Page 2 INTRODUCTION The Promotion of Access to Information Act of 2000 ( the Act ) came into effect in 2000. The purpose of this legislation is to address Section 32(2) of the Constitution, which provides for any person having the right to access any information held by a public or private body for the exercise or protection of a human right. One of the main requirements specified in the Act is the compilation of a manual that provides information on both the types and categories of records held by the public or private body. In terms of the Act, a private body includes any former or existing juristic person. This document serves as the Information Manual of the Hadeda body corporate in terms of the above-mentioned Act, to provide a reference as to the records held and the process that needs to be followed to request access to such records. OVERVIEW OF THE BODY CORPORATE Name and registration of the body corporate The name of the complex is Hadeda body corporate. It was established in terms of the Sectional Titles Act No. 95 of 1986 in 2008. The Body Corporate is identified by its unique SS (Sectional Scheme) number registered at its specific Deeds Office. In terms of this legislation, the executive authority of the body corporate rests with the board of trustees which is elected annually at the Annual General Meeting and which is presided over by the chairman. The board of trustees is answerable to the body corporate members who are all registered owners of units within the scheme/complex. The complex is administered in terms of the provisions of the above-mentioned Sectional Titles Act and its own registered management and conduct rules. Access to records of the body corporate (Section 51(1)(e)) 5.1 Records that are freely available Public records may be viewed upon request at the Registrar of Deeds, at the office of the Surveyor General and/or at COJ - Valuation Roll. Other information must be requested in terms of the procedures indicated under 5.3 below. 5.2 Records that are available upon request Records held by the body corporate include, but are not limited to, the following : - Owners names and contact details - Sectional plans and rules - Minutes of trustees and general meetings - Financial records - Operational records - Tax records - Human resource and employee records 5.3 Procedure to request information - The requester must use the prescribed form (Form C of Annexure B of Regulation 187 issued 15 February 2002). - Requests must be directed to the Information Officer(s) of the body corporate (see contact details above). - The requester must provide sufficient detail on the request form to enable the identification of the record or information required, as well as the identity of the requester. - The requester should indicate in what form access is required. - The requester must identify the right that is sought to be exercised or to be protected and provide an explanation as to why the requested record or information is required for the exercise or protection of that right. - A requester who seeks access to a record containing personal information about the requester, is not required to pay the request fee. Every other requester must pay the required fee. 5.4 Decision process - The Information Officer of the body corporate will notify the requester in writing of the decision on the request and the cost of processing the request. - After payment has been received, the request will be processed. - If a decision has been made to deny the request, the Information Officer will advise the requester in writing of his reasons for
Page 6 6. Other information denying the request. The requester can then further pursue his request in terms of the provisions of the Act. The Minister of Justice and Constitutional Development has not issued any regulations in this regard. 7. Website No public website is currently available for the body corporate. 8.
