Flat Fees for US Applications Based On Use Filing of a National Application in the US based on Use* Filing of a National Application in the US Our fee for filing a one class application in the US is $485.00 plus the US Patent and Trademark Office (USPTO) fee. Our fee for an additional class in the same application is $240.00 plus the USPTO fee. The following are included in our fixed fee for filing a single class application based on use: Preparation of the trademark application. Filing the application electronically. (Additional fees apply for a paper filing) Creation and opening of a file. agreed upon. Transmittal of the Notice of Publication. Transmittal of Requests for Extension of Time to file a Notice of Opposition. This is limited to a maximum of four requests up to 120 days. We will respond to Office Actions at our hourly rate of $360.00 per hour. The following are NOT included in our fixed fee to file the application: US Patent & Trademark Office Fees Notice of Appeal from a Final Decision Review of USPTO Office Action and providing recommendations Notice of Opposition Notice of Cancellation Transmittal of Certificate of Registration Obtaining the Trademark Registration Certificate Obtaining the Trademark Registration Certificate and docketing for Section 8 and Renewal requirements and sending said Registration Certificate by courier is $130.00 and is invoiced when the Registration Certificate is sent. Courier charges are extra. These fees must be paid in advance of the work being performed. All monies must be paid to Hynak & Associates Trust Account. Federal Search & Opinion Prior to filing a US Application, it is recommended that at least a Federal Search be conducted and an opinion rendered. Our flat fee for conducting a Federal Search for a word mark and providing an opinion on use and registrability is $445.00. Fees for design marks will be provided upon request. In addition, we obtain full federal, state and common law trademark searches. Our opinion for a full search is based on our hourly rate. Hourly Rate Our hourly rate for legal services is $360.00. *These fees also apply to applications claiming priority based on a Home Country application or registration.

Filing of a National Application in the US based on Intent to Use Filing of a National Application in the US Our fee for filing a one class application in the US is $485.00 plus the US Patent and Trademark Office (USPTO) fee. Our fee for an additional class in the same application is $240.00 plus the USPTO fee. Our fee for filing a Statement of Use is $295.00 for the first class and $190.00 for each additional class. Obtaining the Trademark Registration Certificate Obtaining the Trademark Registration Certificate and docketing for Section 8 and Renewal requirements and sending said Registration Certificate by courier is $130.00 and is invoiced when the Registration Certificate is sent. Courier charges are extra. These fees must be paid in advance of the work being performed. All monies must be paid to Hynak & Associates Trust Account. Creation and opening of a file Review of file and preparation of the response Submission of the response to the USPTO Flat Fees for Madrid Refusals in the United States Hynak & Associates provides quality cost effective legal services for the prosecution of US Trademark applications filed under the Madrid Protocol. Forwarding a copy of the response sent to USPTO agreed upon Transmittal of the Notice of Allowance For reasonable inquires as to the status of the application, there is no charge Michael Hynak is exceptionally qualified to support international trademark professionals that have filed Madrid applications. Mr. Hynak has over 35 years of trademark practice experience, many of which were as a lawyer at the US Patent and Trademark Office, where he served as an Examining Attorney, Editor of the Trademark Manual of Examining Procedure and a Petitions and Classification Attorney. This option will allow us to prosecute the application and will change where correspondence is received. It changes the correspondent address to where the USPTO sends correspondence. It does not affect the address of the representative designated in the international registration to which the International Bureau sends correspondence. Based on your needs, we offer the following services. Filing a National Application in the US Our fee for filing a one class application in the US is US$485.00 plus the USPTO fee. The following are included in our fixed fee: Preparation of the trademark application Filing the application Creation and opening of a file agreed upon Transmittal of the Notice of Publication No additional fee for design marks unless additional art work is required Madrid Protocol US Application Refusals We will assist you in responding to USPTO actions with 2 options of service or representation. Option 1 - Refusal of Identification/Classification of Goods/Services with Change of Correspondence Address We will file the response together with a Power of Attorney and Change of Correspondent Address. For a fixed fee of US$350.00 for one class and US$240.00 for each additional class in the same application, we will review the refusal relating to the identification/classification of goods. In addition, we will review the file and will respond to the Office Action and file a Power of Attorney. The following are included in our fixed fee: Option 2 - Refusal for Other Reasons We will respond to Office Actions citing any cause for refusal of the trademark application. Responses other than for identification/classification (see fixed fee rate above) are billed at an hourly rate of US$360.00.

Post Registration Fees Filing a Declaration of Use in Commerce Under Section 8/71 We will file the required Declaration together with a Power of Attorney and Change of Correspondent Address, if necessary. Our fixed fee for this service is $485.00 for one class and $240.00 for each additional class in the same application plus the USPTO fee. The following are included in our fixed fee: Review of File. Preparation of the required Declaration. Submission of the Declaration to the USPTO. Creation and opening a file. Forwarding a copy of the Declaration sent to the USPTO. agreed upon.
