II) (E).). The Department has not provided interpreter training for its certified bilingual officers, despite repeated recommendations from the Department of Police Accountability and the Language Access Working Group since DGO 5.20 s adoption in 2007. The DPA recommends that SFPD immediately develop interpreter training or alternatively, hire an outside agency to provide bilingual officer interpreter training. Interpreter training for bilingual officers should include assessment on interpretation skills to ensure information retention. 2. Re-Certification of Bilingual Officers. Language proficiency is a perishable skill. bilingual pay and is considered a qualified bilingual officer for the purposes of Department General Order 5.20. The Police Department does not have any recertification requirements. The absence of a recertification procedure is inconsistent with best practices. The lack of recertification potentially jeopardizes the quality of an officer s interpretation which, in turn, can undermine the investigation and prosecution of cases and negatively impact an officer s ability to communicate with a victim, suspect, witness or community member. The DPA recommends that SFPD: Implement a system of language proficiency recertification that requires retesting of all bilingual officers every 2-3 years; Include a requirement of recertification of language proficiency in the 2017-2018 labor contract with SFPD officers; and Either obtain DHR s assistance or hire an outside contractor to provide recertification every 2-3 years. 3. Advanced Officer and Field Officer Training and Post Certification of LEP Curriculum. Department General Order 5.20 states that the Department will provide periodic training on its LEP policies, including how to access in-person and telephone interpreters and how to work with interpreters. DGO 5.20 states that it shall conduct such trainings for new recruits, at in-service training and at roll-call at least every two years. (DGO 5.20 (III)(N). The two-hours of DGO 5.20 training for recruits is not POST certified. DGO 5.20 updates and language access issues are not included in advanced officer or field officer training. The DPA recommends that SFPD: Incorporate language access training into the Field Training program and advanced officer curriculum; Include language access issues and requirements in all training modules and written materials; and Obtain Police Officer Standard Training (POST) certification for current DGO 5.20 training. 4. Language Services at Stations. Spanish-speaking and Cantonese-speaking domestic-violence survivors have reported significant wait times for language assistance to file a report at certain stations and instances wherein LEP victims/reportees have either been sent to other stations or told to come back later. LEP victims/reportees have also reported encounters with Police Service Aides at the stations who do not use language assistance to explain wait times or when a bilingual officer will be available to take a report. LEP reportees and service providers have repeatedly shared their concerns with the Department that many stations are not welcoming or user friendly which is further exacerbated when language assistance is not readily provided. Additionally, there is no privacy in the district station lobby where reportees often need to provide sensitive information about themselves and the nature of an incident. (For further discussion of domestic violence, immigration and language access concerns involving SFPD, see the Blue Ribbon Panel on 12

Transparency, Accountability, and Fairness in Law Enforcement (July 2016), pages 20-21). The DPA recommends that SFPD: Provide easily accessible information in multiple languages at each station that explains procedures such as how an LEP individual can file a report, talk with a bilingual officer, and obtain other police services; Prominently post that language services are free and available and include this information in district station newsletters; Require stations to identify the top language needs of the community in which the station is located and provide an incentive system so that stations are able to staff the stations with bilingual officers and Police Services Aides who speak the languages most needed; In each station and to the public, prominently post when bilingual officers and Police Service Aides are available and the language they speak; Conduct an audit using LEP reportees to evaluate the effectiveness of language access at all of the stations and implement improved accessibility where needed. 5. Dispatching Bilingual Officers to the Scene. Department General Order 5.20 states that officers "shall provide oral interpretation services to LEP persons they encounter in the following order of preference unless deviations are required to respond to exigent circumstances." The priority is direct communication by a qualified bilingual officer, followed by a qualified civilian interpreter and last by a telephone interpreter. (DGO 5.20 (III)(D) Order of Preference.) Department General Order 5.20 requires SFPD s Language Access Liaison Officer to work in conjunction with Department of Emergency Management (DEM) to establish a system that immediately identifies LEP calls and promptly dispatches language assistance, preferably with a bilingual officer speaking the needed language. (DGO 5.20 (III)(O)(1)(5). In 2009, the Department of Police Accountability recommended a communication system that would enable 911 dispatchers to immediately identify the location and availability of bilingual officers to respond to LEP calls for service. For several years, the DPA in partnership with the Language Access Working Group worked with SFPD and the Department of Emergency Management to design and implement such a system. Although this system was to become operational in April 2013, it has never been fully implemented. When DEM dispatchers identify a LEP caller, instead of relying upon the system that identifies an available certified bilingual officer, many dispatchers continue to put out a request for a bilingual officer and wait for a volunteer to respond. This approach is inefficient and does not comply with the system of dispatching available bilingual officers immediately as required under DGO 5.20. The DPA recommends that SFPD: Work with DEM to fully implement the dispatch procedure in which dispatchers identify and dispatch immediately an available bilingual officer to respond to a LEP call for service. Explain the new dispatch procedure to SFPD officers through a Department Bulletin. Once implemented, monitor compliance under the new procedure through an audit. 13

6. LEP Data Collection and Analysis. Department General Order 5.20 states that officers "shall provide oral interpretation services to LEP persons they encounter in the following order of preference unless deviations are required to respond to exigent circumstances." The priority is direct communication by a qualified bilingual officer, followed by a qualified civilian interpreter and last by a telephone interpreter. (DGO 5.20 (II I)(D) Order of Preference.) DGO 5.20 requires the Department to collect and report on data including the number of calls for service, contacts and investigations involving LEP persons where an incident report was required and the manner in which interpretation services were provided. (DGO 5.20 (III)(O)(2-3)). The Department of Police Accountability in partnership with Language Access Working Group recommended and worked with SFPD to add LEP data collection to the incident report writing system. This data collection will enable the Department to assess language needs and analyze the extent to which language services are being provided by bilingual officers, civilians or telephone interpreters. Mandatory LEP data collection was announced on February 26, 2016 via a Department A Bulletin (16-029 LEP Data Collection Crime Data Warehouse) and became effective on March 16, 2016. The Department has accumulated over a year s worth of LEP data though not yet reported publicly upon this data. Upon the recommendation of the Department of Police Accountability and in partnership with the Language Access Working Group, in 2016 the Department required all officers to view the training video Detecting and Overcoming Language Barriers and to complete an on-line survey about language access services and training. SFPD has not yet analyzed and reported upon this data. The DPA recommends that SFPD: Analyze and report upon the LEP data collected through the Crime Data Warehouse from March 2016-2017. Analyze and report upon the data collected through the on-line survey about language access services and training. VIII. MEDIATION During the second quarter of 2017, the DPA mediated 10 cases compared to 13 cases in 2016. In 2017, the rate of officers declining mediation rose slightly to 6% of officers, or three officers of forty-eight offered mediation, compared with 5% in 2016. The Mediation Coordinator continues to document the numbers and circumstances of officers who decline to meet. The responses indicate that officers decline due to the circumstances of particular cases and/or complainant rather than a reluctance to participate in the program. The DPA s Mediation Coordinator Donna Salazar attended sessions of the American Bar Association Alternative Dispute Resolution Section on police-community relations. She also attended a program offered by Peninsula Conflict Resolution Services regarding ADR methods employed in improving relations in communities and attended the Community Boards Peacemaker Awards. The Mediation Program continues to provide a forum for officers and 14

civilians to have frank discussions regarding complaints, as well as providing an educational experience for all participants. IX. OUTREACH The DPA engaged in the following outreach activities: The DPA Director attended Police Commission Community Meetings and gave regular updates regarding the work of the DPA. Attorney Ines Fraenkel participated in a panel before a youth group addressing concerns regarding youth rights when interacting with police. Attorneys Marion and Salazar made a presentation to residents and staff members of the Hospitality House in the Tenderloin District. Ms. Salazar attended a meeting of the Justice Committee of Glide Memorial Church and provided the Committee with brochures. She also attended planning meetings with Mo Magic and other providers in preparation for the Back to school event in August. The DPA staffed an informational table at an Operation Homeless Connect event. X. CONCLUSION The DPA remained committed to its mission to investigate civilian complaints of police misconduct or failure to perform duties promptly, fairly, and impartially. The DPA continued to focus its community outreach efforts and policy work on addressing the concerns of the public for greater transparency. POLICY RECOMMENDATION 2 nd QUARTER 2017 Case Type of Allegation Policy Recommendation No. #1 Neglect of Duty The complainant stated that the officers did not provide a copy of the search warrant after searching the complainant s home. Names officers stated that because the court had ordered the search warrant sealed, they did not believe they should leave a copy of the warrant. The SFPD Search Warrant Manual specifies, Once entry is made into the location, the officer(s) should show the original search warrant to the occupant(s), then give the occupants(s) a copy. Department General Order 3.02 defines should as recommended in contrast to shall which is mandatory. means that it is required. Neither the Search Warrant Manual nor Department General Order 5.16 address officers responsibilities when the court has ordered a search warrant sealed. The Department of Police Accountability recommends updating both the Search Warrant Manual and Department General Order 5.16 to address procedures and responsibilities when serving a search warrant that the court has ordered sealed. 1

POLICY RECOMMENDATION 2 nd QUARTER 2017 Case Type of Allegation Policy Recommendation No. #2 Neglect of Duty The complainant stated the named officers refused to release the complainant s scooter to him after he was arrested. The named officer stated that there was ambiguity as to the ownership of the scooter. When the complainant could not provide documentation of ownership, the named officers referred the complainant to the SFPD Legal Division. Department records showed that the scooter remains with SFPD and that there is no hold on the property. DGO 6.15 on property processing does not address the type or form of proof of ownership for release property, who makes the determination, and the chain of command for appeal when release of the property has been denied. The Department of Police Accountability recommends that DGO 6.15 be updated to address the return of property, including criteria for establishing ownership, how to request the return of property, notification of the decision to return property, and review of any denial to release property. The Department of Police Accountability also recommends that the public be provided information about the Police Department s procedures for obtaining the release of property. 1

POLICY RECOMMENDATION 2 nd QUARTER 2017 Case Type of Allegation Policy Recommendation No. #3 Neglect of Duty The complainant filed a complaint with the Department of Police Accountability concerning an allegation of an officer s off duty conduct. The San Francisco City Charter 4.127, in effect at the time, stated: The Office of Citizen Complaints shall investigate all complaints of police misconduct, or that a member of the Police Department has not properly performed a duty, except those complaints which on their face clearly indicate that the acts complained of were proper and those complaints lodged by other members of the Police Department. The current City Charter 4.136, states: DPA shall promptly, fairly, and impartially investigate all complaints regarding police use of force, misconduct or allegations that a member of the Police Department has not properly performed a duty, except those complaints which on their face clearly indicate that the acts complained of were proper and those complaints lodged by other members of the Police Department. The City Charter grants the OCC (now the DPA) the power to investigate complaints against police misconduct and refers to member[s] of the Police Department. The charter does not distinguish between on duty and off duty conduct. The Department of Police Accountability recommends that DGO 2.04 be updated and amended to reflect DPA s jurisdiction as provided by City Charter 4.136. 1
