President Bossart convened the work session at 6:20 p.m. Chief Sabo went over the Fire Department Architectural Designs. He talked about the various options; one is the remodeling of Station #4, and two is to use the present Plain Township Hall site and expend the money architecturally to see if this land would be more suitable in sharing this area with Township Administration and the new Fire Station. Other discussion was on what to do with Station #4. Mrs. Bossart mentioned that it might be a good satellite Road Department area. Chief said the other option that would need to be talked about would be using the new 42 acres of land on Schneider. Either way the Chief indicated that they are going to spend $800,000 somewhere, whether it is on a newer area or a three year old building like Station #4 that already sits two feet too low. The Board agreed that he should move forward with the architectural firm and getting the idea together from option two to use the Plain Township Hall site that we already have. EXECUTIVE SESSION #06-545 Stark County, Ohio to adjourn to executive session at 6:44 p.m. from this regular meeting of October 24, 2006 as authorized under Ohio Revised Code 121.22(G) for the purpose of the consideration of: appointment of a public employee or official; employment of a public employee or official; the purchase of real, personal, tangible or intangible property; a conference with the law director or other retained counsel concerning pending or imminent court action. #06-546 Motion by Mrs. Bossart to return to public session at 7:00 p.m. REGULAR MEETING OPENING: The regular meeting was called to order at 7:00 p.m. by President Bossart, who led the staff and audience in the pledge of allegiance. A letter from Denise Evans was added to the agenda under Communications #8.

Phone Voicemail Mrs. Sabina informed the Board that the phone voicemail had been changed and a live person will be answering the phone. It will only be answered by a recorded voice if it rings more than four times. 2. Prescription Costs Mrs. Sabina said that Laura from the Fiscal Office put together a spreadsheet that shows the savings of approximately between $5,000 and $8,000. 1. Agenda Mrs. Sabina informed the Board that as of this date the agenda would be placed on the website with a note indicating that it is subject to change. FISCAL OFFICER S REPORT: 1. Pending Warrants #06-547 Motion by Mr. Giavasis, Stark County, Ohio to authorize the payment of pending warrants in an amount of $91,798.70 as attached hereto and made a part of these minutes. 2. Payroll #06-548 Stark County, Ohio to authorize payment of the regular payroll in an amount not to exceed $150,000.00 each for Payrolls on Oct. 27 th & Nov. 10 th. 3. Payment of Medical Claims #06-549 Motion by Mr. Leno, Stark County, Ohio to authorize payment for the following medical claims as provided by AultCare: DATE WARRANT AMOUNT 10/17/06 EFT 61314 $8,182.69 10/24/06 EFT 61315 $10,149.35 Seconded by Mrs. Bossart. 4. The Investment report was given and accepted by the Board. Mr. Shriver pointed out that as of today we had in excess of $340,000 in investment income with no fees involved. Mrs. Bossart stated that it was very good.

Seconded by Mrs. Bossart. b. Non-Bargaining Employees #06-552 BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio to authorize the benefits of longevity pay to all non-bargaining unit employees who meet the requirements of the attached schedule. ADMINISTRATOR: 1. Newsletter Request Mrs. Sabina said that she had been contacted by Tim Roshong, the Executive Director of the Community Center that is going to be located on the First Christian Church property. He wanted to know if there could be a information on membership fees in our newsletter. Mr. Williams advised that we not do this because it is a form of advertisement and we cannot use the newsletter for that purpose unless it was opened up to all other entities for advertising.

Gall s #06-553 Motion by Mr. Giavasis, BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to authorize the purchase of uniform allowance items from Gall s Inc. in an amount not to exceed $1,500 to be taken from Account 10-A-09C. Seconded by Mrs. Bossart. b. D & G Uniform #06-554 BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to authorize the purchase of uniform allowance items from D & G Uniform in an amount not to exceed $1,500 to be taken from Account 10-A-09C. c. Colors, Inc. #06-555 BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to authorize the purchase of uniform allowance items from Colors Inc. in an amount not to exceed $8,000 to be taken from Account 10-A-09C. ROAD DEPARTMENT: 2. Chaplain Chief Sabo gave the Board two names that had been submitted to him from a couple of firefighters that who know two pastors that would like to co-serve as the Plain Township Fire Chaplain. He will keep the Board informed as this progresses and see that they are introduced to these individuals. 1. Fences There was discussion about a fence on Demington out in the right-of-way that takes in a stop sign. Detailed discussion ensued. Mr. Leno said that if we took this fence down we would have to go through the township and take down a lot of other landscaping projects, mailboxes, etc. The Board made sure that Mrs. Bryant, the owner of the property was aware of the fact that if the Township does work in the right-of-way and needs to take the fence down or should the fence be knocked down by heavy snow being thrown from a plow, we would not be liable to fix it. The Board agreed not to do anything about the fence at this time but wanted to make sure that she understood that they are not liable for any damage to the fence.

Amend Resolution #06-532 (29 th St. Sidewalks) #06-556 Stark County, Ohio, to amend resolution #06-532 to read as follows: Plain Township Board of Trustees, Stark County, Ohio, to approve the sidewalk and curb repair for 29th Street NE on the north side between Gibbs and Beverly Avenue, and to authorize the Plain Township Fiscal Officer to certify 50% of this cost as a special assessment to the property owners to the Stark County Auditor, to be assessed over a period of 5 years, and to authorize Dickerson to perform these repairs per agreement; NOW, THEREFORE, BE IT FURTHER RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to authorize payment to Dickerson Construction Co. in the amount of $18,986.00 upon completion of the repairs per agreement, to be paid from Fund #03-C- 03. ZONING DEPARTMENT: 1. Certification & Payment of Nuisance Abatements a. 6011 Firestone Rd. International Soccer Agreement #06-565 Motion by Mr. Giavasis, Stark County, Ohio to enter into a contract with the International Soccer Club to utilize the outdoor facilities at the Diamond Street Recreation Center for a tournament on October 28 and 29, 2006

2600 Easton St. NE Page 9 of 12 PARKS & RECREATION: (continued) pursuant to the attached contract. Seconded by Mrs. Bossart. Discussion: It was passed, scratching out the amendment within that agreement. Mr. Alexander stated that our fee is very low and for only four dollars more this gentleman is getting the use of the entire complex. Mr. Giavasis also spoke on this issue and said that the wear and tear on our fields and the complex is not worth the fee that we are charging and we were not going to go along with amendments holding us to the same price next year. 2. Refund of Soccer Fees - resolution held for next meeting. 3. Re-Cap of Plain Family Event/ October Boo-Nanza Mr. Alexander said that there were several families present and it went over very well. There were arts and crafts along with other activities. Mrs. Bossart suggested that we have handouts available at the various functions in the future. Mr. Alexander had a table at the Plain Fun Day at the high school and didn t really have anything to hand out regarding our complex at Diamond. He said that he had taken some pictures and would have things ready for any future events. 4. Adult CPR class Mr. Alexander wanted to thank Chief Sabo and the Fire Department for the Adult CPR class. They had nine participants and it was very well received. 5. Payment to Joe Snyder #06-566 BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to authorize payment to Joe Snyder of $9.00 per hour for working at the International Soccer Tournament on October 28 and 29, 2006, in addition to the regular weekly amount paid to him by the Parks Department. LAW DIRECTOR: 6. Free Coaches Clinic Mr. Alexander said that he is hosting a free coaches clinic on October 25, 2006 from 6:00 PM 7:30 PM. This is for parents who help coach soccer, etc. Mrs. Bossart wanted to thank Mr. Alexander for the great job he is doing and that he is giving 150% to it and that she and the Board appreciate it. Mr. Williams introduced Mr. Cameron Traub to the Board and audience who is a scouting student and is interesting in local government. Mr. Traub received applause from those present. 1. False Alarms #06-567 Motion by Mr. Giavasis, WHEREAS, Resolution #95-96 established a false alarm policy in Plain Township, whereby residents and commercial establishments would be billed for false alarms in excess of three in any calendar year;

The billed amounts shall be as follows: (1) for the fourth false alarm $50.00; (2) for the fifth false alarm $100.00; (3) for all false alarms in any calendar year occurring after the fifth false alarm.$150.00; BE IT FURTHER RESOLVED, that the above described rates shall be effective January 1, 2007. Seconded by Mrs. Bossart. Discussion: Mr. Giavasis said that he believed that this new resolution would get people to see that their systems are corrected if they are malfunctioning. 2. Harmont East Annexation Area #06-568 Motion by Mr. Giavasis, WHEREAS, the City of Canton has filed an Annexation Petition entitled the Harmont East Annexation Area with the Board of Stark County Commissioners on or about October 12, 2006; and, pursuant to the Ohio Revised Code, wishes to object to this annexation; and WHEREAS, the City of Canton deemed this annexation an Expedited Type II Annexation ; and WHEREAS, pursuant to the Ohio Revised Code, Plain Township Board of Trustees wishes to formally and by resolution object to this proposed annexation; and NOW, THEREFORE BE IT RESOLVED that the Board of Trustees for Plain Township, Stark County, Ohio does hereby formally and pursuant to the Ohio Revised Code, object to the proposed Harmont East Annexation Area. This objection is based upon the following: (1) the City of Canton s petition does not meet all of the technical requirements required by the Ohio Revised Code, (2) the petition was not properly filed, (3) the petition does not contain the signatures of all of the property owners in the area proposed to be annexed, (4) the territory proposed to be annexed does not share a common boundary with the municipality for a continuous length of at least 5% of the perimeter of the territory proposed to be annexed, (5) the annexation will create an unincorporated area of the Township that is completely surrounded by the area proposed to be annexed, (6) the municipality has not agreed to provide the area proposed to be annexed a service as specified in a Municipal Services Statement, (7) a street or highway will be divided by the boundary between a municipality and the township, so as to create a road maintenance problem, and the municipality has not agreed as a condition for an annexation to assume road maintenance responsibility or to otherwise correct the problem. Stark County Sheriff Media Release an invitation from the Sheriff regarding an open house. The new facility will be open November 5, 2006 from 1:00 PM - 4:00 PM. 3. Paul & Shirley Keener a thank you for the installation of a culvert on Mt. Pleasant. 4. Nimishillen Creek Litter Clean-up a message from NEFCO regarding the Nimishillen Creek Litter Clean-up date change to October 28, 2006. 5. Stark County Board of Elections a letter pleading for pollworkers. 6. Save for Retirement Week from the Governors Office regarding a resolution that October 22 October 28 is Save for Retirement Week. 7. Ohio Secretary of State regarding the 2006 issue report for November General Election, which is posted in the hallway at the Township Hall. 8. Denise Evans a letter thanking the Township for having Todd A. Alexander added to the Parks and for all the programs that he has brought to the community. The Sheriff and Chief Perez were present. 1. Vandalism at Alpine Park took place on August 8, 2006. They overturned a porta-john and strewn it all over the park. 2. Speeding on Oakpark between Market & Fairwood - 3. Speeding and Running of Stop Sign on Beverly & East Green - No concerns of citizens; however, Pat Fallot, candidate for the Stark County Auditor, spoke to the Board and those present and passed out some literature about herself. She talked a little bit about her credentials for that position.
