TOWN OF EDSON BYLAW NO. A BYLAW FOR THE OPERATION OF "THE EDSON & DISTRICT COMMUNITY SERVICES BOARD" AND TO SET FORTH THE DUTIES AND RESPONSIBILITIES THEREOF. WHEREAS, Section 7(B), (F) and 145(A) of the Municipal Government Act, Chapter M-26 R.S.A. 2000 and amendments thereto, provides for the establishment of any Board considered desirable for the purpose of providing services on behalf of the municipality with respect to people, activities and things in, on or near a public place or place that is open to the public, and WHEREAS, the Family and Community Services Act, Chapter F-3, R.S.A. 2000 and amendments thereto and regulations passed thereunder provide for the establishment, administration and operation of a Family and Community Support Services program within a municipality; and NOW THEREFORE, the Municipal Council of the Town of Edson, in the Province of Alberta, duly assembled, enacts as follows: 1. TITLE The Bylaw may be cited as "The Edson and District Community Services Board Bylaw". 2. DEFINITIONS a. Board is the Edson and District Community Services Board b. Town is the Town of Edson c. Council is the Municipal Council of the Town of Edson d. County Council is the Municipal Council of Yellowhead County 3. PURPOSE OF THE BOARD The purpose of the Board is: a. to advise Council on policies concerning human services in the community; b. to advise the Community Services Department on programs; c. to be concerned with the quality of community services for all age groups and segments within Edson & District.

ESTABLISHMENT OF BOARD There is hereby established and constituted a Board to be known as "The Edson and District Community Services Board" to exercise the duties and powers and to perform the functions as prescribed by this Bylaw. a. The Board shall consist of not less than five (5) and not more than ten (10) volunteer members of which at least one (1) must be from the County. Members are to be appointed as follows: i. one (1) member appointed from and by the Council of the Town of Edson. ii. iii. iv. one (1) member appointed from and by the Yellowhead County Council. six (6) members appointed from the Town of Edson by the Edson Town Council. two (2) members appointed from Yellowhead County by the Yellowhead County Council. b. All appointments shall become effective as of the date of resolution, unless otherwise specified. c. In October each year at their Organizational Meetings, Town Council and Yellowhead County Council shall appoint members to fill board positions. d. A member may serve on the Board for a maximum of three (3) consecutive three (3) year terms after which he or she shall step down for at least one (1) year before being eligible to serve again. The initial appointments for the six (6) members at large from the Town shall be staggered so that two of the member terms expire or are eligible for re-appointment each year. The initial appointments for the two (2) members at large from Yellowhead County shall be staggered so that both terms do not expire in the same year. e. In the event of a vacancy occurring, the person appointed by resolution of Council to fill such vacancy shall hold such office for the remaining term of his or her predecessor. f. A person ceases to be a member of the Board when he or she: i. misses three (3) consecutive regular meetings of the Board, unless the absence is caused through illness or is authorized by resolution of the Board. ii. ceases to be a resident of the Town of Edson or Yellowhead County.
BYLAW NO. 1939 PAGE 3 iii. iv. is hired as an employee with the Town or with the County. submits a written resignation to the Town of Edson Director of Community Services. g. At the first meeting of the Board following the Annual Organizational Meeting of Council each year, the members shall select a chairperson and a vice chairperson, who shall act in the absence of the chairperson. h. The Director of Community Services shall serve as advisor to the Board. i. The Director of Community Services shall appoint a staff member who will provide secretarial service to the Board. j. The Board may appoint committees of its members and/or citizens at large to study various issues and to make recommendations back to the Board. k. Upon resolution from Council on the appointments of new board members, members shall receive an inclusive orientation by Administration on board duties & responsibilities. 5. MEETINGS a. Regular monthly meetings of the Board shall be held with the exception of July and August in which only one (1) meeting will be held to be determined by the Board and Administration. b. Special meetings of the Board may be called by the Chairperson with twenty-four (24) hours notice to all Board members. c. A majority of the members of the Board shall constitute a quorum. d. Each member present at a meeting of the Board shall vote when the vote is taken unless prohibited from so doing by reason of a conflict of interest, in which case the member shall be excused from the meeting room while discussion and voting takes place. e. The Chairperson shall vote on all motions and in the event of a tie vote, the motion is considered defeated. 6. POWERS Without restricting the generalities of the foregoing, this Board is authorized: a. to recommend policy to Council for development and revision of the Community Services programming and other aspects of human resource development: b. to provide co-operation and joint planning with related community groups and agencies;
BYLAW NO. 1939 PAGE 4 c. to encourage community groups and interested citizens to make representations to the Board in the development and review of the Board's policy recommendations to Council; d. to develop and recommend standards concerning community services programming; e. to encourage citizen participation in program development; f. to review, comment and recommend to Council the policy for grants, municipal assistance and specific grant applications for Community Services programming; and g. to work to establish a liaison with similar groups in order to co-ordinate Community Services programs of a common purpose. h. in the fall of each year to recommend to Council an operating and capital budget for the Community Services Department for the following year. i. to have one of its members and the Town Council representative to the Board be appointed full voting members of any committee involved in the appointment of a Director of Community Services. j. to have the authority to exercise control over the admittance to as well as conduct in the Recreation/FCSS facilities and on its grounds as well as the authority to exclude admittance to individuals or groups of individuals as the Board may deem necessary to facilitate the safety of and/or peaceable enjoyment of its patrons and its use of the programs and facilities. k. to make recommendations to Council regarding any suspensions or evictions from any Recreation/FCSS facility(s)/ground(s) that extends more than three (3) months. 7. DUTIES OF THE BOARD The Board shall: a. develop and maintain a system of communication between the Board, the community, community agencies, Yellowhead County, Grande Yellowhead and Living Waters School Boards designed to stimulate and facilitate planning and development; b. advise with respect to preventative social programs, recreation, parks and trails, and cultural services that provide a balance and variety for all segments, areas, age groups and organizations within the Town. c. co-operate, liaise with and encourage all organizations within the Town which support, promote or work for recreation and/or culture and FCSS.
BYLAW NO. 1939 PAGE 5 d. hear and consider representations by an individual, organization or delegation of citizens with respect to recreation, culture or FCSS and to make such recommendations arising therefrom as the Board deem to be in the general interest of all citizens; and e. be made aware of Disaster Services components of the Department and provide community feedback with respect to planning & training. 8. LIMITATIONS Unless authorized by Council, neither the Board nor any member thereof shall have the power to pledge the credit of the Town in any manner whatsoever. 9. REPEAL That Bylaw 1939 providing for the establishment of the Edson and District Community Services Board is hereby repealed. 10. EFFECTIVE DATE That this Bylaw shall take force and have effect upon final reading thereof.
