CLOSED SESSION At 9:45 a.m., Commission President Jonathan Weiss called the Closed Session of the Board of Civil Service Commissioners to order pursuant to Government Code Section 54956.9(b)(1) to confer with legal counsel regarding options as to legal precedent and best practices in making a rule change retro-active. Of issue is the question to include any appeal pending as of the time of the adoption of new Civil Service Rules extending Board jurisdiction over disciplinary appeals filed by Appellants who subsequently retire through one of the City s retirement systems as related to item 9 on the public agenda. No binding votes were taken during closed session. Closed session was adjourned at 10:21 a.m. 2. OPEN SESSION The open session meeting of the Board was called to order by Commission President Jonathan Weiss at 10:23 a.m. 3. PRESENTATION Employee of the Quarter Commission President Jonathan Weiss and General Manager Wendy Macy presented the Personnel Department Employee of the Quarter Award for the Fourth Quarter of 2017 to Rommel Rufon of the Department s IT/Technology Section.

ADMINISTRATIVE BUSINESS 4. PRESENTATION Recognition of Service of Former Commissioner Suzanne Steinke The Board of Civil Service Commissioners and Personnel Department General Manager Wendy Macy presented a plaque of recognition to former Civil Service Commissioner Suzanne Steinke in recognition of her outstanding service to the People of Los Angeles as a member and President of the Board of Civil Service Commissioners 2013-2017. 5. APPROVAL OF MINUTES a) The Board unanimously approved the minutes of the telephonic meeting of Thursday, October 12, 2017 on a motion by Commissioner Esparza, seconded by Commissioner Fugate. b) Approval of the minutes of the regular meeting of Thursday, October 26, 2017 was continued to the next meeting on a motion by Commissioner McClelland, seconded by Commissioner Esparza. Motion approved unanimously. 6. COMMISSION ACTION ON ROUTINE AND OTHER MATTERS The Board unanimously approved the routine and non-appearance matters noted under Unfinished Business, page 7, items 12 and 13, and New Business, pages 8 through 17, items 14 and 15 as amended, on a motion by Commissioner McClelland, seconded by Commissioner Esparza. 7. GENERAL MANAGER S REPORT The General Manager reported that Live Well, the City s Wellness Program, sponsored Health Trails, a walking challenge between September 18 and October 29. All City Departments participated with 351 teams of four and five walkers each totaling 2,251 individual walkers. The Personnel Department fielded 206 walkers, more than 44% of the Department and boasted the top two walking teams. The event seems to have fostered some behavioral changes in the daily actions within the Personnel Building; more people are taking the stairs, walking about more rather than telephoning or emailing, more energy in the air. We have plans to replicate the success in the future. 8. PUBLIC COMMENTS ON MATTERS WITHIN BOARD S JURISDICTION There were no requests for general public comment. minutes 2

APPEARANCE ITEM - UNFINISHED BUSINESS 9. ADMINISTRATIVE CLOSURE - APPEAL UNDER CHARTER SECTION 1016 TO BE MADE A MATTER OF RECORD Gil PETERSON, Librarian II, Library Department, Discharge effective July 9, 2016. DISCUSSION On July 9, 2016, Gil Peterson was personally served with a General Form 77 by representatives of the Library Department detailing the Department action of imposing the penalty of discharge for Violation of Department rules; Requiring excessive supervision or instruction in performance of duties after completion of training for the position; Failure to perform work assignments adequately or promptly; and Making inappropriate statements to the public, supervisors or co-workers. An Appeal was filed on July 12, 2016 in the office of the Civil Service Commission. Following the regular course of events, a hearing examiner was selected and a hearing date set. On December 7, 2016, a representative from the Los Angeles City Employees Retirement System (LACERS) confirmed that the Appellant had filed for and been granted Deferred Vested Member status effective October 15, 2016. The California Court of Appeals, Second Appellate District, in Zuniga v. Los Angeles County Civil Service Commission, et al., 137 Cal.App.4 th 1255, 1259 (2006) stated as follows: A civil service commission created by charter has only the special and limited jurisdiction expressly authorized by the charter... (Zuniga, supra, citing Hunter v. Los Angeles County Civil Service Com. (2002) 102 Cal.App.4 th 191, 194 [124 Cal.Rptr.2d 924].) As the Appellant is no longer a City employee, but a retiree, the Civil Service Commission no longer has jurisdiction to act on his Appeal from Discharge. RECOMMENDATION: Adopt staff recommendation that, at the time of filing, the Board no longer held jurisdiction over the Appeal from Discharge of Gil PETERSON and that the Appeal be Administratively Closed and made a Matter of Record. File No. 54446 COMMISSION ACTION: Continued from January 9, 2017, February 9, 2017, April 27, 2017, June 22, 2017, July 27, 2017 and October 26, 2017. Discussion on. The Commission President reported that the Board, meeting in closed session with its counsel, came to the consensus that the new Civil Service Rule 12.18 was a prospective rule and would not be retroactively extended to previous cases closed by the Board. He continued that it was the legislative intent of the majority of the Board to extend the rule as revised to any pending appeal before the Board at the time of the adoption of the rule change. Representatives of the Library Department and the Appellant restated their position on the issue. Commission Action: In a motion by Commissioner Fugate, seconded by Commissioner Perez, the Board voted unanimously to NOT adopt the recommendation of Staff to administratively close the Appeal from Discharge of Gil Peterson, and to permit the appeal to proceed in the usual fashion. minutes 4 APPEARANCE ITEM - UNFINISHED BUSINESS 10. APPEALS UNDER CHARTER SECTION 1016 a. Stanley DESIR, Management Analyst I, Department of Aging. Suspension effective June 13, 2017 to June 26, 2017, inclusive (10-working days). Report and recommendations of the Board s Hearing Examiner Stephen Biersmith following the conduct of a hearing held on August 29, 2017 into the subject appeal of Mr. Desir. The Hearing Examiner recommends that the Board: A. FIND that the Skelly due process requirements were met. 1) SUSTAIN the cause of action of requiring excessive supervision or instruction in the performance of duties; 2) SUSTAIN the cause of action of failure to perform work assignments adequately or promptly. B. FIND that the Suspension effective June 13, 2017 to June 26, 2017, inclusive (10-working days), was appropriate and is SUSTAINED. C. MAKE A DETERMINATION to adopt the findings and conclusions in the Hearing Examiner s report as its own; File No. 54756 COMMISSION ACTION: Discussion: The Department expressed its support for the findings and recommendations within the Hearing Examiner s report and asked the Board to adopt it. Various Commissioners asked the Department about the internal changes within the Department of Aging raising standards Department wide which brought about improvements in individual job performance allowing the Department to pass recent State and Federal audits for the first time in many years assuring its continued grant funding. It was noted that the Appellant is still functioning under the supervision of Ms. Reyes and that together they have been striving to improve the Appellant s work product and performance. The Appellant noted his nearly 20-years of successful City service, that he found it difficult to work within the management style of Ms. Reyes, he was and continues to do his very best. Commission Action: In a series of motions offered by Commissioner McClelland, seconded by Commissioner Fugate, the Board voted unanimously to: FIND that the Skelly due process requirements were met. SUSTAIN the cause of action of requiring excessive supervision or instruction in the performance of duties; SUSTAIN the cause of action of failure to perform work assignments adequately or promptly. FIND that the Suspension effective June 13, 2017 to June 26, 2017, inclusive (10-working days), was appropriate and is SUSTAINED. Suspension effective October 28, 2016 to November 18, 2016, inclusive (15-working days) to be served as agreed. Report and recommendations of the Board s Hearing Examiner Pamela Sellers, following the conduct of a hearing held on August 24, 2017 into the subject appeal of Ms. Goodwin. The Hearing Examiner recommends that the Board: A. FIND that the Skelly due process requirements were met. 1) SUSTAIN the cause of action that on or about September 30, 2015, the employee, while on-duty, failed to complete a thorough interview with a citizen who had called for service. B. FIND that the Suspension effective October 28, 2016 to November 18, 2016, inclusive (15-working days) to be served as agreed, was appropriate and is SUSTAINED. C. MAKE A DETERMINATION to adopt the findings and conclusions in the Hearing Examiner s report as its own; File No. 54549 COMMISSION ACTION: Discussion: The Commission Executive reported to the Board that the Appellant s union representative has informed the Commission Office that neither the Appellant nor the union would be attending the Board meeting and would not oppose the Board adopting the Hearing Examiner s report. The Department representative reviewed the incident that resulted in the employee discipline. Because of the Appellant failing to follow up and ask the required questions when a citizen called in for police service, the citizen was forced to wait more than an hour for assistance while an aggressive homeless person blocked access to her apartment. Commissioner Perez expressed concern that the penalty of seven-working days, recommended by the division command, was disregarded by Department command and a 15-working day suspension was imposed. The Department pointed out that this was the Appellant s third offense, the second in three months, she had just returned from a five-day suspension when this incident occurred. Progressive discipline is supposed to be corrective; the five-day suspension did not have the desired effect on the employee. Department command felt that adding only three days would not be effective either so opted for the more serious penalty of 15-working days. The discipline guidelines for a third offense runs to discharge, so 15-working days is considerably less than the penalty within the Department s discretion. minutes 5

Commission Action: In a series of motions by Commissioner Fugate, seconded by Commissioner McClelland, the Board voted unanimously to: FIND that the Skelly due process requirements were met. SUSTAIN the cause of action that on or about September 30, 2015, the employee, while on-duty, failed to complete a thorough interview with a citizen who had called for service. In two additional motions by Commissioner Fugate, seconded by Commissioner McClelland, the Board voted three yea votes to one nay vote cast by Commissioner Perez to: FIND that the Suspension effective October 28, 2016 to November 18, 2016, inclusive (15-working days) to be served as agreed, was appropriate and is SUSTAINED. APPEARANCE ITEM - UNFINISHED BUSINESS 11. APPEAL FROM CLOSURE OF COMPLAINT FILED WITH THE OFFICE OF DISCRIMINATION COMPLAINT RESOLUTION. The General Manager recommends that the Board adopt the findings of the Office of Discrimination Complaint Resolution (ODCR) staff to close the complaint filed by Jeanne WILLIAMS citing that it found insufficient evidence to support her allegations of sexual harassment, racial discrimination and retaliation resulting in her discharge by the Los Angeles Police Department. File No. 54806 COMMISSION ACTION: Continued from September 14, 2017. Discussion: At the September 14, 2017 Board meeting when the Commission first took up the Appeal from Closure of the ODCR complaint, the Complainant expressed her opinion that the ODCR staff did not do a proper investigation, that the State EEO had seen the same materials and granted her the right to file legal action. Commissioner Esparza attempted to explain that it was not the function of ODCR to assess blame, but rather to seek ways and means to resolve conflicts and, where discrimination or questionable actions have occurred, to work with the City Department and employee to resolve the conflict and correct future actions. He asked the Complainant what it was she wanted the Board to do. Before the Complainant could reply, the Board s Counsel interjected that two days prior to the Board meeting, a Superior Court judge ruled against the Complainant s Writ of Mandamus to recover her position with the City. That tentative decision would become final in the near future, and while the decision will be taken to the Court of Appeals, the judge s ruling would be beneficial to the Board. The matter was continued to a future agenda to allow the Board time to review related court actions. Discussion on : The Manager of the Office of Discrimination Complaint Resolution outlined the history of the Complainant s case. She detailed the process by which all parties listed by the Complainant in her filing and subsequent submissions were interviewed at least once. None supported the information filed by the Complainant. Commissioner Weiss detailed the history of litigation in this matter: The employee was discharged from her position at the LAPD on November 6, 2014. Commission sustained the action August 11, 2016. Appellant filed a writ of mandate in Superior Court; ruling to deny issued in September, 2017 with her claim for damages under 42 USC section 1983 referred to another court. A heated discussion followed after which the Board took its vote. Commission Action: In a motion by Commissioner McClelland, seconded by Commissioner Esparza, the Board voted unanimously to adopt the General Manager s recommendation to close the ODCR complaint filed by Jeanne WILLIAMS citing that proper investigation found insufficient evidence to support her allegations of sexual harassment, racial discrimination and retaliation resulting in her discharge by the Los Angeles Police Department. RESIGNATIONS, SETTLEMENTS AND WITHDRAWALS UNDER CHARTER SECTION 1016 TO BE MADE A MATTER OF RECORD Federico CERPA, Mechanical Helper, Department of Airports. Suspension effective April 4, 2017 to April 14, 2017, inclusive, (seven-working days). Settlement agreement whereby the Department agreed to rescind the penalty of a seven-working day suspension; The Appellant will be placed on disciplinary pay status for the period covered by the original suspension; The Appellant agreed to abide by all of the provisions of the Disciplinary Pay Status Agreement; The Appellant agreed to withdraw his appeal from Suspension now pending before the Civil Service Commission; The parties agreed to other terms and conditions.
