CHADRON, NEBRASKA April 28, 2015 DAWES COUNTY BOARD OF COMMISSIONERS The Public convened meeting of the Dawes County Commissioners in regular session was commenced at the hour of 8:33 A.M. on the 28 th day of April, 2015 and published pursuant to public notice as required by law. The meeting was called to order by Commissioner Stewart. Roll was called and the following Commissioners were present: Commissioners Stewart, Johnson and Rivera. Also present was Cheryl Feist, Dawes County Clerk; Adam Edmund, Deputy County Attorney and David Nixon, City of Crawford Mayor. Per LB 898 the Chairman announced the location of posted information concerning the Open Meetings Act. Copies of the Act are available upon request by anyone attending the meeting. Motion by Commissioner Johnson, seconded by Stewart, adding the Pledge of Allegiance and timely TERC correspondence to the Agenda. Roll call vote, Ayes: Johnson, Rivera and Stewart. Nays: None. Motion carried. Motion by Commissioner Johnson, seconded by Rivera, approving the April 14, 2015 minutes with the following correction to wit: the word separation instead of termination. Roll call vote, Ayes: Rivera, Stewart and Johnson. Nays: None. Motion carried. Claims were reviewed. Motion by Commissioner Johnson, seconded by Rivera, approving all claims as presented. Roll call vote, Ayes: Stewart, Johnson and Rivera. Nays: None. Motion carried. Chris Fankhauser, KCSR Radio, joined the meeting in progress. Public comment ensued with Crawford Mayor, David Nixon, informing the Board the City of Crawford is considering silent crossings at Annin Street and Mill Road railroad crossings. Commissioner Rivera asked about cost and responsibility thereof. Discussion ensued. No action was taken. Board reports were heard from the following Commissioner s to wit: Vic Rivera-the Travel Board recently heard advertizing presentations. Maly Marketing out of Lincoln, Nebraska was chosen to market Northwest Nebraska. Jake Stewart-Dawes County participated in the Big Event held on April 25, 2015 with over 700 participants. The Chadron State College Dining Services worked at the Courtyard cleaning up, locating flag holders, planting flowers and mulching trees. The Dawes County Board of Commissioners wishes to express their gratitude to the CSC Dining Services for all their hard work. It was also noted for the record that volunteers will be needed to hang flags and take them down for the Memorial Day holiday. Anyone interested in helping can contact Jake Stewart, Commissioner or Alan Connell, VSO. Kerri Rempp, The Chadron Record, joined the meeting in progress. Resolution No. 2015-08 transferring $3,000.00 from General Fund to the Veterans Aid Fund was introduced by Commissioner Rivera, seconded by Johnson. Roll was called, Ayes: Johnson, Rivera and Stewart. Nays: None. Motion carried. A surplus request from the Communications Department was reviewed by the Board. Motion by Commissioner Johnson, seconded by Rivera, approving the surplus request. Roll was called, Ayes: Rivera, Stewart and Johnson. Nays: None. Motion carried. In other business Lacy Troester, HR Director, met with the Board. She presented three (3) bids for lawn mowing/weed eating to wit: Rischling Lawn Service-$245.00 per time or as needed May-October; Herb Petersen-$75.00 per time and Downs Rural Service-$225.00 per time or as needed May-October. It was noted for the record that any sprinkler heads broke by individuals contracted to do the lawn mowing will be responsible for replacement. Commissioner Rivera, seconded by Johnson, moved to accept Herb Petersen s bid in the amount of $75.00 per time contingent upon insurance coverage. Roll was called, Ayes: Stewart, Johnson and Rivera. Nays: None. Motion carried. No action was taken on the personnel policy committee. Commissioner Johnson moved to enter executive session at 9:20 A.M. to discuss a building purchase. Commissioner Rivera seconded the motion. Roll was called, Ayes: Johnson, Rivera and Stewart. Nays: None. Motion carried. Commissioner Johnson moved to reconvene to regular session at 9:32 A.M. Commissioner Rivera seconded the motion. Roll was called, Ayes: Rivera, Stewart and Johnson. Nays: None. Motion carried. No action taken during executive session. Commissioner Johnson moved to direct the Chairman of the Board to proceed with negotiations relevant to a building purchase and report back at the May 12, 2015 Board Meeting. Commissioner Rivera seconded the motion. Roll was called, Ayes: Stewart, Johnson and Rivera. Nays: None. Motion carried. Commissioner Rivera moved to enter executive session at 9:37 A.M. to discuss a pending TERC case. Commissioner Johnson seconded the motion. Roll was called, Ayes: Johnson, Rivera and Stewart. Nays: None. Motion carried. Commissioner Johnson moved to reconvene to regular session at 9:54 A.M. Commissioner Rivera seconded the motion. Roll was called,

Ayes: Rivera, Stewart and Johnson. Nays: None. Motion carried. No action taken during executive session. Commissioner Johnson moved to direct counsel to settle a pending TERC case with Liberty Holdings using a Commercial Appraiser s figures. Roll was called, Ayes: Stewart, Johnson and Rivera. Nays: None. Motion carried. The Board recessed at 9:56 A.M. and reconvened to regular session at 10:03 A.M. At 10:04 A.M. Larry Hankin, Highway Superintendent and Larry McCaslin, Larry McCaslin Consulting, met with the Board. Discussion ensued regarding the Soester/Lemmon bridge projects on Bethel Road. It was agreed by all present the Soester bridge project will take precedence over the Lemmon bridge project. Both Hankin and McCaslin recommended the Board bid a 50 bridge at an approximate cost of $447,000.00. The bridge will endure a year storm. Box culverts were discussed, however; due to debris accumulation which restricts the opening this wasn t an option. A fly will also be necessary on the South side of Soester Bridge during the construction phase to address traffic flow issues. Commissioner Rivera asked about engineering costs. Larry McCaslin informed Commissioner Rivera the County would be looking at 20% for engineering costs which include design, permits, legal fees, etc. Commissioner Johnson moved to accept Larry McCaslin s recommendation for a 50 bridge replacement for the Soester Bridge located on Bethel Road and Albertson Engineering will design the specifications necessary for the project and bidding. Commissioner Rivera seconded the motion. Roll was called, Ayes: Johnson, Rivera and Stewart. Nays: None. Motion carried. Larry Hankin presented Resolution No. 2015-09 for the Boards consideration. Commissioner Rivera, seconded by Johnson, directed the Chairman to sign an agreement with the State of Nebraska, Department of Roads and BNSF Railroad for the installation of flashing light signals and gates at the Saw Log railroad crossing. Discussion ensued. The Federal Rail Safety will commit 90% of the funding necessary with BNSF Railroad committing the remaining 10% for a total cost of $270,143.00. Roll was called, Ayes: Rivera, Stewart and Johnson. Nays: None. Motion carried. Road updates included the following to wit: District 1-blading; Drivers are hauling gravel on West Dakota Road and milling is taking place on Slim Buttes Road so gravel can be hauled next week. District 2-blading; building road on East River Road and the 2000 Mack truck needs a remanufactured motor at a cost of $17,000.00. District 3-blading and Crusher-finished at Dillon pit. Contract crushing is still in progress and Janice German is working on last group of ranges re: road record update. Mr. Hankin also reported NIRMA will cover Blaine Yardley for bridge inspections. Mr. Hankin also reported the personnel policy and State Statutes don t dictate how many hours are paid out for Holiday pay. He suggested the Roads Department be allowed to work 4-10 hours shifts during those weeks a Holiday falls instead of the 5-8 hour days as approved by the Board at the April 14, 2015 Commissioner Meeting. Commissioner Stewart informed Mr. Hankin there are only five times a year this happens so it will remain at 5-8 hour days during those weeks a Holiday falls. He also expressed concern with timeframe of granting sick/vacation leave. The Board assured him they have no intention of changing policy on this in the Roads Department. In other business the Board reviewed and approved monthly fee/mileage reports of the various departments. At 10:45 A.M. The Board recognized seven (7) individuals for 15+ years of service to Dawes County. Certificates of appreciation were presented to Vance Haug, County Attorney; Stacey McCartney, Child Support Enforcement; Jeffrey Smith, Jailer; Sharon Harrison, Clerk of District Court; Jay Bruns, Roads Department; Jake Stewart, Commissioner and Cheryl Feist, Dawes County Clerk. There being no further business before the Board, the Chairman adjourned the meeting at 11:03 A.M. The next meeting of the Dawes County Commissioners will be May 12, 2015 beginning at 8:30 A.M. with a Board of Equalization meeting, followed by the Commissioner meeting at approximately 8:50 A.M. Both meetings will be held in the former County Courtroom at the Courthouse. A current agenda is available at the Clerk s Office during normal business hours but will close at 2:00 P.M. May 07, 2015.
