COUNCIL REORGANIZATIONAL MEETING MINUTES - 10:45 am East Windsor Township Municipal Building MINUTES CALL TO ORDER: The Reorganizational meeting of the East Windsor Township Council was called to order by Mayor Janice S. Mironov at 10:45 a.m. on. VERIFICATION OF NOTICE OF MEETING: The Municipal Clerk Gretchen McCarthy announced that notice of this meeting was sent to the Trenton Times, filed in the office of the Municipal Clerk and posted in the East Windsor Township Municipal Building on December 30, 2015 and that all requirements of the Open Public Meetings Act have been met. INVOCATION: Rabbi Jay M. Kornsgold of the Beth El Synagogue gave the invocation. FLAG SALUTE: Boy Scout Troop 59 (Ben Catana, Mark Elgency, Michael Elgency, Kenny Gerhart, Zach Hupfl, John O Brien, Brendan Reiss, Nicholas Seminerio, Aidan Sharpe, Joel Simon, Max Tootleman, and Sam Tootleman with Troop Leaders John O Brien, Steve Sharpe, and Sandy Tootleman) presented the Colors and led the Flag Salute. NATIONAL ANTHEM Star Spangled Banner Harvey Bailey of East Winsor Volunteer Fire Company No. 1 sang the National Anthem. Mayor Mironov invited Congresswoman Bonnie Watson Coleman to say a few words. Congresswoman Watson Coleman briefly spoke congratulating the recently elected and appointed and wishing a productive year to them as well as a Happy New Year to all. Nays - None There being seven (7) ayes and no (0) nays the Oath of Office was administered to Mayor Janice Mironov by Mercer County Executive Brian M. Hughes after he gave a few brief remarks. NOMINATION AND ELECTION OF DEPUTY MAYOR: It was MOVED by Council Member Lippman SECONDED by Council member Rosenberg nominating Peter Yeager as Deputy Mayor. There being no other nominations made the roll was called. There being seven (7) ayes and no (0) nays the Oath of Office was administered to Deputy Mayor Peter Yeager by Mayor Janice Mironov. APPOINTMENTS BY COUNCIL: It was MOVED by Council Member Yeager SECONDED by Council Member Shapiro appointing David E. Orron as Township Attorney for the year 2016. There being seven (7) ayes and no (0) nays David E. Orron was appointed as Township Attorney for the year 2015. It was MOVED by Council Member Lippman SECONDED by Council member Zoller appointing Jeffrey Rubin as Township Prosecutor for the year 2016. There being seven (7) ayes and no (0) nays Jeffrey Rubin was appointed as Township Prosecutor for the year 2016.

Council Member Shapiro as Class III Township Council Member Recreation Commission: Jenine Porter-Celestin for 5 year term ending 12/31/2020. Council Member Yeager as Township Council Liaison. Zoning Board of Adjustment: Michael Bailey, Caroline Berdzik, and Anthony Katawick for 4 year terms ending 12/31/2019. Anthony Rago as Alternate #1 for a two (2) year term to expire 12/31/17 It was MOVED by Council Member Zoller SECONDED by Council member Daniels appointing the list of Board and Commission members to their respective positions.

RESOLUTIONS: RESOLUTION R2016-001 BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, as follows: 1. During the year 2016 the Regular Meetings of the Township Council will be held at 7:30 p.m., in the Municipal Building at 16 Lanning Boulevard, in accordance with the attached Annual Notice of 2016 Meetings. RESOLUTION R2016-002 BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, as follows: 1. The Times of Trenton is hereby designated as the official newspaper of the Township for the year 2016. 2. The Times of Trenton is also designated to receive any and all meeting notices of the Township.

Page 6 3. The Trentonian is designated to receive meeting notices and any other notices as deemed appropriate. 4. The Bulletin Board in the office of the Municipal Clerk in the East Windsor Municipal Building, 16 Lanning Boulevard, East Windsor NJ 08520 is hereby designated as the place where all official notices are to be posted. RESOLUTION R2016-003 COUNTY OF MERCER BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, that interest on delinquent taxes during the year 2016 be charged at the rate of eight (8%) percentum on the first $1,500 of the delinquency on any lot, and at the rate of eighteen (18%) percentum on any amount in excess of $1,500, the same to be calculated from the date the tax was payable until the date of actual payment, provided, however, that no interest be charged if payment of taxes is made within ten (10) days after the date upon which the same became payable. BE IT FURTHER RESOLVED that unpaid delinquencies in excess of $10,000 at the end of the calendar year be charged additional interest at the rate of six (6%) percentum of the amount of the delinquency. RESOLUTION R2016-004 BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, that pursuant to the requirements of the Public Employee s Retirement System and the Police and Firemen s Retirement System that the Finance Director, Laurie Finger, is hereby designated as Certifying Agent and shall be responsible for processing all documents and sending the said documents as required pertaining to the aforesaid retirement systems. RESOLUTION R2016-005 WHEREAS, in accordance with N.J.S.C. 17:27-3.3, each public agency shall designate an individual to serve as its Public Agency Compliance Officer or P.A.C.O. to serve as the public agency point of contact for all matters concerning implementation and administration of Equal Employment Opportunity statutes and regulations.

Page 7 NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, that: 1. Township Manager, James Brady, is hereby appointed as the Public Agency Compliance Officer on behalf of the Township of East Windsor. 2. The Municipal Clerk is authorized and directed to forward a certified copy of this Resolution to the State of New Jersey, Department of Treasury, Division of Purchase and Property, Contract Compliance Audit Unit, EEO Monitoring Program. RESOLUTION R2016-006 WHEREAS, N.J.S.A. 40A:5-14 mandates that the governing body of a municipal corporation shall, by resolution passed by a majority vote of the full membership thereof, designate as depositories for its monies banks or trust companies having its place of business in the state and organized under the laws of the United States or this state; and NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of East Windsor, in the County of Mercer, State of New Jersey, as follows: 1. First Choice Bank is hereby currently designated as depositories for all the monies of the Township of East Windsor unless or until further action of the governing body. 2. Prior to the deposit of any municipal funds in the above name Depositories, said bank shall file with the Chief Financial Officer a statement indicating that the bank is covered under Government Units Deposit Protection Act (N.J.S.A. 17:9-41). 3. First Choice Bank are hereby authorized to make payments from the funds on deposit with them upon and according to signed checks, drafts, notes and/or acceptances of the Township of East Windsor pursuant to the attached list of accounts and authorized signatures. RESOLUTION R2016-007 WHEREAS, the Township Council of the Township of East Windsor is desirous of facilitating public access to the proceedings of the Township Council; and WHEREAS, there is a need to provide guidelines for increasing such access.

Page 8 NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of East Windsor, County of Mercer, State of New Jersey, as follows: 1. The attached guidelines entitled Regulations Governing Meeting Dates, Agenda, and Procedures for Conducting Business of the Township Council dated, are hereby adopted as By-Laws of the Township Council for the year 2016. 2. Copies of same shall be sent to all department heads and posted permanently in municipal facilities. 3. This Resolution shall become effective immediately. RESOLUTION R2016-008 WHEREAS, N.J.S.A. 40A:4-19 provides that the governing body shall make temporary appropriations to provide for the period between the beginning of the budget year and the date of the adoption of the budget; and WHEREAS, in accordance with N.J.S.A. 40A:4-19, the total of the attached temporary general appropriations does not exceed 26.25% of the total of all budget appropriations of the preceding year, less appropriations for debt service, capital improvements fund and public assistance; and WHEREAS, the total proposed temporary appropriations are $4,630,432.00 for current fund plus $409,000.00 for garbage district no. 1. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of East Windsor in the County of Mercer, State of New Jersey as follows: 1. The attached 2016 temporary appropriations are hereby approved. 2. A certified copy of the Resolution shall be transmitted to the Chief Financial Officer. Mayor Mironov recognized and thanked the numerous elected officials present: New Jersey State Senator Linda Greenstein, Assemblyman Daniel Benson, Assemblyman Wayne DeAngelo, Mercer County Executive Brian Hughes, Mercer County Freeholder Ann Cannon, Mercer County Freeholder Pat Colavita, Mercer County Freeholder Tony Carabelli, Mercer County Freeholder John Cimino, and Mercer County Freeholder Lucy Walter, Mercer County Sheriff Jack Kemler, Mercer County Clerk Paula Sollami-Cavello, Mercer County Surrogate Diane Gerofsky, and Plainsboro Township Mayor Peter Cantu. PRESENTATIONS: Mayor Mironov presented certificates of appreciation to the following volunteer members of boards and committees for their service to the Township: Gary Fournier (Vice-Chairperson, Clean Communities Advisory Committee), Ina Heiman (Commission on Aging), Michael Henderson (Chairperson, Economic Development Committee), Lenox Ng (Economic Development Committee), Frank Fielder (Health Advisory Board), Anthony Catana (Planning Board), Denise Daniels (Planning Board), Jenine Porter-Celestin (Recreation Commission), Michael Bailey (Zoning Board of Adjustment), and Caroline Berdzik (Zoning Board of Adjustment). OTHER RECOGNITIONS Mayor Mironov spoke regarding the staff present and thanked them for the jobs they do and their presence at the meeting. Mayor Mironov spoke specifically of the diligent work of Township Manager James P. Brady and presented Mr. Brady with a plaque as Overall Employee of the Year. Mayor Mironov, Council Member Shapiro and Council Member Rosenberg spoke of the sad passing of Council Member Hector Duke and how his kind heart, wealth of knowledge and dedication to East Windsor Township made such impact to all who knew him. Mayor Mironov presented Mrs. Joanne Duke with an inscribed clock in Council Member Duke s honor. PUBLIC FORUM: No members of the public spoke REMARKS BY MEMBERS OF COUNCIL AND MAYOR: Council Members voiced wishes for a Happy New Year as well as thanks for the opportunities to serve East Windsor. Mayor Mironov detailed the many accomplishments and numerous projects and works of the Mayor and Township Council. MUSICAL CONCLUSION: Harvey Bailey of East Windsor Volunteer Fire Company No. 1 sang God Bless the U.S.A.
