MINUTES OF THE OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF UPPER DEERFIELD, IN THE COUNTY OF CUMBERLAND, HELD ON THURSDAY, MARCH 16, 2017, AT 7:00 P.M. IN THE MUNICIPAL BUILDING, HIGHWAY 77, SEABROOK, NEW JERSEY, PURSUANT TO NOTICE Present were: James Crilley, Bruce Peterson, John T. O Neill, Sr., John Daddario and Scott Smith all being members of the Township Committee. Also present were: Rocco Tedesco, Solicitor; Roy Spoltore, Township Administrator/Clerk; Teresa Warburton, Recording Secretary and Amy Colaneri, Treasurer. The meeting was called to order by Committeeman James Crilley and he read the following public meeting announcement. "This meeting is being held in accordance with the Open Public Meetings Act. Notice of the meeting has been provided and published as required by law in the Daily Journal and The Press, Cumberland County Edition. Notice has also been posted in the Municipal Building. The Clerk shall enter this statement in the minutes of this meeting. In compliance with State Fire Safety Statues the Chairman instructs those present how to exit the room in an emergency. James Crilley gave an invocation followed by the flag salute led by Scott Smith. At this time James Crilley, Chairman opened the meeting for public comment. Donna Lloyd, Senior Center Director thanked the committee for giving her the opportunity to serve as director of the center for the past five years. She thanked the committee for allowing her to redecorate the center and make it a place the seniors love to be. Ms Lloyd reported that there are nine new members since January and there are ten seniors over 90 years of age. The center will be holding a Nifty Nineties day in May 2017. The committee thanked Ms. Lloyd for the job she has done and working through a difficult time at the center. There being no other public comments James Crilley, Chairman called for the approval of minutes for the meeting of March 2, 2017. On a motion of Bruce Peterson, seconded by John T. O Neill, Sr., to dispense with the reading of the minutes and to accept the minutes as received, unanimously approved 4-0 with John Daddario abstaining. James Crilley, Chairman called for a public hearing on an ordinance entitled, Calendar Year 2017 Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank (N.J.S.A. 40A:4-45.14).. The Clerk read the proposed Ordinance by title. On motion of Bruce Peterson, seconded by Scott Smith to open the meeting for a public hearing on the proposed ordinance, and unanimously carried. The Chairman instructed the Clerk to distribute copies to those present. There being no public comments, on motion of John T. O Neill, Sr., seconded by Bruce Peterson to close the public hearing and unanimously carried. On motion of Scott Smith, seconded by John T. O Neill, Sr., to approve and adopt proposed ordinance, unanimously carried 5-0 on a roll call vote. James Crilley, Chairman called for a public hearing on an ordinance entitled, Authorizing the Expenditure of Capital Reserve Funds for Improvements to Roads. The Clerk read the proposed Ordinance by title. On motion of Bruce Peterson, seconded by John T. O Neill, Sr. to open the meeting for a public hearing on the proposed ordinance, and unanimously carried. The Chairman instructed the Clerk to distribute copies to those present. There being no public comments, on motion

of Scott Smith, seconded by John T. O Neill, Sr., to close the public hearing and unanimously carried. On motion of Bruce Peterson, seconded by Scott Smith, to approve and adopt proposed ordinance, unanimously carried 5-0 on a roll call vote. Authorizing the Expenditure of Capital Reserve Funds for Improvements to Roads Crosswalk. The Clerk read the proposed Ordinance by title. On motion of Bruce Peterson, seconded by Scott Smith to approve and adopt proposed ordinance on first reading and setting the date for public hearing on April 6, 2017 at 7:00 pm and was carried 5-0 on a roll call vote. The Chairman instructed the Clerk to advertise same in the Daily Journal as required by law and copies to be made available upon request. Ordinance Amending Chapter 328 of the Code of the Township of Upper Deerfield With Respect to Sewer Use and Fees. The Clerk read the proposed Ordinance by title. John T. O Neill, Sr. stated that this ordinance will increase sewer rates to cover the expense of the operation but will also add a senior discount similar to the allowable discount for water usage. Bruce Peterson commented that the Township s utility distribution system is new compared to other systems in the area. On motion of Bruce Peterson, seconded by John T. O Neill, Sr., to approve and adopt the proposed ordinance on first reading and setting the date for public hearing on April 6, 2017 at 7:00 pm and was carried 5-0 on a roll call vote. The Chairman instructed the Clerk to advertise same in the Daily Journal as required by law and copies to be made available upon request. Amending Chapter 396 of The Code of The Township of Upper Deerfield With Respect to Water Use and Fees. The Clerk read the proposed Ordinance by title. John T. O Neill, Sr. stated that this ordinance will reduce the amount of free water per month but maintain the monthly billing amount. On motion of John T. O Neill, Sr., seconded by Scott Smith to approve and adopt proposed ordinance on first reading and setting the date for public hearing on April 6, 2017 at 7:00 pm and was carried 5-0 on a roll call vote. The Chairman instructed the Clerk to advertise same in the Daily Journal as required by law and copies to be made available upon request. James Crilley, Chairman called for a resolution entitled Introduction of 2017 Municipal Budge and 2017 Utility Budget. The Clerk read the resolution by title. Mayor Crilley gave some highlights of the budget for 2017. On motion of Bruce Peterson, seconded by John T. O Neill, Sr., to approve and adopt said James Crilley, Chairman called for a resolution entitled Authorizing the Lease of Certain Land(s) Owned by the Township of Upper Deerfield. The Clerk read the resolution by title. On motion of Bruce Peterson, seconded by John T. O Neill, Sr. to approve and adopt said resolution, unanimously carried 5-0 on a roll call vote.

James Crilley, Chairman called for a resolution entitled Authorizing Professional Service Agreement with Fralinger Engineering for the Reconstruction of Love Lane. The Clerk read the resolution by title. On motion of Scott Smith, seconded by John T. O Neill, Sr., to approve and adopt said James Crilley, Chairman called for a resolution entitled Authorizing Awarding Contract for Township Employee and Volunteers Physicals to RSP Medical, LLC. The Clerk read the resolution by title. On motion of Bruce Peterson, seconded by John T. O Neill, Sr., to approve and adopt said James Crilley, Chairman called for a resolution entitled Authorizing Awarding of Contract for Spring Activation and Fall Winterization to Certain Underground Irrigation Systems within the Township of Upper Deerfield. The Clerk read the resolution by title. On motion of Bruce Peterson, seconded by Scott Smith to approve and adopt said resolution, unanimously carried 5-0 on a roll call vote. James Crilley, Chairman called for a resolution entitled Appointing Part Time Emergency Medical Technician Michael Urgo. The Clerk read the resolution by title. On motion of John Daddario, seconded by John T. O Neill, Sr. to approve and adopt said resolution, unanimously carried 5-0 on a roll call vote. James Crilley, Chairman called for a resolution entitled Authorizing Awarding of Contract for Supplying DGA Material to Various Locations Within Upper Deerfield Township. The Clerk read the resolution by title. On motion of Bruce Peterson, seconded by Scott Smith to approve and adopt said James Crilley, Chairman called for a resolution entitled Payment of Bills in the amount of $1,262.438.92. On motion of Bruce Peterson, seconded by John Daddario to approve and adopt said COMMITTEE COMMENTS John Daddario reported that the cleanup of Township roads is this Saturday. Registration will begin at 7:45 am at the Township Municipal Building. He Hoped that 40-50 people will get involved and have this event twice a year. Scott Smith did not have a report this evening. Bruce Peterson did not have a report this evening.

John T. O Neill, Sr. requested approval for continuing education for Chad Ott and Dominick Manno for the Office of Emergency Management Emergency Preparedness training in the amount of $270.00, and for Jeryl Goff for the annual Building Safety Conference in the amount of $190.00. On motion of John T. O Neill, Sr., seconded by John Daddario, to approve the aforementioned training and unanimously carried 5-0 on a roll call vote.. Mayor Crilley stated that we were lucky with the path the storm took but forecasts necessitated the cancelling of the 30 Mayor s and 30 Developers expo in Glassboro. The event has been rescheduled for May 17, 2017. ADMINISTRATOR S REPORT Roy Spoltore, Administrator reported that the NJLM advisories and departmental reports are in your packets for your review. The newsletter is going to print next week so the pictures from township clean-up will be added. The County is still looking to take ownership of the island at Rosenhayn Avenue and Woodruff and to receive additional ROW along western side of the railroad along Laurel Heights Drive. Resolutions will be prepared to deed the island and provide additional ROW to the County. The Committee reviewed the nine parcels that will be put out for public bid in May. DEPARTMENTAL MONTHLY REPORTS: February 2017 SOLICITOR S REPORT Animal Control and Dog Registrar Monthly Report Clerks Monthly Report Construction Office Monthly Report Housing and Zoning Municipal Court Monthly Report Tax Collectors Report Vital Statistics Fire Marshall Rocco Tedesco, Solicitor stated that the Township has a Housing Trust Fund. The solicitor believes the court may allow some of the funds to be used for consulting fees in the development of the fair share housing plan. Mr. Tedesco will continue to investigate the matter and if it is deemed appropriate will bring back a resolution to hire a consultant for the plan. Mr. Tedesco added the Township should be charging the Commercial Non-Residential Development Fee for any new commercial development. At this time James Crilley, Chairman opened the meeting for additional public comments. Lisa Kincaid of Centerton Road thought the idea of a clean-up day in the Township is a great idea. She suggested tying the event into the national volunteer day. Ms. Kinkaid inquired if there was a way as a neighboring property owner to a parcel that is going up for public bid to purchase the property prior to the public bid process. Mr. Tedesco informed Ms. Kincaid that the state bid laws do not allow for private sales and properties have to go through the public bid process. Nancy Ridgway of Irving Avenue stated she was glad to hear about the potential use of the housing trust fund. She reported that the Cumberland County Utilities Authority contractor for the pump station behind the convenience center must start the job by April 1 st or the Authority will consult with the contractor s bonding company.

Wayne Sabota of Quail Ridge Drive stated that it is dangerous to have parked cars along the south side of Love Lane by CRHS. Mr. Sabota asked if it is possible to post no parking signs on the south side. With no other public comments and no further business to come before the Committee James Crilley, Chairman called for a resolution Authorizing Closed Session to for a resolution Authorizing Closed Session to update the Committee on matters requiring attorney client privileged confidential communications. The Clerk read the resolution by title. On motion of Bruce Peterson, seconded by Scott Smith to approve and adopt resolution, unanimously carried 5-0. On a motion of Bruce Peterson, seconded by John Daddario and unanimously approved 5-0, the meeting was reopened to the public. With no further business to come before the Committee, on a motion of Bruce Peterson, seconded by John T. O Neill, Sr. to adjourn the meeting, and unanimously carried.
