Also, to allow five dumpster enclosures to be located in the front yard setback on Fillmore North, Block 1, Lot 1. Greg Arnold, representing WestCorp Management Group appeared before the Council. He stated he understands they have built in the setback area. He stated they were given approval by the Planning Commission and it was also approved through building inspection, and permits were issued. Garages were placed in the setback area with received approvals. He is asking Council for approval to allow for keeping the garages where they are built. He noted an updated survey was approved with the ten foot setback, and he used local engineer KLJ to be in compliance with City Zoning Code. The City Engineer explained the original plan to staff did not indicate there were garage structures, as no dimensions were provided and staff cannot determine what the structures are. He said staff cannot override zoning ordinances administratively and a variance request never came to the Planning Commission. The Building Official informed them the structures were in the setback. The City Engineer stated the applicant was told they needed to correct the plan, but the garages had not been built at the time the setback issue was discovered. Greg Arnold stated the plans did indicate garages and the final plan showed the ten foot setback. He said they built on approval given to their engineer. He noted they moved ahead and built garages knowing they were in the setback, but they were not able to get feedback on their plans provided to the City since July 2014. MAYOR S REPORT Mayor Barney thanked the Alderman for their participation in the Board of Equalization process and in assisting with the vote canvassing. He also recognized an individual Scout from Troop 425 who was in attendance for his Community Merit Badge. He noted the Comprehensive Plan, the Transportation Plan and the River Front and Center Plan remain priorities. He said the City is tightening the procedures related to nuisance and zoning enforcement and the City has recently participated in the Beautify Minot campaign. Mr. Staab also reviewed several departments and some of the work they have been involved in. He stated the Police Department has put in a lot of work and emphasis on traffic citations, the Fire Department has had the recent retirements for senior staff members and the Engineering Department is working on maintaining parking structure progress. He also said the Public Works Department will review GPS vehicle tracking at the next City Council Meeting. He concluded by reminding Council members of the upcoming Airport tour on May 5 th. Bobby Roberts of 1217 7 th Ave NE, asked if this ordinance includes a grandfather clause on pitbulls as service dogs so as not to open up opportunity for individuals to specifically pick the breed as a service animal. The City Attorney stated that Special City Attorney Pat Seaworth had researched the issue and found that strict bans of breeds as service animals have been challenged in court. This ordinance has added specific language describing the owners responsibility in having this breed as a service dog such as fencing requirements. It also includes an exception for those dogs that are declared a nuisance.
