Summary Conviction Offences & Indictable Offences It is the responsibility of the Crown Prosecutor to determine whether an offence is too serious to be charged as a Summary Conviction Offence. This deliberation is contingent upon factors such as whether or not bodily harm or aggravated assault occured during the commission of any of the following offences. If those elements are present, the Charge will be laid as an Indictable Offence. Although The Lever Paralegal Agency may defend clients charged with Summary Conviction Offences, The Lever Paralegal Agency is not able to represent clients who are charged with an Indictable Offence. Unlawfully causing bodily harm Section 269 See assault. Assaulting a peace officer Section 270 Threatening or causing bodily harm to a peace officer who is performing their duties, or resisting arrest. Disarming a peace officer Section 270.1 Taking or attempting to take a peace officer s weapon without permission. Removal of child from Canada Section 273.3 Doing anything toward the act of removing a child under the age of 16 years from the country. Forcible Confinement Section 279 (2) Imprisoning, confining, or forcibly seizing another person, without authority to do so. Abduction in contravention of custody order Section 282 A parent of a child aged 14 years or less taking, enticing away, concealing, detaining, or harbouring that child. Abduction Section 283 Kidnapping; to entice away, kidnap, forcibly seize. Theft or forgery of credit card Section 342 Taking or stealing another person's credit card, whether or not one attempts to use it. Theft under $5,000 Section 334 Conversion or taking of another s personal property. Making, having or dealing in instruments for forging or falsifying credit cards Section 342.01 Making, repairing, buying, selling, exporting, importing, or possessing an instrument for the forging or falsifying of credit cards. Unauthorized use of credit card data Section 342 (3) Fraudulently and without right using a credit card. Unauthorized use of a computer Section 342(1) By direct or indirect means, accessing a computer, or using, trafficing, or permitting such to happen. Possession of property obtained by crime Having anything one knows to have been obtained via illegal means or the proceeds (profits/means) from such. Making a false statement in relation to a passport Section 57 (2) Relying on a passport which one knows to be false. False pretence or false statement Section 361 Representing a statement as being fact when one knows it is not.

Fraud Section 380 Obtaining anything by false means. Personation with intent Section 403 Fraudulently holding oneself out to be someone else, living or dead, for the purpose of obtaining something.
