M~ {t» ~ 14, 2010 Mayor Yagelski opened the regular meeting of the Montpelier Village Council for June 14, 2010 at 7:30pm. Roll call was conducted and the following council members were present: Dean Skiles, Jim Rockey, Jason Rockey, Laura Gray, Ric Echler, and Dan Clum. Mayor Yagelski opened the meeting with a moment of silence and then everyone recited the Pledge of Allegiance. Laura Gray moved and Ric Echler seconded a motion to accept the agenda for June 14, 2010. Vote on motion: All ayes. Jim Rockey moved and Jason Rockey seconded May 24,2010. Vote on motion: All ayes. a motion to approve the minutes from Laura Gray moved and Jason Rockey seconded a motion to approve the Financial Report for May 2010. Vote on motion: All ayes. Mr. Dane Michael addressed council about receiving water in his basement from the recent rain. He stated this didn't happen before the sewer separation. A valve was put in at the street and minimized the water during the last rain, but he is concerned about this problem. Kurt Roan stated that when we receive a lot of rain, a vacuum pump on that type of system may freeze up, and that pump failure then causes a trickle-down effect from house to house. Once they find the pump that failed, they can start it again and the other pumps will follow, but until they find the problem it causes a backlog in water. Kurt Roan advised he will meet with Water/Sewer Supt. Ric Byers about the issue. Jason Rockey stated that due to the detour on St. Rt. 15 the downtown is seeing a lot more semi truck traffic and that there is an issue with semi's cutting the corner at Monroe and Main Street, and the walk light has been hit a couple of times. Mayor Yagelski asked if we could suggest to ODOT to reroute the detour to State Route 49 instead of having to turn at St. Rt. 576. With the Fire Dept. located close by it would be better for emergency traffic in the area, plus visibility at the intersection is also problem. Pam Lucas was unsure if they could change the route for this project, but we need to address this with ODOT for future projects. Mayor Yagelski suggested writing them a letter so that we have documentation that we are trying to address the issue. Mayor Yagelski and Laura Gray commented about residents that were part of the Phase I CSO Project that are unhappy with the yard work, patios, and shrub replacement. Mayor Yagelski would like to see one or two Village employees go. door to door with documentation and pictures and ask the people if they are happy with the work that is done inside the residence and outside. It was stated in the public hearings prior to the

We need to ensure that restoration was completed satisfactorily. Laura Gray addressed council about the Planning and Zoning Committee meeting earlier this evening, and advised them of the items being addressed. Mrs. Gray also advised that they reviewed member qualifications for the Design Review Committee, and the Mayor can recommend Mark Smith be placed on the Design Review Committee as the chairperson with Council approval. Mayor Yagelski asked that Mark Smith be placed on the Design Review Committee Chairperson for the committee. and Laura Gray moved and Jason Rockey seconded a motion to name Mark Smith on the Design Review Committee and as the Committee Chairperson. Vote on motion: All ayes. Jeremy Fraley, Montpelier Chamber President, spoke to Council regarding the parade route for Bean Days. The parade line up will be in the fairgrounds starting behind the Veteran's Memorial Building, out the east gate at the intersection of Henry Street and proceed west down Main Street ending at North Jonesville Street. To get to the parade lineup, the entrants need to go to the Livestock gate that is located at the corner of River Street and luka Road. Entrants would head east along the back of the fairgrounds to the east side of the fairground. Dan Clum moved and Ric Echler seconded Parade Route. Vote on motion: All ayes. a motion to approve the 2010 Bean Days Pam Lucas advised we received a letter from Jim Hicks, EMS Director, describing how West Unity is utilizing their first responders. Mayor Yagelski advised that Mr. Hicks is seeking interested Montpelier residents to be first responders. Interested persons would need to take a forty-eight (48) hour course with a three year certification to qualify them as first responders, and interested persons need to contact Jim Hicks the EMS Director. They are going to try to house a unit at the Safety building at the fairgrounds which is located at the first entrance to the fairgrounds off of River Street. Pam Lucas addressed the sale of the youth football equipment to Troy Roth for one dollar ($1.00). The 5 th and 6 th grade program was run by the Parks Department for the last few years by Kevin Sommers, and he is unable to continue with the program. Troy Roth and two other persons, approached the park board about obtaining the equipment to continue the football program privately and separate from the Village, and the Park Board had given authorization to sell the equipment for one dollar and let Mr. Roth and these gentlemen take over the program. If within five years the program ceases to exist, they would have to return the equipment back to the village for the same price of

A RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO PURCHASE ONE 2011 FORD F-350 4WD CAB AND CHASSIS Pam Lucas stated the dump truck is for the Electric Department, and this resolution is just for the cab and chassis. She recommended that for the difference of $2,713.00 we purchase the cab and chassis through a local business, Maxton Motors rather than the Ohio Cooperative Purchasing program. AN ORDINANCE ESTABLISHING THE RATES FOR WHOLESALE WATER SERVICE PROVIDED BY THE VILLAGE OF MONTPELIER, Pam Lucas explained that Ordinance 2117 and 2118 go together and is for setting wholesale water and sewer service rates for customers located outside the village limits. This would be charging them the same as the inside rates. Dean Skiles moved and Jim Rockey seconded a motion for a first reading of Ordinance 2117. Vote on motion: All ayes. OHIO AN ORDINANCE ESTABLISHING THE RATES FOR WHOLESALE SEWER SERVICE PROVIDED BY THE VILLAGE OF MONTPELIER, Dean Skiles moved and Jason Rockey seconded a motion for a first reading of Ordinance 2118. Vote on motion: All ayes. OHIO Dan Clum asked if a definition needed to be added to the ordinance regarding who will be able to supply water and sewer service. After a brief discussion, it was determined to look at the possibility of expanding that definition. Kelly Hephner reported that income tax collections as of June 11, 2010 are $655,845.00 compared to $727,844.00 and $699,037.00 in 2008 and 2009 respectively. Mayor Yagelski commented on the open house for the Montpelier North Wildlife site located north of Montpelier. Dean Skiles moved and Jim Rockey seconded a motion to go into Executive Session to discuss personnel and possible pending litigation and reserving the right to discuss other matters.
