#h Embassy of the Republic of the Phitippines " trfl Pasuguan ng Republika ng Pilipinas ^ Islamabado Pakistan W, Mga Paglilinaw ng Embahada Tungkol Sa NOC Sa gitna ng mainit na talakayan ng ilan nating mga kababayan sa Pakistan patungkol sa NOC, ang Embahada ay malugod na nagbibigay ng mga sumusunod na paglilinaw para sa kapakanan ng ating mga kababayan sa loob at labas ng Pakistan: Ano ang NOC? Ang No Objection Certificate (NOC) ay isang papeles na ini-isyu ng Embahada na nagsasabing ito ay hindi tumututol sa pag-hire ng isang Filipino sa Pakistan. Ano ang mga tungkulin ng Embahada sa pag-isyu ng NOC? Bago mag-isyu ng NOC, sinusuri ng Embahada ang kontrata sa pagitan ng empleyado at amo o employer at iba pang mga kaakibat na dokumento upang masiguro na ang mga ito ay naaayon sa batas ng Pilipinas kalakip ang mga regulasyon na ipinapatupad ng Philippine overseas Employment Administration (POEA). Ang tungkulin na ito ay kahalintulad sa verification na ginagawa ng Philippine overseas Labor office (PoLO) sa ibang mga Embahada na meron nito. Q3: Bakit walang NOC requirement sa ibang bansa? Ang NOC ay hinihingi o requirement ng Ministry of lnterior (MOl) ng bansang Pakistan bago sila makapag-isyu ng working visa. Q4: Bakit kailangang magkaroon ng agency bago ma-isyuhan ng NOC? Ayon sa Section 123 ng"revised Rules and Regulations on the Recruitment of OFWs" (2016 poea Rules) na ipinatupad simula noong 28 April 2016, ipinagbabawal ang "direct hiring" ng ofw. Upang makapag-hire ng ofw, kailangan ng employer na makipag-ugnayan sa mga lisensyado o accredited agencies ng POEA kung hindi sila sakop ng mga exemptions sa direct hiring. Q5: May mga exemption ba sa "ban on direct hiring?" Ayon sa Section 124 ng 2016 POEA Rules, may mga employer na exempted sa ban on direct hiring. lto ay ang mga sumusunod: I a. b. c. Mga miyembro ng diplomatic corps (diplomat); I nte rn ation al org an i zation s; pinuno ng bansa o matataas na opisyates ng pamahalaan na may rank na di bababa sa deputy minister (Undesecretary) ; d. Ibang mga employers o OFWs na maaring payagan ng Secretary of Labor and Employment, katulad ng: 1. 2. 3. in-endorse ng POLO, o ng Embahada kung walang POLO; Mga OFWs na professionals o skilled workers na may executed/authenticated na contract na ang nilalaman ay higit sa pamantayan na itinakda ng POEA; Mga OFWs na ang employer ay isang kamag-anak na naging permanent resident na ng host country. Ang mga exemptions na napabilang sa Section 124 (d) ay kailangang i-process sa DOLE o POEA. Q6: Sinu-sino ang mga accredited agencies sa Pakistan? Q7: Magkano ang bayad ng NOC? Ang NOC na ini-isyu ng Embahada ay nagkakahalaga ng USD 75 o Rs 9,000. lto ay binubuo ng tatlong consular services na certification (USD 25), verification (USD 25) at acknowledgement (USD 25). Ang bayad na ito ay naaayon sa Department Order No. 07-00 o "Revised Consolidated Schedule of Service Fees." Ang Embahada ay nagbibigay ng resibo para sa naturang mga serbisyo. Q8: Bakit naniningil ng mas mataas ang agency para sa NOC? Ang binabayaran ng employer sa agency ay hindi lamang para sa NOC. Kasama dito ang paggawa ng contract, pagpoproseso ng papeles tulad ng contract of employment, visa at agency fee. Ang agency fee ay para sa serbisyo na ginagarantya ng agency para sa OFW ayon sa POEA rules tulad ng repatriation, claims at iba pa. Q9: Bakit hindi makontrol ng Embahada ang mataas na singil ng agency? Ang Embahada ay walang kapangyarihan o mandato na magtalaga ng rates na sisingilin ng agency. Ang mga employer at agency ay may karapatan na magpasya sa kondisyon ng kanilang kasunduan kasama na dito ang rate ng agency.

Bakit kailangan ko pang mag-agency? Ito ay nakasaad sa Section 123 ng 2016 POEA Rules, na bawal ang direct hiring. lto ay simulang na-implement noong 28 April 2016. Wala sa mga exemptions ng naturang Rules ang tagal ng residency ng OFW. Q11: Natapos ko na ang kontrata ko at hindi ako maglilipat ng amo, kailangan ko pa bang mag-agency ulit? Ang requirement sa pagkakaroon ng agency ay nakasaad sa Section 123 ng 2016 POEA Rules. Wala sa mga exemptions ng naturang Rules ang mga re-hire. Kung nanaisin, pwedeng dumulog sa POEA or DOLE upang makapag-request ng exemption. Q12: Bakit pabago-bago ng Rules ang Embahada, dati ang dali namang makakuha ng NOC? Ang Embahada, sa pagganap ng kaniyang tungkulin, ay sumusunod lamang sa mga patakaran na itinakda ng POEA.
