Wonder Back-to-School Giveaway Rules and Regulations THIS CONTEST IS OPEN TO CANADIAN RESIDENTS (EXCLUDING QUEBEC) ONLY AND IS GOVERNED BY CANADIAN LAW The Wonder Back-To-School Giveaway Contest (the Contest ) is in no way sponsored, endorsed or administered by, or associated with Facebook, Inc. ( Facebook ). You understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for the administration of this Contest and in accordance with the terms of these Rules and Regulations. Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook. You may only use one (1) Facebook account (the Account ) to participate in this Contest. 1. CONTEST PERIOD: The overall Contest period starts at on Monday, August 18, 2014 and closes at on Friday, September 5, 2014 (the Overall Contest Period ). All times are Eastern Daylight Saving Time. Within the Overall Contest Period, there will be nine (9) Wonder Back-to-School puzzle challenge periods ( Challenge Periods ) as indicated in the chart below. ELIGIBILITY: The Contest is open to all residents of Canada, excluding residents of the province of Quebec, with a valid Canadian mailing address, who have reached the legal age of majority in their respective province or territory of residence at the time of entry. Employees, and the immediate family of employees of Weston Bakeries Limited (the Sponsor ) and its parent company, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the Contest Parties ) are ineligible to participate in the Contest. 3. HOW TO ENTER: NO PURCHASE NECESSARY. To enter online: During the Overall Contest Period nine different back-to-school challenges ( Challenge(s) ) will be posted on www.facebook.com/wonderbreadcanada (the Page ) as per the schedule outlined in Section 1
1 above. To enter, login to your personal Facebook account (the Account ), and (i) Like the Page (note: only required if you are not already a follower of the Page); and (ii) use the Comment feature to submit the correct answer to the Challenge. By liking the Page and commenting with a correct answer to a Challenge, you will be entered ( the Online Entry ) into that Challenge Period s draw (see Section 4 for more prize information). Entrants who submit an incorrect answer to any given Challenge will not be eligible for that Challenge s draw. Entrants must be contactable via Facebook and email to be eligible to win. There is a limit of one (1) Online Entry per Account permitted for each Challenge. For greater certainty and the avoidance of any doubt, you can enter the Contest only one (1) time using one (1) Account per Challenge. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Online Entry per Account per Challenge; and/or (ii) use (or attempt to use) multiple names, identities, email addresses, Accounts and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Online Entries (all of which are void). In the event an online entrant does (i) not Like the Page, (ii) does not comply with Facebook s Community Standards; and/or (iii) a Comment is written within the Comment Section that contains obscene, offensive, defamatory, or disparaging language, or contains any content that does not conform with the requirements of section 6, below, the entrant will be ineligible to receive an Online Entry for the Challenge Period, and the Comment and any accompanying image may be removed and, in the absolute discretion of the Sponsor, the entrant may be disqualified from entering the Contest. To enter by mail, send a handwritten, unique 500 word essay on why Wonder Bread is your favourite bread product along with your full name, mailing address (including city, province, and postal code), telephone number (including area code) and e-mail address (the Mail In Entry ) to: Wonder Back-to-School Contest c/o The Hive Inc., 544 King St. West, Toronto ON M5V 1M3 to be received on or before the end of the Overall Contest Period. All Mail In Entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor or their designated agent (the Administrator ). Sponsor and/or Administrator are not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due requests, which will not be honoured. The date on which a valid Mail In Entry is received will determine which Challenge Period draw a Mail In Entry is eligible for. Limit one (1) Mail In Entry per person per Challenge Period. In the event more than one Mail In Entry per person is received during any given Challenge Period, only the first valid mail in entry received will be included in any given Challenge Draw. By entering you signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the Rules ). Rules can be found within the bitly link of the Challenge or within the Page. All Online and Mail In Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeframe specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest Sponsor or their Administrator s server. 4. THE PRIZES AND APPROXIMATE RETAIL VALUES:
There are a total of five (5) prizes available to be won for each Challenge for a total of forty-five (45) prizes. The prize consists of (1) one Wonder branded lunch box with the approximate retail value of $20 CAD (each the Prize ). Each Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute a Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor s sole and absolute discretion, a cash award. The Prize will only be awarded to the authorized account holder of the Facebook account associated with the selected winning entry or the person associated with the selected mail in entry. No communication or correspondence shall be entered into or exchanged with entrants, except as provided for in these Rules or as otherwise determined by the Sponsor, in its sole and absolute discretion, to be appropriate or necessary based on the circumstances. Limit of one (1) Prize per person. 5. RANDOM PRIZE DRAWS: Random draws will be conducted by a representative of the Contest Sponsor in Toronto, ON on the dates/times indicated in the chart in Section 1 above. Unselected entries are not eligible for subsequent draws. The odds of winning depend on the number of Online and Mail in Entries received during each Challenge Period, in accordance with these Rules. The Sponsor or its designated representative will notify selected entrants ( Notification ) by email (for Mail In Entries) or by commenting on a selected entrant s post (for Online Entries) within forty-eight hours of each draw date/time. Selected entrants must respond to Notification within the specified time frame and follow all prize claim instructions or the prize will be forfeited. If a selected entrant fails to respond to notification, incorrectly answers the skill testing question, or if a Notification email bounces back or is undeliverable, the selected entrant forfeits the ability to claim the prize and the prize will not be awarded. Prizes will be delivered to each confirmed winner within eight (8) weeks of close date of the Overall Contest Period. BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each selected entrant must correctly answer a mathematical skill-testing question without mechanical or other aid and may be required to sign and return to Sponsor or their designated agent a declaration and release form. By entering the Contest entrant, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the Released Parties ) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest, Comments, and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return properly executed Contest documents as may be required within the specified time; (c) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 6. INTELLECTUAL PROPERTY: By entering the Contest each entrant: (i) grants to the Sponsor, in perpetuity, a world-wide, non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Comment and any accompanying image (for online entries) and the essay (for mail in entries), collectively the Entry Submission, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her
Entry Submission in favour of the Sponsor; and (iii) agrees to release, indemnify and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action. For greater certainty, the Sponsor and/or the Contest Parties reserve the right, in its/their sole discretion, to modify, edit or remove any Comment and any accompanying image, or to request an entrant to modify or edit his or her Comment or any accompanying image, if a complaint is received with respect to the Comment or any accompanying image, or for any other reason. By entering via the online method in the Contest, each entrant warrants and represents that his/her Comments and any images submitted with those Comments: i. are original to him/her and that the entrant has all necessary rights (including, without limitation, consent of the photographer) to grant the license above; ii. do not violate any law, statute, ordinance or regulation; iii. do not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence (note: if you cannot obtain the consent of an individual appearing in your image, then his/her face must be blurred out); iv. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and v. are not defamatory, trade libelous, pornographic or obscene, and further that they will not contain, depict, include, discuss or involve, without limitation, any of the following: 7. GENERAL 1. Nudity; 2. Explicit, graphic or excessive sexual activity; 3. Crude, vulgar or offensive language and/or symbols; 4. Derogatory characterizations of any ethnic, racial, sexual or religious groups; 5. Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct; 6. Personal information of individuals, including without limitation, names and addresses (physical or e-mail); 7. Conduct or other activities in violation of these Rules; 8. Commercial messages, comparisons or solicitations for products or services other than those of Sponsor; 9. Any identifiable third party products and/or trade-marks, brands or logos. For example, any clothing worn by persons appearing in a photograph must not contain any visible logos, trademarks or other third party materials, unless the necessary permissions/licenses have been obtained; and 10. Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the Contest Parties in their sole discretion. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
The Released Parties will not be liable for: (i) any failure of the website or Page during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant s or any other person s computer or other device related to or resulting from participating in the Contest; (v) lost, stolen, delayed, late, postage due, damaged or misdirected mail; and/or (vi) any combination of the above. In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Account associated with the online Entry in question, or the person whose name is submitted on a mail in entry. For further clarity, authorized account holder is defined as the person who is assigned an Account by Facebook. An entrant may be required to provide proof (in a form acceptable to the Sponsor including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Account or person associated with the Entry in question. The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor s privacy policy, unless the entrant otherwise agrees. Each entrant agrees that his or her name and Entry Submission may use to identify the Prize winner and posted on the Page or Website. The Sponsor reserves the right, in its sole and absolute discretion and without prior notice, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry Submission or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Entry Form, Website, Page, and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
