The Mayor and City Council of the City of Bayard, County Morrill, State of Nebraska, met regular session in the Council Chambers June 12, 2018 at 7:00 PM City of Bayard 445 Main St., Bayard, Nebraska, 69334. Notice of the meeting having been published in the Bayard Transcript, a newspaper of general circulation, on June 6, 2018. An agenda for the meeting was made available to the Mayor and each of the Council members prior to the meeting. Present were Mayor Coolidge and council members, Marty Marquez, Janice Newhoff, Nate Edmunds, and Scot Ouderkirk, Gage Norman, and Jim Deines. There being a quorum of council members present, Mayor Coolidge called the meeting to order at 7:00 P.M. with City Clerk Jennifer Tressler recording the minutes. All present voluntarily recited the Pledge of Allegiance. Council member Ouderkirk made a motion to approve the agenda. Seconded by council member Edmunds. ROLL CALL: AYES: Marquez, Newhoff, Edmunds, and Ouderkirk, Norman, and Deines. NAYS: None. Mayor Coolidge acknowledged the Open Meetings Act and stated to the public that a copy is posted on the door. Mayor Coolidge declared public hearing open on James and Lisa Johnston Request of "Change in Zoning" classification for LOTS 1-6, BLOCK 3, 2nd EAST ADDITION And LOTS 1-6, BLOCK 6, 2ND EAST ADDITION And LOTS 1-7, BLOCK 9, 2ND EAST ADDITION, Morrill County, Nebraska. Joe Romero discussed the Planning Commission s recommendation from April 26 th, 2018 meeting. Stated it was unanimous that they approve the recommendation to council to change the zoning. There were concerns from the public regarding taxes and how changing the Johnston s property could affect the neighboring property taxes and they were referred to the County for that. Lisa Johnston explained they purchased the property in 2011 and felt they did their due diligence in researching to ensure it was zoned Agriculture. The Johnston s were informed last winter that their properties were not zoned Agriculture and that they were not aware that something in the zoning had changed. The Johnston s would like to have the properties zoned to Agriculture from Residential-2 (R2) so they may continue their business in raising and breeding horses and providing lessons. Comments of the public were concerning their properties currently being zoned as Agriculture. Clerk Tressler clarified that when the Johnston s purchased their properties in 2011 they were misinformed that the properties were zoned Agriculture when in fact they have been zoned Residential-2 since 2004. None of the properties in the area being discussed were zoned Agriculture. Concerns of property taxes were brought up due to the zoning change. City Attorney Phil Kelly addressed that the only property taxes that would be affected would be the Johnston s property they are currently requesting to be rezoned. Concerns regarding traffic were addressed by the Johnston s stating that there would be minimal traffic, at most ten (10) to fifteen (15) at a time once arena opens. Concerns regarding fowl being within City limits was brought to question if the property is rezoned to Agriculture. City Attorney Phil Kelly addressed the concern stating that the rezoning the property to Agriculture would supersedes City Ordinance regarding no fowl within City limits. Agriculture zoning would allow for fowl. Council member Edmunds made a motion to approve the recommendation to change the zoning from Residentail-2 (R2) classification to Agriculture for LOTS 1-6, BLOCK 3, 2nd EAST ADDITION And LOTS 1-6, BLOCK 6, 2ND EAST ADDITION And LOTS 1-7, BLOCK 9,

Mike Olsen from MC Schaff submitted a written report with update concerning the water treatment plant. City Attorney Phil Kelly discussed proposed acquisition of 0.174 acres of real estate property NORTH HALF OF THE SOUTHEAST QUARTER OF SECTION 3, TOWNSHIP 20 NORTH, RANGE 52 WEST OF THE 6th P.M., MORRILL COUNTY, NEBRASKA and proposed acquisition of approximately 1.994 acres of real estate located in the SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 3, TOWNSHIP 20 NORTH, RANGE 52 WEST OF THE 6th P.M., MORRILL COUNTY, NEBRASKA. City Attorney Kelly has spoken with the property owners and they requested to have a meeting with the committee of the council. The Real Estate Committee and Utility Committee will meet on June 20, 2018 at 6:00 pm with the owners to discuss their concerns and negotiate. City Attorney clarified that if she were to be an independent contractor she would have to supply liability insurance or the City would have to employ her to cover her under their insurance. At this time due to the pool season delays council will review options for the 2019 pool season. Genie Andrews from GIS Workshop presented proposal for SimpleCity Subscriptions. Council requested to have a workshop July 10 th, 2018 at 6:30 pm to go over products and services. Dan Coolidge presented Blackline Safety Device. Council requested additional options be reviewed for similar services before making a decision. Dan Coolidge presented request from Guys Enterprise to purchase City scrap copper and aluminum in the amount of $300.00. Council would like other options and bids presented before considering. Mike Peterson presented option for new roll up door for Bayard Swimming Pool with a quote of $1900.00. Council requested that City Clerk reach out to Miller and Associates regarding DHHS requirements for replacement door before making any decisions. Mike Peterson presented Sani-Tred refurbishing product for the Bayard swimming pool. The product has a limited lifetime warranty on the Sani-Tred material along with a five (5) to eight (8) year warranty on paint which will only require sanding if repairs are needed. Quote for $54,950.00 included baby pool. Mike explained that quote included what were his expected hours and paint needed but if less was needed price would drop accordingly. Additional questions were asked regarding freezing and warranty that Mike will research for next council meeting. A breakdown of City related costs over the last five (5) years due to water loss, loss of chemical, and staff payroll for scraping and repainting was requested to be presented at next council meeting. Public Comment: Dan Coolidge commented that Kevin Fowlkes passed his wastewater test. Sonny Johnson is scheduled to go to his training July 25 th and July 26 th in Scottsbluff for a water class. City Clerk commented that MEAN representative Carol discussed grants available through MEAN for electrical training up to $1,000.00 per year as well as $500.00 for any training for City Staff for Finance or Clerk school. Also up to 5 additional on line classes for free are offered annually. Council member Norman moved to adjourn at 9:28 P.M. Seconded by council member Edmunds.
