BEFORE THE BOARD OF COUNTY COMMISSIONERS MARTINCOUNTY, FLORIDA, ORDINANCE NUMBER 129 AN ORDINANCE AMENDING THE CODE OF LAWS AND ORDINANCES OF MARTIN COUNTY BY UPDATING THE ELECTRICAL CODE TO THE NATIONAL ELECTRICAL CODE 1978 EDITION; REPEALING CONFLICTING PR3VISIONS OF LAW; PROVIDING FOR SEVERABILIW IN THE EVENT OF,i PARTIAL INVALIDITY; PROVIDING FOR INCLUSION IN THE COUNTY CODE; PROVIDING FOR APPLICABILITY OF THIS ORDINANCE IN THE UNINCORPORATED AREAS OF THE COUNTY; STATING THE STATUTORY PENALTIES FOR ORDINANCE VIOLATION; DIRECTING THAT COPIES OF THIS ORDINANCE BE FILED WITH THE DEPARTMENT OF ENVIRONMENTAL REGULATION, THE DEPARTMENT OF COMMUNITY AE'FAIRS, AND THE DEPARTMENT OF STATE; AND PROVIDING AIJ EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Martin County desires to keep the codes regulating construction in the county current with changes in the construction industry, and WHEREAS, the new edition of the National Electrical Code is available, and WHEREAS, the Board of County Commissioners has determined that the new code would better protect the public health, safety, and general welfare; NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MARTIN COUNTY, FLORIDA, THAT: PART ONE: ADOPTION OF UPDATED NATIONAL ELECTRICAL CODE. The following sections of the Code of Laws and Ordinances of Martin County be and hereby are amended as follows: SECTION 11-55. APPLICABILITY OF FLORIDA ELECTRICAL CODE; INTENT. The Florida Electrical Code contained in

Part 11, Chapter 553, ~lorida Statutes (1977), except for Subsection 553.19(1), and the National Electrical Code (PJFPA No. 70-1978), is - are applicable in the electrical en- forcement district created by this chapter and constitutes the minimum electrical standards in such district, It is the intent of this article to adopt and enforce additional or more stringent standards or administrative procedures and requirements than those prescribed inthe Florida Electrical Code, and the National Electrical Code, including but not limited to fees, and that the standards or admini-,/ strative procedures and requirements of this article shall I be in conformity with standards set forth in Section 553.19, Florida Statutes, and the National Electrical Code. SECTION 11-56. ADOPTION OF COUNTY ELECTRICAL CODE. The Florida Electrical Code contained in Part 11, Chapter 553, Florida Statutes (1977), including all of the standards adopted in Section 553.1.9, except for Sub- section 553.19 (l), Florida statutes (1977), and the ~ational Electrical Code, (NFPA No. 70-1978), as amended by the additional or more stringent standards or administrative procedures and requirements of the local amendments to said Paerida National Electrical Code contained in section 11-57 of this chapter, be and hereby is - are adopted as the county electrical code, SECTION 11-57. LOCAL AMENDMENTS TO PbeRZBA NATIONAL ELECTRICAL CODE, The following local amendments to the Paerkda National Electrical Code be and hereby are adopted: (Note: NEC references are to'~ationa1 Electrical Code, 3935 1978 Edition. ) *6truek-tkreugh passages are deleted; underlined passages are added.

PART TWO: REPEAL. Special acts of the Florida Legislature applicable only to unincorporated areas of Martin County, county ordinances and county resolutions, or parts thereof, in conflict with this ordinance are hereby abolished and repealed to the extent of such conflict. PART THREE: SEVERABILITY. If any section, sentence, clause, phrase or word of this ordinance is for any reason held.or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and it shall be construed to have been the intent of the Board of County Commissioners to adopt this ordinance without such unconstitutional, invalid, or inoperative part therein, and the remainder of this ordinance after the exclusion of such part or parts, shall be deemed and held to be valid as if such part or parts had not been included herein. If this ordinance or any provision thereof shall be held to be inapplicable to any person, groups of persons, property, kind of property, circumstances, or set of circumstances, such holding shall not affect its applicability to any other person, property or circumstances. PART FOUR: CODIFICATION. Provisions of this ordinance shall be incorporated in the County Code and the word "ordinance" may be changed to "section," "article," or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts Two to Nine shall not be codified. PART FIVE: APPLICABILITY. This ordinance shall be applicable only in the un- incorporated areas of the county.

PART SIX: FILING WITH DEPARTMENT OF ENVIRONMENTAL REGULATION. In order to comply with Section 373.023, FLORIDA STATUTES, the County Attorney shall send a certified copy of this ordinance to the Bureau of Water Resources Managenent, Department of Environmental Regulation, 115 Bloxham Street, Pennington Building, Tallahassee, Florida 32304. PART SEVEN:. FILING WITH DEPARTMENT OF STATE. / The Clerk be and hereby is directed forthwith to. - send a certified copy of this ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida 32304, PART EIGHT: PENALTIES. Violation of this ordinance is a misdemeanor pursuant to Section 125.69, FLORIDA STATUTES, and is punishable under said section by imprisonment for up to sixty (60) days, or a fine of up to $500.00, or both such imprisonment and fine. PART NINE: EFFECTIVE DATE. This ordinance shall take effect upon receipt of official acknowledgment from the Office of Secretary of State that this ordinance has been filed in that office.
