WHEREAS, the city plan commission and the city council, in accordance with the Charter of the City of Dallas, the state law, and the ordinances of the City of Dallas, have given the required notices and have held the required public hearings regarding this amendment to the Dallas City Code: and WHEREAS. the city council finds that it is in the public interest to amend Article 193 as specified in this ordinance; Now, Therefore. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DALLAS: SECTION 1. That Division S9l, PD Subdistrict 91, of Part II, PD Subdistrict Regulations, of Article 193, PD 193, of Chapter 51P, Dallas Development Code: Planned Development District Regulations, of the Dallas Ctv Code is amended to read as follows: Division S-91. PD Subdistrict 91. SEC. S-91.1O1. LEGISLATIVE HISTORY. PD Subdistrict 91 was established by Ordinance No. 27954. passed by the Dallas City Council on August 11. 2010.
12268 SEC. S.-91.102. PROPERTY LOCATION AND SIZE. PD Subdistrict 91 is established on property located at the west corner of Cedar Springs Road and Herschel Avenue. The size of PD Subdistrict 91 is 1.9 acres. SEC. S-9L103. DEFINITIONS AND INTERPRETATIONS. (a) Unless otherwise stated, the definitions and interpretations in Chapter 51 and Part I of this article apply to this division. If there is a conflict, this division controls. If there is a conflict between Chapter 51 and Part I of this article, Part I of this article controls. (b) In this division, SUBDISTRICT means a subdistrict of PD 193. (c) Unless otherwise stated, all references to articles, divisions, or sections in this division are to articles, divisions, or sections in Chapter 51. (d) This subdistrict is considered to be a residential zoning district. SEC. S-91J04. EXHIBIT. plan. The following exhibit is incorporated into this division: Exhibit S-91A: development SEC. 5-91.105. DEVELOPMENT PLAN. (a) For multiple-family uses, development and use of the Property must comply with the development plan (Exhibit S-91A). If there is a conflict between the text of this division and the development plan, the text of this division controls. (b) For all other uses. no development plan is required, and the provisions of Section 51-4 707 regarding submission of or amendments to a dex elopment plait site analysis plan. conceptual plan, dcx eiopment schedule and landscape plan do not apply SEC. S-91.106, MAIN USES PERMITTED. The only main uses permitted in this subdistrict are those main uses permitted in the MF 2 Multiple:Family Subdistrict, subject to the same conditions applicable in the MF-2 Multiple: Family Subdistrict, as set out in Part I of this article. 2S88 I SEC. S-91.107. ACCESSORY USES. (a) As a general rule, an accessory use is permitted in any subdistrict in which the main use is permitted. Some specific accessory uses, however, due to their unique nature, are subject to additional regulations in Section 51P-193.108. For more information regarding accessory uses, consult Section 51P-193.108. (b) The following accessory uses are not pennitted in this subdistrct: -- Private -- Amateur -- Open stable. communication tower. storage. SEC. S-91.108. YARD, LOT, AND SPACE REGULATIONS. (Note: The yard, lot, and space regulations in this section must be read together with the yard, lot, and space regulations in Part I of this article. If there is a conflict between this section and Part I of this article, this section controls.) (a) In general. Except as provided in this section, the yard, lot, and space regulations for the MF-2 Multiple-Family Subdistrict apply. (b) Milefamily uses. (1) Fyard. Minimum front yard is 15 feet. (2) Side and rear yard. Minimum side and rear yard is 10 feet. (3) Density. Maximum number of dwelling units is 215 [4-gO]. (4) Hçjg. Maximum structure heights are as designated on the development plan and are measured to the highest point of the roof \4aximurn structure hcights are as S. (A) (B) Area A: 33 feet. Area B: 4 teet. 288S (5) Lot coverage. Maximum lot coverage is 86 percent. Aboveground parking structures are included in lot coverage calculations: surface parking lots and underground parking structures are not. SEC. S-91.109. OFF-STREET PARKING AND LOADING. (a) In general. Except as provided in this section, consult Part I of this article for the specific off-street parking and loading requirements for each use. (b) Multiple-family uses. (1) A minimum of 1.70 parking spaces per dwelling unit is required. Out of these parking spaces, 0.25 unassigned spaces per dwelling unit must be available for use by visitors as guest parking and by residents as unreserved parking. (2) An accessory community center (private) use must provide parking at a ratio of one space per 1,000 square feet of floor area. A minimum of one medium loading space must be provided. j4 Section 51P-193.l26(b)(3)(C) does not apply for off-street loading spaces. Section 51P-193.126(b)(3)(D) does not apply. SEC. S-91.11O. ENVIRONMENTAL PERFORMANCE STANDARDS. See Article VI. SEC. S-91J11. LANDSCAPING. (a T andscaping ind screening must he proded in accordance Part I nf this (b) All street frontages are to be considered as a front yard. except for the Dallas North Tollwav frontage. (c) The tree planting zone on the Cedar Springs Road frontage is that area parallel to and between 2.5 feet and 15 [-1-4] feet from the back of projected street curb. Tree grates are allowed per Part I of this article.
28828 (d) A sidewalk with a minimum width of [si*] feet must be provided on the Cedar Springs Road frontage. The sidewalk location must be provided in that area parallel to and between three [j feet and 10 [4-i] feet from the back of the projected street curb. (e) Plant materials must be maintained in a healthy, growing condition. SEC. S-91.112. STRUCTURE FACADE STANDARDS. (a) The structure facade must be clad with masomy materials. Masonry includes but is not limited to brick, stone, concrete, stucco, and fiber cement exterior cladding material. (b) Permanent parking structures must have a facade that is similar in appearance to the facade of the main non-parking building for which the parking is accessory. Openings in the parking structure facade may not exceed 52 percent of the total facade area. SEC. S-91.113. SIGNS. Signs must comply with the provisions for non-business zoning districts in Article VII. SEC. S-91.114. ADDITIONAL PROVISIONS. (a) Sections 51P-193,107(a)(3)(E)(iii) and (iv), which require an outer court or inner court for multiple-family uses, do not apply. j The Property must be properly maintained in a state of good repair and neat appearance. (c[b]) Development and use of the Property must comply with all federal and state laws and regulations, and with all ordinances, rules, and regulations of the city. (d[el) Development and use of the Property must comply with Part I of this article. That the development plan, Exhibit S-91A of Division S-91 of Article 193 of Chapter 51P of the Dallas City Code, is replaced by the Exhibit S-91A attached to this ordinance. SECTION 3. That development of this district must comply with the full-scale version of Exhibit S-91A (development plan) attached to this ordinance. A reduced-sized version of this plan shall be provided in Chapter 51P. Permits shall be issued based on information provided on the full-scale version of the plan. SECTION 4. That a person who violates a provision of this ordinance, upon conviction. is punishable by a fine not to exceed S2,000. SECTION 5. That the zoning ordinances of the City of Dallas and Chapter SiP of the Dallas City Code, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 6. That the terms and provisions of this ordinance are severable and are governed by Section 1-4 of Chapter 1 of the Dallas City Code as amended.
