Police Jury Room January 22, 2013 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on January 22, 2013, with President Mr. Nathan Granger presiding. The meeting was called to order by Mr. Nathan Granger who asked Mr. Leon Broussard to lead the group in the Pledge of Allegiance. Following the pledge, the President asked for a moment of silent prayer or reflection. The President then reminded all present to turn all cell phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. The following members were present: Mr. Nathan Granger Mr. Wayne Touchet Mr. Leon Broussard Mr. Pervis Gaspard Mr. Paul Bourgeois Mr. Errol J. Domingues Mr. Cloris J. Boudreaux Mr. Mark Poche Mr. Kevin Sagrera Mr. Ronald Menard Mr. Ronald Darby Mr. Allen LeMaire Mr. Dane Hebert Mr. Sandrus Stelly Mr. Granger stated the first item on the agenda is the Bid Opening on the Public Sale of adjudicated property located at the intersection of Jacqulyn Street, and South Airport Dr. Mr. Granger asked if there were any bids from the audience. President Granger stated that no bids have been submitted for the Public Sale of adjudicated property located at the intersection of Jacqulyn Street, and South Airport Dr, Upon motion by Mr. Mark Poche, duly seconded by Mr. Wayne Touchet, unanimously carried, the Police Jury authorized Legal Counsel to publish the necessary notice to re-advertise the Public Sale of adjudicated property located at the intersection of Jacqulyn Street, and South Airport Dr, with a minimum bid of $10,000.00 for public sale to the highest bidder. Mr. Granger requested a motion to go into Executive Session to discuss the Juvenile Detention lawsuit. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Errol J. Domingues, and unanimously carried, the Police Jury went into executive session at 6:05 p.m., to discuss the Juvenile Detention lawsuit. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Errol J. Domingues, and unanimously carried, the Police Jury returned to regular session at 6:12 p.m. Mr. Paul Moresi, III, Legal Counsel stated that based on his report he requested permission to try and negotiate an expectable compromise with the City of Kaplan, and the City of Abbeville, regarding the housing of Juvenile s in Detention Centers.

. Upon motion by Mr. Pervis Gaspard duly seconded by Mr. Cloris J. Boudreaux, unanimously carried, the Police Jury authorized Legal Counsel to negotiate an acceptable compromise with the City of Kaplan, and the City of Abbeville, relative to the housing of Juvenile s in Detention Centers. Mr. Granger recognized Mr. Tim Creswell discuss his appointment to the Governor s Advisory Commission to the Coastal Protection, Restoration and Conservation. Mr. Creswell informed the Jury that on January 11, 2013, the Governor had a special meeting nominating three people from the Parish to the Governor s Advisory Commission on the Coastal Protection Restoration and Conservation. Mr. Creswell stated that Ms. Linda Zaunbrecher, will be one of the two representative for the agriculture, Mr. Mark Pizza will be one of the nominee s for the Municipalities, and Mr. Creswell will be appointed to serve as a representative of the Governing body with the political subdivisions of the state. Furthermore, Mr. Creswell stated that the first meeting for the Governor s Advisory Commission on the Coastal Protection & Restoration and Conservation would be held on February 26, 2013, and at that time, he will know then what their duties will detail. Mr. Granger read the following announcements: (A) (B) Received the Organizational Budget Plan for 2013 to 2017 from the Hospital Service District No. 2, which will be kept on file. Received the Financial Report for the Fiscal Year 2012 from the Vermilion Parish School Board, which will be kept on file. Upon motion by Mr. Leon Broussard duly seconded by Mr. Sandrus Stelly, unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the January 7, 2013 regular meeting, and was accepted as presented. Mr. Granger stated the next item is to consider action to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports Upon motion by Mr. Leon Broussard, duly seconded by Mr. Errol Domingues, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider action on any new items presented by Engineering & Architectural reports. President Granger recognized Mr. Eugene Sellers, Sr., with Sellers & Associates, Inc., to present his business to the Jury. Mr. Sellers presented a Letter of No Objection and two Project Permit Application. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Allen LeMaire and unanimously carried, the Police Jury approved a Letter of No Objection to: Walter Oil & Gas Corporation, for the dredging to prepare a drill pad for a barge in future well slip (Shell pad will be placed to hold the drill barge), for the proposed SL21015 Well No. 1, located ±17.2 miles southeast of Abbeville in Vermilion Bay, in Election District No. 9. Upon motion by Mr. Pervis Gaspard duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved the following Project Permits.

A. Project Permit No. 1708-D, to Dunn Exploration Company, LLC, proposed well located at Plante Well No. 001 in Sections 20, T-12-S, R-03-E, approximately 3.2 miles west of Abbeville on Highway 343, in Election District No 11. B. Project Permits No. 1708-D, to Dunn Exploration Company, LLC, a proposed well located at Montagne et al Well No. 002, in Sections 44 T-12-S, R-03-E, approximately 2 miles northwest of Abbeville, between Coulee Kinney Road and Coulee Kinney, north of Highway 14, in Election District No 11. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved General Needs Committee Recommendations, as presented, and the appropriate officials were authorized to carry out the recommendations. GENERAL NEEDS COMMITTEE JANUARY 16, 2013 ABBEVILLE, LOUISIANA AS A RESULT OF A GENERAL NEEDS COMMITTEE MEETING HELD ON JANUARY 16, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the Police Jury authorize the Parish Administrator to order on State Contract (2) Computers for the Public Works office, and (1) Computer for the Mosquito Control office. 2. It is recommended that the Police Jury approve to renew two DEQ Operator Certificates at a cost of $100.00 each total $200.00 for the following employees. A. Ricky LeBlanc B. Thomas Campbell, III 3. It is recommended that the Police Jury approve the following 5 operators to attend the 2013 LSWA (Louisiana Solid Waste Association) Conference March 21-22, 2013 in Lafayette in order to obtain their yearly certification hours at a cost of $225.00 each, totaling $1,125.00. A. Ricky LeBlanc B. Rodney Campbell C. Thomas Campbell, III D. William Stockton E. Keith Frederick 4. It is recommended that the Police Jury approve payment of an Invoice dated 01/22/13, in the amount of $10,832.88, to Bertrand s Plumbing & Heating, relative to completing the installation of 3 heaters at the Cecil McCrory Building. 5. It is recommended that the Police Jury approve Partial Payment No 1, to Louisiana Structural Movers, Inc. in the amount of $52,999.51, relative to the SRL elevation program for Joey & Connie Hebert s resident. 6. It is recommended that the Police Jury approve Partial Payment No.1 in the amount of $33,274.28, to L & R Construction, Phase II, relative to 2009-

2010 Capital Improvements Program, Road & Bride Improvements, for the F P & C Project No. 50-J57-09-01.Dewberry Road, F.T. Smith Road and Humble Road Bridges. 7. It is recommended that the Police Jury award the quote received to Arthur J. Gallagher Risk Management Services relative to a total estimated annual premium of $157,931.25, relative to Property and Boiler/Machinery insurance for the period of 01-25-13 01-25-14. 8. It is recommended that the Police Jury approve payment of an invoice dated 12/27/12 to the Avoyelles Parish Sheriff s Office, in the amount of $350.89, relative to medical billing for Vermilion Parish inmates from 10/01/2012 to 10/31/2012. 9. It is recommended that the Police Jury approve payment of an invoice dated 01/07/13 to the Avoyelles Parish Sheriff s Office, in the amount of $756.09, relative to Housing Vermilion Parish Inmates for the month of December 2012. 10. It is recommended that the Police Jury approve payment of an Invoice dated January 7, 2013, to Emerald Correctional Management (West Carroll Detention Center), in the amount of 634.14, relative to Housing Vermilion Parish Inmates for the month of December 2012. It is further recommended that the Police Jury authorize Legal Counsel to send a letter with the attached check to Emerald Correctional Management (West Carroll Detention Center), stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates 11. It is recommended that the Police Jury approve entering into an Intergovernmental Agreement with the City of Abbeville regarding garbage pick-up on Sweet Lane, in Election District No. 7. 12. It is recommended that the Police Jury authorize President Nathan Granger and Vice-President Ronald Menard to sign any and all official Police Jury documents. 13. It is recommended that the Police Jury approve entering into an Intergovernmental Agreement between the Police Jury and the City of Kaplan, to patch and overlay Louis, S. Guidry, and E. Maraist Streets, in Election District No.12, Sub 4 of 2. 14. It is recommended that the Police Jury appoint Mr. Scotty LeMaire to the Isle Morone Drainage District, replacing Mr. Randall Stelly. 15. It is recommended that the Police Jury re-appoint the following to the Hospital Service District No. 3: Mr. Larry Dugas 2 year (02/07/2015) Mr. Sean Gayle 2 year (02/07/2015) Ms. Grace Flo Thompson 2 year (02/07/2015) Mr. Lester Foreman 2 year (02/07/2015) 16. It is recommended that the Police Jury appoint the following to the Pecan Island Fire Protection District No.16.

It is recommended that the Police Jury re-appoint the following to the Pecan Island Fire Protection District No.16. Mr. John C. Choate 2 year(02/07/2015) Mr. Mike Broussard 2 year (02/07/2015) Mr. Wayne Miller 2 year (02/07/2015) 18. It is recommended that the Police Jury re-appoint Ms. Randie Choate to the Pecan Island Waterworks District No. 3, Board, as Commissioner for another five-year term, term will expire on (02/07/2020). 19. It is recommended that the Police Jury authorize the President to sign the Contract between the Division of Administration and the Vermilion Parish Police Jury for the FY 2012-2013 Louisiana Local Government Assistance Program (LGAP). (Grant amount received is $45,360.00, which will be used to purchase new computers and printers for the Administrative Office.) 20. It is recommended that the Police Jury authorize Sellers & Associates, Inc. to prepare the bid package and advertise for the 2013 Capital Outlay Equipment for the Solid Waste Facility as follows: (A) Three (3) Knuckle Boom Grab Trucks (B) Two (2) Automated Side Loading Garbage Trucks (C) One (1) Front End Loader (D) One (1) Landfill Dozer (E) One (1) Tractor and Side Mounted Brush Cutter Unit (F) One (1) 4WD Tractor (Approximately 125 HP) 21. It is recommended that the Police Jury ratify payment of Invoice dated November 29, 2012 through December 26, 2012, to Capital One, in the amount of $36.70, relative to Credit Card Invoice for the Vermilion Parish Office of Homeland Security and Emergency Preparedness. 22. It is recommended that the Police Jury approve a road name change from Dixon (PVT) Boulevard to Dixon (PVT) Drive, in Election District No. 11. 23. It is recommended that the Police Jury approve payment of the attached bills that were submitted. 24. It is recommended that the Police Jury approve sending a letter to the Office of Housing Authority of the City of Lafayette, requesting them to reconsider their decision in closing the office in Vermilion Parish, and to send a letter to all the Municipalities and the Vermilion Legislative Delegation, requesting their support. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury approved the holding of an election in Seventh Ward Gravity Drainage District No. 2 of the Parish of Vermilion, State of Louisiana, on Saturday, May 4, 2013, to authorize the continuation of a special tax therein. Mr. Granger stated the next item is to consider action to approve payment of the Section 5311 Monthly Activity Report for the month of December 2012 as submitted by the Vermilion Council on Aging and direct the Parish Administrator to submit the report of the Department of Transportation and Development for reimbursement in accordance with the contract agreement. Upon motion by Mr. Allen LeMaire, and seconded by Mr. Pervis Gaspard, and unanimously carried the Police Jury authorized sending a letter to the Department of Transportation and Development (DOTD), requesting that signs be installed off of Hwy 696 and Hwy 14 stating the location of the Meaux/Nunez Volunteer Fire Department. Upon motion by Mr. Cloris Boudreaux, and seconded by Mr. Allen LeMaire, and unanimously carried the Police Jury authorized sending a letter to the Department of Transportation and Development (DOTD), requesting to clean the ditch along mile marker No. 5, located at 13433 Hwy 696, Abbeville, LA. President Granger recognized Mr. Paul Moresi, III, Legal Counsel to present his business to the Police Jury. Mr. Moresi presented a brief report stating that at the last meeting there was some discussion on the Chenier Plain Coastal Restoration Protection Authority, (CPRA), and the Police Jury and their ability to work together on Projects. Mr. Moresi, stated that he has reviewed the Act, which created the Chenier Plain, Coastal Restoration Protection Authority, (CPRA), and first comment that he explained was basically this authority does not have sufficient money until if and when the voters in all three Parishes approve a tax, which has to be called for and must pass in all three Parishes. President Granger recognized Mr. Dane Hebert to present his business to the Police Jury. Mr. Hebert thanked the Juror s for contributing to the renovations, and improvements that were made to the Cecil McCrory Exhibit Building. President Granger recognized Mr. Ronald Darby to present his business to the Police Jury. Mr. Darby stated that he also received compliments on the renovations, and improvements that were made to the Cecil McCrory Exhibit Building and the community wanted to thank the Police Jury for everything they have done at the Exhibit Building. Mr. Darby further stated that he attended the Martin Luther King Parade that was held on January 21, and that it was a beautiful parade and the turnout of patrons was great. Mr. Darby informed the Jurors that he had attended his first Vermilion Parish Tourism Commission Meetings and informed the Police Jury that he feels they have a great commission and feels they will work well together to bring the Parish forward.
