March 12, 2018 A Regular Meeting of the Council of the City of Manassas, Virginia was held in Council Chambers, City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Vice Mayor Sheryl L. Bass, Council Members Marc T. Aveni, Ken D. Elston, Pamela J. Sebesky, and Mark D. Wolfe; City Manager W. Patrick Pate, Deputy City Manager Bryan Foster, Assistant to the City Manager/City Clerk Andrea P. Madden, City Attorney S. Craig Brown, Police Chief Doug Keen, Fire and Rescue Chief Robert L. Clemons, Jr., Deputy Fire and Rescue Chief Todd E. Lupton, Community Development Director Elizabeth S. Via-Gossman, Finance Director Diane V. Bergeron, Budget Analyst Amanda Hamm, Deputy City Clerk Rose V.B. Spring, and Communications Manager Patty Prince. Absent was Council Member Ian T. Lovejoy. Mayor Parrish called the meeting to order at 5:30 p.m. and delivered the invocation. Council Time Vice Mayor Bass informed the community that it is budget season and there are several budget work sessions planned over the next few weeks. Vice Mayor Bass reported that the Economic Development Authority has launched www.choosemanassas.org. Vice Mayor Bass reported that Manassas Business Beat has a brief citizen s survey and advised all citizens to take the survey. Vice Mayor Bass informed the community that the General Assembly recessed without a budget and will be returning in April. Vice Mayor Bass announced that the Virginia House of Delegates has formed a new state School Safety Committee to address school security and make recommendations for the 2019 legislative season. Council Member Elston informed the community that the One Love Manassas will be May 18, 19, and 20 and encouraged the community to participate. Council Member Elston reported that on Thursday, March 15 the Joint Finance Committee between Manassas City Council and the Manassas City School Board will meet to discuss the Joint Budget Agreement. Council Member Elston invited the community to the Ribbon Cutting at the new Gillum Ballfields on March 13, 2018. Council Member Elston commended the Manassas City Schools on reaching out to students and allowing them to voice their concerns about school safety. Council Member Sebesky thanked everyone in the community who attended the St. Patrick s Day parade and reported that Friday, March 16 is Transit Drive Appreciation Day. Council Member Sebesky informed the community that on the City of Manassas website is a survey for the Potomac and Rappahannock Transportation Commission (PRTC). Council Member Sebesky reported that the House and the Senate did pass legislation to create the Commuter Rail Operating and Capital Fund. Council Member Sebesky congratulated all the Manassas businesses who won awards at the Chamber of Commerce Business Awards. 5 1

March 12, 2018 Mayor Time Mayor Parrish reported that he attended the Northern Virginia Transportation Authority (NVTA) meeting on March 8 and informed the community that the NVTA Chairman and Executive Director briefed the members on legislation that could have a substantial impact on the NVTA. Staff Reports Chief of Police Douglas Keen reported that there will be a Parent Forum on School Safety on Monday, March 19 at 7:00 p.m. Fire and Rescue Chief Robert Clemons reported that the Fire and Rescue Department had a Push-In Ceremony for the new apparatus, Rescue Engine 521, and retired Rescue 501. Chief Clemons additionally reported that Rescue 501 has been sold to Little Fork Fire Department. Mr. Pate wished everyone in the community a Happy St. Patrick s Day. Mr. Pate invited the community to the Manassas Museum on Sunday, March 18 at 1:00 p.m. for the opening of the new immersion exhibit, Annie s Porch. Mr. Pate reported that next week begins Restaurant Week in the City of Manassas and that many of the restaurants will have two courses for twenty-five dollars and three courses for thirty-five dollars. Mr. Pate commended the City s electric department for their hard work to restore all the power to residents within twenty-four hours during the recent Nor easter. March 12, 2018 VICE MAYOR BASS MOVED that Consent Agenda Items 1.1 through 1.4 be approved and that the reading of the ordinances be dispensed. Seconded by Council Member Aveni. Roll call vote: AYES Aveni, Bass, Elston, Sebesky, and Wolfe. ABSENT Lovejoy. MOTION CARRIED. 2) New Business 2.1 Update: Loy E. Harris Pavilion Activities Anna Marie Robinson and representatives from Rink Management presented to City Council an overview of past and upcoming activities at the Harris Pavilion, plans to coordinate with the City and community organizations, efforts to attract tourists and visitors to the City, and its online social media presence. 2.2 Presentation: Proposed FY 2019 Operating Budget and Capital Improvement Program (CIP) W. Patrick Pate, City Manager, presented to the City Council the proposed FY 2019 Operating Budget and Capital Improvement Program (CIP). Several Budget Work Sessions are scheduling in the coming weeks. 3) Awards, Acknowledgments, and Presentations 3.1 Presentation: Developmental Disability Awareness Month Proclamation Mayor Parrish presented the Proclamation proclaiming March as Developmental Disability Awareness Month in the City of Manassas to Shakira Johnson with Prince William County Community Services. 4) Citizens Time There were no speakers during Citizens Time. 5) Public Hearing Mayor Parrish read an affidavit of publication that was before him signed by an authorized agent of the Prince William Times newspaper certifying that the public hearings listed on the evening s agenda were published in conformance with Virginia law and City ordinances. 5.1 SUP #2018-04: Holtzman Propane (Propane Storage Facility) 10399 Central Park Drive Kelly Davis, Senior Planner, reviewed the application submitted by Holtzman Propane to obtain a special use permit for three thirty thousand gallon propane tanks for propane 7 3

March 12, 2018 distribution to be located at 10399 Central Park Drive. Ms. Davis informed the Mayor and City Council that the site meets all the National Fire Prevention Association (NFPA) setback requirements and the Fire Marshal has approved the applicant s emergency response and evacuation plan. In response to a question regarding safety standards, Ms. Davis noted that the case does meet or exceed the safety standards even for the residential structures eight hundred feet away. In response to a question regarding public notice to the residential property owners, Ms. Davis noted that the adjacent property owners did receive notice, but the residential properties are not immediately adjacent to the property so they did not receive notice. The Planning Commission and staff are recommending approval of SUP #2018-04 as conditioned. Gifford Hampshire, representing Holtzman Propane, spoke in support of SUP #2018-04. Mayor Parrish opened the public hearing and invited anyone wishing to speak in favor of or in opposition to the Holtzman Propane special use permit to come forward and address the City Council. Mayor Parrish disclosed a conflict of interest and stated that he will not participate in deliberations or vote. There were no speakers in favor of or in opposition to the special use permit. COUNCIL MEMBER AVENI MOVED that the public hearing be closed and action scheduled for March 26, 2018. Seconded by Vice Mayor Bass and CARRIED UNANIMOUSLY. The public hearing was closed at 7:51 p.m. 6) Authorize a Closed Meeting 6.1 Authorization of a Closed Meeting COUNCIL MEMBER AVENI MOVED that the City Council convene in a closed meeting to discuss the following, as permitted by appointments to Virginia Code 2.2-3711 (A) (5) to discuss a prospective business or industry or the expansion of an existing business or industry where no previous announcement has been made of the business or industry s interest in locating or expanding its facilities in the community. Seconded by Vice Mayor Bass. Roll call vote: AYES Aveni, Bass, Elston, Sebesky, and Wolfe. ABSENT Lovejoy. MOTION CARRIED. Mayor Parrish announced that the Mayor and City Council, City Manager, Deputy City Manager, City Attorney, and Economic Development Director would be included in the closed meeting discussion. The City Council retired to the closed meeting at 6:45 p.m. 8 4

March 12, 2018 7) Certify the Closed Meeting 7.1 Certification of the Closed Meeting COUNCIL MEMBER AVENI MOVED that the Council certify that, in the closed meeting just concluded, nothing was discussed except the matter (1) specifically identified in the motion to convene in a closed meeting and (2) lawfully permitted to be discussed under the provisions of the Virginia Freedom of Information act cited in that motion. Seconded by Vice Mayor Bass. Roll call vote: AYES Aveni, Bass, Elston, Sebesky, and Wolfe. ABSENT Lovejoy. MOTION CARRIED. The City Council returned from the closed meeting at 7:24 p.m. A motion was duly made, seconded and CARRIED UNANIMOUSLY to adjourn the meeting. In the FY 2019 Budget, the Fire and Rescue Department is requesting two additional full time Firefighter/Medics and an upgrade to three existing Firefighter/EMT positions to Firefighter/Medics. 2) Work Session Aircraft Rescue and Fire Fighting (ARFF) Airport Director, Juan Rivera, presented the City Council with options regarding the use of or disposal of the ARFF equipment currently located at the Manassas Regional Airport. Mr. Rivera noted that all funding to get the equipment working properly and keep it maintained would be directed from the Airport Enterprise Fund. 3) Work Session Prince William County Library Report Community Development Director, Elizabeth S. Via-Gossman, reviewed with the City Council the various options regarding the library system, renovations at the Museum, and the creation of community spaces. 4) City Manager Time Budget and Tax Rate Discussion Mr. Pate asked if there were any issues or outstanding questions that City Council had following previous discussions of the General Fund and the Capital Operating Program. Mr. Pate asked if the Council was interested in approving an advertised tax rate and cancelling Wednesday evening s budget work session. Council Member Sebesky commented that she would prefer to have the meeting on Wednesday and follow the schedule that was published with the budget and made available to the public. 1 12

RESOLUTION OF OFFICIAL INTENT TO REIMBURSE EXPENDITURES WITH PROCEEDS OF A BORROWING WHEREAS, the City of Manassas, Virginia (the Borrower ), intends to design, acquire, construct and equip various improvements to public facilities, including but not limited to the Architect and Engineering Design Services for the construction of a Public Safety Facility (the Project ); and WHEREAS, plans for the Project have advanced and the Borrower expects to advance its own funds to pay expenditures related to the Project (the Expenditures ) prior to incurring indebtedness and to receive reimbursement for such Expenditures from proceeds of tax-exempt bonds or taxable debt, or both; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MANASSAS, VIRGINIA: 1. The Borrower intends to utilize the proceeds of tax-exempt bonds (the Bonds ) or to incur other debt, in an amount not currently expected to exceed $2,200,000 to pay the costs of the Project. 2. The Borrower intends that the proceeds of the Bonds be used to reimburse the Borrower for Expenditures with respect to the Project made on or after the date that is no more than 60 days prior to the date of this Resolution. The Borrower reasonably expects on the date hereof that it will reimburse the Expenditures with the proceeds of the Bonds or other debt. 3. Each Expenditure was or will be, unless otherwise approved by bond counsel, either (a) of a type properly chargeable to a capital account under general federal income tax principles (determined in each case as of the date of the Expenditure), (b) a cost of issuance with respect to the Bonds, (c) a nonrecurring item that is not customarily payable from current revenues, or (d) a grant to a party that is not related to or an agent of the Borrower so long as such grant does not impose any obligation or condition (directly or indirectly) to repay any amount to or for the benefit of the Borrower. 4. The Borrower intends to make a reimbursement allocation, which is a written allocation by the Borrower that evidences the Borrower s use of proceeds of the Bonds to reimburse an Expenditure, no later than 18 months after the later of the date on which the Expenditure is paid or the Project is placed in service or abandoned, but in no event more than three years after the date on which the Expenditure is paid. Special Use Permit Conditions SUP #2018-04, Holtzman Propane, L.C. Storage Yard (Hazardous Materials) 10399 Central Park Drive March 8, 2018 In addition to compliance with all applicable zoning, subdivision, and Design & Construction Standards Manual (DCSM) requirements, the development and use of the designated property shall be subject to the following conditions: 1. This special use permit is for a Storage Yard/Facility/Chemical Storage/Tank Farm (Hazardous Materials) for the bulk storage of liquid propane. This permit specifically allows a maximum of three (3) exterior liquid propane storage tanks not to exceed 30,000 gallons each. 2. The site, subject to final engineering, shall be developed and operated in substantial conformance with the Special Use Permit Plan ( SUP Plan ) entitled Holtzman Propane Bulk Storage Facility prepared by Bowman Consulting, dated October 2017 and revised through January 23, 2018. 3. Prior to site plan approval, the Applicant shall submit a Stormwater Pollution Prevention Plan to the City Stormwater Manager for approval and shall demonstrate compliance with Virginia Pollutant Discharge Elimination System Permit Program requirements. 4. Prior to site plan approval, the applicant shall provide a hazardous materials analysis of the existing silo and adjacent soils and, pursuant to the results of that analysis, a hazardous materials management plan if requested by the City. 5. Prior to site plan approval, the owner/operator shall submit an Emergency Response and Evacuation Plan for review and approval. Enhanced landscape buffers shall be provided and maintained along Godwin Drive and Central Park Drive in general conformance with the SUP Plan. 7. As depicted on the GDP, the applicant shall plant and maintain a row of evergreens as supplemental screening along Godwin Drive and the southeast property boundary. 8. Opaque screening along Godwin Drive, Central Park Drive, and along the southeast property boundary shall consist of board on board or higher quality materials as may be approved by the City. The remaining perimeter fencing may consist of chain link fencing coated with black or dark green vinyl with coordinating black or dark green opaque slats. No barbed wire fencing shall be permitted along Godwin Drive or Central Park Drive. 9. One freestanding sign not to exceed (10) ten feet in height shall be permitted on this property. The monument sign base shall be landscaped with shrubs and/or perennials. 10. Access to the site shall be limited to Central Park Drive. 11. All exterior lighting fixtures shall be directed and shielded downward and inward to prevent illumination of adjacent properties. 12. There shall be no use of exterior loudspeakers or public address systems. 13. Parking of fleet vehicles shall be limited to the Prop. Parking Area as designated on the SUP Plan. 14. There shall be no exterior maintenance or washing of vehicles. 15. There shall be no exterior storage of non-hazardous materials, including inoperable vehicles, parts, or materials. 16. To minimize entry by unauthorized persons, the facility operator shall ensure that the entry gate to the site remains locked while the site is unattended 17. All hazardous materials shall be recycled or disposed of according to federal, state, and local laws. 18. A spill kit shall be maintained on site per the Virginia Department of Environmental Quality requirements. Hazardous fluid spills shall be cleaned up immediately with the proper absorbent materials and disposed of in accordance with federal, state and local regulations. 19. Material Safety Data Sheets for any hazardous materials stored or used shall be available on site for review by public safety personnel. 20. The Applicant shall be responsible for obtaining Fire Prevention Code Permits as required by the Virginia Statewide Fire Prevention Code for hazardous materials storage or operations. 21. Cessation of use - If the use should cease for a period of more than one (1) year, the Applicant or any subsequent property owner shall notify the City of the cessation of use and shall be required to submit a demolition plan to the City for the removal of structures associated with hazardous material storage. 22. A copy of the conditions for this special use permit shall be included with any lease agreements and with any permit application submitted to the City of Manassas. 23. The First Amendment to Purchase and Sale Agreement extended the study period to April, 2018 and stipulates that Closing will occur no later than June 30, 2018. The developer has requested a second amendment that extends the study period to September 30, 2018. This extension stipulates the developer will have a franchise agreement in place no later than August 30, 2018 and that Closing shall occur not later than January 30, 2019.
