COURT REPORTER GUIDELINES April 18, 1999 Revised December 20, 2004 HOW TO FILL OUT THE WORKSHEET Be sure to fill out a worksheet and turn it in with each job. Fill out one worksheet for EACH job number. If two depos have the same job number, then one worksheet is okay, but if there is more than one job number we need a worksheet for each. Fill out all areas of the worksheet, except for Shipped via. PROMISED DELIVERY DATE If there is no requested date of delivery, please check off Normal Delivery. This will communicate to us that no special date of delivery was requested, and to deliver by the two-week guaranteed turnaround time. If they request a specific date, please write in that date. APPEARANCE SECTION Be sure to include the ZIP code, the suite number, and the phone number of all attorneys. (It s best to get their business card and staple it to the worksheet. Ask for these if they don t give them to you. Often we need to phone the attorney s office to clarify something. We have had situations where transcripts weren t delivered on time because of missing ZIP codes or missing suite numbers. DELIVERY INFORMATION, DUE WHEN/HOW This blank is to be filled in for each copy order. When there is an expedite or special delivery request by a certain party, you will need to clarify if all other parties ordering a copy want a special delivery as well. This blank is to be used to fill in the requested date of delivery for each party. Please be sure to clarify this. Put in Regular if there is no special request. PAGE RATING Mark the correct section: PERSONAL INJURY The section PI should be marked for any personal injury depos. This would include car accidents and slip-and-falls, as well as plaintiff s depos on product liability and Applicant deposition on Workers Comp. This would also include third party witnesses to these type of cases and defendant depos, too.
Page 2, Atkinson-Baker Policy April 18, 1999 How to Fill Out the Worksheet WORKER S COMPENSATION APPEALS BOARD WCAB jobs require special handling, and thus it must be marked for any worker s comp jobs to be billed correctly. BUSINESS The section Business should be marked for any type of business litigation: contract disputes, construction cases, divorces, wrongful termination, judgment debtor exams, Rule 2004 exams, and land development cases whether heavy or light. EXPERT The section Expert should be marked for designated experts and medical testimony. Please do not use it for heavy business. Medical testimony would include doctors, nurses, and psychiatrists/psychologists. Other categories for the expert designation are depos taken in patent, trademark, and copyright cases. HEARINGS/ARBITRATIONS The section Hearings/Arbitrations should be used for non-deposition-type matters like city council meetings, as well as hearings and arbitrations. There are two types of arbitration for ABI s purposes: arbitration as a case type, and arbitration as a proceeding type. There may be a job that is a hearing, meeting or examination which is done in a dispute being resolved by arbitration. This would be marked on the worksheet as a hearing/arbitration. The other type of arbitration would be, for ABI s purposes, the case type of an arbitration. This would be where the case is being resolved by arbitration, but the type of proceeding (and thus billing falls under a different category (e.g., an expert deposition, business, etc. and should be marked as appropriate on the worksheet. For Transcript Inspectors/Billers, this may require looking over some of the testimony to see which category this falls into. The simplest way to tell the difference is to look at the cover page and see how the job is described. Take note of how the proceeding is labeled. Is it a transcript of proceedings (arbitration proceeding type or labeled as a deposition (arbitration case type? For example, if the transcript has American Arbitration Association at the top of the cover page and says Deposition of, then you will know that job is a deposition, not an arbitration. However, if the cover page says Transcript of Proceedings, then it would be an arbitration. For clarification, see attachments 2 and 3 to this policy. Be on the alert: if it is labeled as a deposition, but has several deponent names listed, it may be a hearing. Once again, in this case it would require further investigation on the part of the inspector. APPEARANCE ONLY The section Appearance Only should be used when an appearance was made by the reporter, the depo did not go, and no statement was made. AFFIDAVIT
Page 3, Atkinson-Baker Policy April 18, 1999 How to Fill Out the Worksheet The section Affidavit should be used when an appearance was made; the depo did not take place, but the attorney wants an affidavit to that effect. OTHER This may be one of several different types of proceedings that do not fall under the above categories. The two most common are: INDEPENDENT MEDICAL EXAMINATIONS IME jobs must be marked as such on the worksheet, as they fall under their own category for billing purposes. This would be noted under OTHER on the page rating section. MEETINGS/PUBLIC HEARINGS/CONVENTIONS Public hearings, meetings and conventions have their own billing rate, and so should be designated as such on the worksheet. WAS THIS JOB A REALTIME DEPO? Y N Mark if the job was Realtime, also stating if it was a LiveNote or Caseview hook-up job or rough disk. START TIME/END TIME Be sure to fill this out on all jobs. We need this information for billing and reporter pay purposes. This includes Appearance Only jobs, as we pay waiting time (normally after one hour, so we need to know what time you left. Also, on jobs which include per diem fees, we need the time the proceedings started and what time the proceedings ended. This would include all court hearings and trials, meetings, arbitrations, and miscellaneous-type hearings. ASCII INSTRUCTIONS Find out what size as well as the format. We offer several types: a. ASCII - This is a disk format which is used to get the data from the reporter s computer format to a format which the attorney can access. b.
