NOTICE OF SPECIAL ELECTION THE STATE OF TEXAS CITY OF ALLEN COUNTY OF COLLIN TO THE RESIDENT QUALIFIED ELECTORS OF THE CITY OF ALLEN, TEXAS TAKE NOTICE that an election will be held in the CITY OF ALLEN, TEXAS on the 9 th day of May, 2015, in accordance with a resolution adopted by the City Council which is a part of this notice for all purposes and reads substantially as follows: RESOLUTION NO. 3284-2-15(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY OF ALLEN, TEXAS, MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION. WHEREAS, by virtue of an election held in the City of Allen, Texas (the "City") on November 5, 2002, the City Council of the City became authorized to issue, sell and deliver general obligation bonds for the City in the aggregate principal amount $19,500,000 to construct and equip a performing arts center, including the purchase of land therefor; and, WHEREAS, the City has heretofore issued bonds in the principal amount of $2,815,000 for such purpose and there remains an unissued balance of bonds in the principal amount of $16,685,000; and, WHEREAS, such performing arts center was to be used and funded jointly by the City and neighboring communities (herein referred to as the Arts of Collin County Project) but has since been cancelled; and, WHEREAS, the City Council is authorized pursuant to Texas Government Code, Chapter 1252, as amended, and the City Charter to order an election to submit a proposition to the voters to determine whether to revoke the authority to issue the remaining $16,685,000 of bonds voted for such project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. An election shall be held on May 9, 2015, in the City of Allen, Texas, which date is not less than seventy-one (71) nor more than ninety (90) days from the date of the adoption hereof and is a uniform election date pursuant to Texas Election Code, Section 41.001, for the purpose of submitting the following measure: SHALL the authority of the City Council of the City of Allen, Texas, to issue the remaining $16,685,000 general obligation bonds voted to construct and equip a performing arts center, including the purchase of land, voted in Proposition Number 1 at the bond election held November 5, 2002, be revoked? SECTION 2. Pursuant to an agreement with the Collin County Elections Administrator, the election shall be conducted by the Collin County Elections Administrator in accordance with the provisions of an election services contract (the "Contract") to be executed with the Collin County Elections Administrator.
The polling places for this election shall be as shown in Exhibit A attached hereto and incorporated herein by reference as a part of this Resolution for all purposes. The election officers and maximum number of clerks for each polling place shall be determined and appointed in accordance with the Contract. On election day, the polls shall be open from 7:00 a.m. to 7:00 p.m. SECTION 3. Early voting for this election shall be conducted at the locations, dates and times as shown in Exhibit B, which is attached hereto and incorporated herein by reference as a part hereof for all purposes. Sharon Rowe, Collin County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy clerks at such early voting polling places in accordance with the Contract. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the Contract. The Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Collin County Elections Office, 2010 Redbud Boulevard, McKinney, Texas, and the Manager, Tabulation Supervisor, Presiding Judge and Alternate Presiding Judge at such Central Counting Station shall be determined, appointed and designated in accordance with the Contract. The Manager and Presiding Judge of such Central Counting Station may appoint clerks to serve at such Station, as provided by Texas Election Code, Section 127.006, as amended. SECTION 4. A voting system or systems meeting the standards and requirements of the Texas Election Code, as amended, is hereby adopted and approved for early voting by personal appearance and by mail and for election day voting. Ballots shall be prepared in accordance with Texas Election Code, and permit electors to vote "FOR" or "AGAINST" the aforesaid measure which shall appear on the ballot substantially as follows: "THE REVOCATION OF $16,685,000 OF GENERAL OBLIGATION BONDS TO CONSTRUCT AND EQUIP A PERFORMING ARTS CENTER" SECTION 5. All resident qualified electors of the City shall be permitted to vote at said election. This election shall be held and conducted in accordance with the provisions of Texas Election Code and Texas Government Code, Chapter 1251, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 6. A substantial copy of this resolution shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted at three (3) public places within the City and at the City Hall not less than twenty-one (21) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in a newspaper of general circulation in said City, the first of said publications to appear in said newspaper not more than thirty (30) days and not less than fourteen (14) full days prior to the day of the election. SECTION 7. This Resolution shall incorporate the provisions of the Contract, and to the extent of any conflict between this Resolution and the Contract, the provisions of the Contract shall control. The Mayor, City Manager, City Secretary or other appropriate official, is hereby authorized to correct, modify or change the exhibits to this Ordinance based upon the final locations and times agreed upon by the Collin County Elections Administrator and the City as well as incorporate additional voting locations as designated by the Collin County Elections Administrator.
