These Official Rules govern the Cub Cadet Product Review Sweepstakes (the "Sweepstakes"). HOW TO ENTER: During the Sweepstakes Period, 1. Visit www.cubcadet.com 2. Complete all required information on the review form provided; 3. Acknowledge that you agree to these Official Rules; 4. Click on Submit. Limit: You may enter one (1) time during the Sweepstakes Period. Once a valid entry is made, IT WILL BE CARRIED FORWARD to all remaining drawings (if any remain). There is no cost to register and product purchase is not necessary to enter or win. Sponsor will not advise an Entrant of an incomplete or otherwise non-compliant entry. Entries made by any individual or any entity other than Entrant, including but not limited to commercial sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Sweepstakes. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. Winners are responsible for any and all applicable fees, federal, state and local taxes, if any, and any other unspecified expenses associated with acceptance or use of Prize. Winner is advised to seek independent counsel regarding the tax implications of accepting a Prize. Acceptance of any prize constitutes winner's permission for the Sponsor to use the winner's name, photograph, image, likeness, voice, biographical information, statements and complete address (collectively, the "Attributes"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization, (except where prohibited by law), and releases the Released Parties from all claims arising out of the use of such Attributes. GENERAL PRIZE RESTRICTIONS/CONDITIONS: Prize is non-transferable. Monthly prizes may not be redeemed for cash. Sponsor reserves the right to substitute a prize (or portion thereof) of equal or greater value if the advertised prize (or portion thereof) becomes unavailable. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor's control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein including without limitation, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, insufficient number of eligible participants or technical failure. These Official Rules cannot be modified or amended in any way, except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that or any other term or provision. LIMITATION OF LIABILITY: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or random selection of entries, the announcement of the prizes or in any Sweepstakes-related materials; (5) late, lost, undeliverable, damaged or stolen mail; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in this Sweepstakes or receipt or use or misuse of any prize; (7) costs associated with claiming or redeeming the prizes; nor (8) loss or damages resulting from an Entrant's connection to the internet via any of the websites contained herein. Released Parties are not responsible for any incorrect, mistranscribed, misdirected or
undeliverable entries, E-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user's Internet service provider and/or E-mail client or for insufficient space in user's E-mail account to receive E-mail. Sponsor shall not be responsible for any occurrences resulting from the entrant's connection to the internet via Sponsor's Facebook page. Sponsor does not accept responsibility for any damage (whether material or non-material) caused to Entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Released Parties are not responsible for any unauthorized third party use of any entries. DISPUTES: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State of Ohio, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio. PRIVACY: Personal information provided by Entrant at the time of entry into the Sweepstakes may be used by Sponsor and designated third parties engaged by Sponsor in connection with the administration of the Sweepstakes, in the fulfillment and verification of prize awards, and as otherwise authorized under Sponsor's privacy policy available at www.cubcadet.com.
