RECOMMENDATION The Independent Review Board ("IRB") refers the below report to the Executive Board of Local 918 for the purpose of initiating charges against Local 918 member Antonio Manfredi for refusing to cooperate with the IRB by failing to appear for a sworn examination scheduled for June 11, 1997. By failing to appear for his sworn examination, it appears that while an IBT member Antonio Manfredi violated Article II, Section 2(a) and Article XIX, Section 7(b) (1) and (2) and Section 14 (i) of the IBT Constitution by obstructing, interfering and unreasonably failing to cooperate with the duties of the IRB as set forth in Paragraph G of the March 14, 1989 Consent Decree in United States v. International Brotherhood of Teamsters, 88 Civ. 4486 (S.D.N.Y.). II. INVESTIGATIVE FINDINGS Antonio Manfredi ("Manfredi"), date of birth July 30 1966, is currently a member of the IBT and Local 918. (Ex. 1) Local 918 is located in Brooklyn, New York. Local 918 records reflected that Manfredi became a Local member in May 1993 and his dues were paid through May 1997. (Ex. 2) By letter dated June 23, 1997, Daniel Lombardozzi, President of Local 918, advised

that Antonio Manfredi is an active member of the Local. (Ex. 3) According to Local 918 records, Antonio Manfredi is an IBT member employed at Safe Auto Sales. ("Safe") (Ex. 1 ) According to public records, Corrado Manfredi is the President of Safe Auto Sales. (Ex. 4) It appears that Local 918 member Corrado Manfredi signed the collective bargaining agreement between Local 918 and Safe Auto Sales. (Ex. 5) This collective bargaining agreement was dated January 20, 1995, and expires January 19, 1998. (Ex. 5) This collective bargaining agreement included all employees in the bargaining unit "excluding office, clerical, supervisory, foremen, guards and watchmen." (Ex. 5, Section 1)* On May 28, 1997, a notice of sworn examination was sent to Manfredi by overnight mail to his address as listed on the May 8, 1997, Local 918 membership list. This notice informed Manfredi that his sworn examination was scheduled for June 11, 1997. (Ex. 7) A postal receipt was returned to the Chief Investigator's Office indicating that delivery was made to Manfredi on June 2, 1997. (Ex. 8) At this examination, the Chief Investigator planned to question Manfredi about his Local ' It appears that on January 20, 1995, the same date the collective bargaining agreement was entered into, Local 918 and Safe Auto Sales entered into an amendment to the collective bargaining agreement which included "office, clerical" in the bargaining unit. (Ex. 6) However, the amendment provided that the classification of employees listed in the amendment would only be covered under certain sections of the collective bargaining agreement. (Ex. 6) For example, the "office, clerical" employees would not be covered under the collective bargaining agreement for wages, holidays and vacations. (Exs. 5 and 6)

918 membership, his employment at Safe, and whether Manfredi had contact with any organized crime figures. After the sworn examination notice was sent to Manfredi, Michael Romeo, Esq. ("Romeo") called the Chief Investigator's Office and advised that Manfredi was not a member of the Teamsters. (Ex. 9) Romeo was advised that Local 918 records showed Manfredi to be a member of Local 918. (Ex. 9) Romeo then stated that he would look into whether Manfredi was a Local member. (Ex. 9) Although Romeo was asked to contact the Chief Investigator's Office regarding whether Manfredi was a Local member, he did not do so. (Ex. 9) On June 11, 1997, without explanation, Antonio Manfredi failed to appear for his sworn examination. (Ex. 10) On June 17, 1997, the Chief Investigator's Office contacted Romeo regarding Manfredi's failure to appear for his sworn examination. Romeo stated that Manfredi was a Local 918 member but he did not represent Manfredi in connection with this matter. (Ex. 9) The Chief Investigator's Office attempted to contact Antonio Manfredi at Safe Auto Sales, but did not receive a return telephone call from him. (Ex. 11) Accordingly, it appears that Manfredi failed to cooperate with the IRB when he failed to appear for his June 11, 1997, sworn examination. III. PROPOSED CHARGES Based upon the foregoing, it is recommended that

Antonio Manfredi be charged as follows: While a member of Local 918 and the IBT, you brought reproach upon the IBT in violation of Article II, Section 2 (a) and Article XIX, Section 7 (b) (1) and (2) and Section 14 (i) of the IBT Constitution and obstructed, interfered and unreasonably failed to cooperate with the duties of the Independent Review Board as set forth in paragraph G of the March 14, 1989 Consent Decree in United States v. International Brotherhood of Teamsters. 88 Civ. 4486 (S.D.N.Y.) to wit: On June 11, 1997, you willfully and without justification refused to appear for your sworn in-person examination pursuant to Paragraph H.3 (c) of the Rules and Procedures for Operation of the Independent Review Board for the International Brotherhood of Teamsters.

The executive Board conducted the hearing and determined the to) lowing: 1. You willfully and without justification, refused to appear for you swom-in person examination pursuant to paragraph H.3( c ) of the Rules and Procedures for Operation of the independent Review Board (BRB) for the Intemationai Brotherhood of Teamsters (IBT) on June.! 1,1997. 2. On July 24, 1997, you wihfuily and without justification refused to appear at a hearing conducted by the Teamsters Local 91S Executive Board for violation of Article II, Section 2 (a) and Article XIX, Section 7(b)(1) and (2) and Section 14(1) cf the IBT Constitution and obstructed, interfered and unreasonably failed to cooperate with the duties of the Independent Review Board as set forth = in paragraph C of the March 14, 1989 Consent Decree in United States v. International Brotherhood of Teamsters 8S.CIV.4486 (S.D.N.Y.). Based upon the above, the Board has made the following detetmmation: 1. ' Nicholas Man&edi is expelled &om Teazasters Loc^I 91S and is permanently barred &om becoming a member of Teamsters Local 91 or any Local of the IBT. 2. Nicholas Manfredi is permanently barred front accepting or seeking employment, including 'consulting work, with the Teamsters Local 918, the IBT or any IBT affiliated entity effective immediately. 3. Nicholas Manfredi may not receive any benefits, gratuities, severance payments or gift of any kind whatsoever from Local 91S or IBT entities, except that he ypay receive his iu!!y vested pension benefits. 4.
