A REGULAR SCHEDULED CAUCUS MEETING of the Mayor and Council of the Borough of Carlstadt was held in the Caucus Room of the Borough Hall, 500 Madison Street, Carlstadt, New Jersey on Thursday, at 7:05 P.M. Mayor Craig Lahullier asked Claire Foy, Borough Clerk to call the roll: Mayor Craig Lahullier, Councilmen James Lenoy, Joseph Emerson and William Shockley were present. Councilman David Stoltz arrived at 7:20 P.M. and Councilman Richard Bartlett arrived at 7:30 P.M. Councilman Robert Zimmermann was absent. Mayor Lahullier led all present in the Pledge of Allegiance to the Flag. Mayor Lahullier This meeting has been called pursuant to the Open Public Meetings Law and in accordance with Section 5 of the Open Public Meetings Act, adequate notice of this meeting having been provided in the annual notice schedule which contained the time, date and location of the meeting, copies of which were sent and advertised in the following official newspapers of Carlstadt: The Record on January 6, 2016 and the Herald News on January 6, 2016 a copy of which is on the Bulletin Board in the Borough Hall and a copy on file in the office of the Borough Clerk. Gregory Polyniak of Neglia Engineering read his report for the month regarding projects that are being done in the Borough of Carlstadt. Robert Ceberio of RCM Ceberio, LLC read his Carlstadt Economic Development Report for October 2016 regarding Scientific Chemical, Arsynco, Redevelopment properties, Topgolf, Prodigy Training, Indoor Go-Cart and Roller Rink, Data Center Recycler and Wetlands Mitigation. A resident wanted to know about the work being done on Broad Street near Route 17 for the water drainage problem. Mayor Lahullier replied the check valve will allow the water to run east. He went into detail regarding the problem at that location. Our engineer, Neglia assures us that this will solve the problem. As long as the check valve works properly, this should work. EXECUTIVE SESSION MEETING ACT RECESS INTO CLOSED SESSION WHEREAS, it is necessary for the Governing Body of the Borough of Carlstadt to conduct an executive session closed to the public in order to discuss one or more of the following subjects: personnel and potential litigation. NOW, THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough of Carlstadt hereby moves to go into executive session in accordance with the provisions of the Open Public Meetings Act, N.J.S.A. 10:4-6 et. Seq. for the purpose of discussing one or more of the following subjects: personnel and potential litigation.
Page 2 AND, BE IT FURTHER RESOLVED that the public will be informed either later this evening after reconvening the public meeting or at a future public meeting said date is not predictable at the present time. AND, BE IT FURTHER RESOLVED that the matters discussed in and minutes of the closed session shall be disclosed to the public when the reason for confidentiality no longer exists. On motion by Stoltz, seconded by Bartlett, unanimous on call of roll of those present, the meeting went into closed session at 7:40 P.M. The meeting went back into open session at 9:05 P.M. with the following members in attendance: Mayor Lahullier, Councilmen Stoltz, Bartlett, Lenoy, Emerson and Shockley. CONSENT AGENDA RESOLUTION NO. 2016-354 WHEREAS, the Borough of Carlstadt has adopted a Property Maintenance Ordinance to provide the property owners of the Borough of Carlstadt the best value for their tax dollars and to provide a minimum standard of maintaining their property; and WHEREAS, the Carlstadt Zoning Department is charged with the responsibility to regulate and inspect properties as per the Property Maintenance Ordinance, and, as per N.J.S.A.40:64-8, N.J.S.A. 40:48-2.14, N.J.S.A. 40:48-2.27; and WHEREAS, inspections were made at the following properties for sanitation violations and overgrowth of weeds and grass, etc. and that the property owners were notified to correct the violations and did not respond in the prescribed time frame; and WHEREAS, the Zoning Department contracted with a vendor to correct said violations. NOW, THEREFORE BE IT RESOLVED by the Governing Body of the Borough of Carlstadt that all charges paid by the Borough of Carlstadt to clean up including snow removal/remediation, landscaping, planting or removing trees the following charge shall be passed onto the property owners as a Municipal Charge and added to their property tax accounts. RESOLUTION NO. 2016-357 CAUCUS MEETING Page 3 AWARD OF CONTRACT BE IT RESOLVED by the Mayor and Council of the Borough of Carlstadt, Bergen County, New Jersey upon the recommendation of Neglia Engineering Associates that the Contract for: CARLSTADT GENERATOR IMPROVEMENTS PROJECT (FEMA HAZARD MITIGATION GRANT PROGRAM FUNDED) be awarded to Industrial Electric Service & Engineering Corp., 131 South Newman Street, Hackensack, New Jersey 07601 for the bid amount of Ninety-Six Thousand Three Hundred Dollars and Zero Cents ($96,300.00) (which represents the Base Bid and Alternate Bid) being the lowest of five bids submitted. This Resolution to take effect upon certification of this Resolution by the Borough Treasurer that sufficient funds are available. RESOLUTION NO. 2016-358 RESOLUTION: Approval to submit a grant application and execute a grant contract with the New Jersey Department of Transportation for the Fifth Street Roadway Improvements project. NOW, THEREFORE BE IT RESOLVED that the Council of the Borough of Carlstadt formally approves the grant application for the above stated project; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as LAIF-2017-Fifth Street Roadway Improvements-00013 to the New Jersey Department of Transportation on behalf of the Borough of Carlstadt; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Carlstadt and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement. CONSIDERATION OF ORDINANCES FINAL READING ORDINANCE NO. 16-22 AN ORDINANCE TO AMEND CHAPTER II ADMINISTRATION, SECTION 2-22 ENTITLED POLICE DEPARTMENT, SUBSECTION 2-22.5 ENTITLED QUALIFICATIONS OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OR CARLSTADT, 2002 Mayor Lahullier entertained a motion to open this ordinance to a hearing of citizens. On motion by Lenoy, seconded by Emerson, unanimous on call of roll of those present. Mayor Lahullier asked if any citizen wished to be heard on this ordinance. Mayor Lahullier said to let the record note there are no citizens to speak on this ordinance. Mayor Lahullier entertained a motion to close this ordinance to a hearing of citizens. RESOLUTION NO. 2016-360 CAUCUS MEETING Page 5 BE IT RESOLVED that the ordinance entitled: AN ORDINANCE TO AMEND CHAPTER II ADMINISTRATION, SECTION 2-22 ENTITLED POLICE DEPARTMENT, SUBSECTION 2-22.5 ENTITLED QUALIFICATIONS OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF CARLSTADT, 2002 heretofore introduced, does now pass on final reading and the Borough Clerk is hereby authorized and directed to publish said ordinance according to law. On motion by Bartlett, seconded by Stoltz, unanimous on call of roll of those present. CORRESPONDENCE Mayor Lahullier said we received correspondence from the Carlstadt PTA. The 8 th Grade Graduation Dance is planned for May 25, 2017 and they are asking for our donation which we have done in the past of $600.00 for the DJ for this event. On motion by Stoltz, seconded by Emerson, unanimous on call of roll of those present. Mayor Lahullier mentioned we received correspondence from Sara J. Sundell, the Director of Land Use Management, Chief Engineer, for the NJSEA. This is for MGK Properties/Stiletto s site improvement. The application is for proposed minor site improvement to provide additional parking. The letter states if we have any objections or comments to contact the office within ten days. If we want to make a comment, we can say we believe this is expanding on a non-conforming use. Mayor Lahullier said we received correspondence from the Department of Community Affairs, Commissioner Charles Richman informing us that our municipality s recent application to them has been accepted. Our town will benefit from a grant award in the amount of $12,387.00 to reimburse us for the 10% cost share of our eligible FEMA Pubic Assistance Program projects. Mayor Lahullier read the correspondence from Dave Malinowski who is asking permission to hold a Toy Drive for the Tomorrows Children s Fund in Hackensack NJ. He would like to start collecting new, unwrapped toys on November 14, 2016 through December 9, 2016. The toys can be brought to the Borough Hall and he will collect and deliver them to Hackensack Hospital the week of December 12, 2016. On motion by Bartlett, seconded by Shockley, unanimous on call of roll of those present. Mayor Lahullier said we have to table Ordinance No. 16-20 to November 10, 2016. Page 6 COUNCILMAN RICHARD BARTLETT COUNCILMAN WILLIAM SHOCKLEY He mentioned that Trunk or Treat was a great success. He thanked the support from the Police, Fire Department, EMS and DPW. We had over two hundred and fifty children. The Soccer Tournament is November 19 and 20, 2016. All teams play two games of twenty-five minutes which are shortened games. The girls games are Sunday, November 19 and the boys games are November 20, 2016. They will be at Lindbergh Field. We are going to have food trucks at the games and see how that goes. The games will start at 9:00 A.M. and go to 4:00 or 5:00 P.M. COUNCILMAN JAMES LENOY COUNCILMAN JOSEPH EMERSON COUNCILMAN DAVID STOLTZ Mayor Lahullier had something he would like to bring up even though Joseph Crifasi was not there. Recreation may play a part also. We have to start using the Village Green Park. If we don t start planning now, we will end up not using the park. We could get some dates for the band shell and see if we can get something going over there and we may want to do an open air market. First thing to do is see when the band shell is available from the County and then work around that. Once you know you have the band shell, then you have to find someone that wants to use the band shell. Mayor Lahullier entertained a motion to adjourn the meeting at 9:25 P.M.
