MINISTRY OF INDUSTRY OF THE REPUBLIC OF INDONESIA REGULATION NUMBER: ON OBLIGATORY ENFORCEMENT OF THE INDONESIAN NATIONAL STANDARD FOR VEHICLE RIMS CATEGORY M, N, O AND L BY THE GRACE OF THE ONE ALMIGHTY GOD MINISTRY OF INDUSTRY OF THE REPUBLIC OF INDONESIA Considering: a. that within the framework of enhancing the competitiveness of national industries, to guarantee the quality of industrial products, to protect consumers in respect of product quality, as well as to create sound and fair business competition, it is necessary to enforce the Indonesian National Standard (SNI) for Wheel rims of Motor Vehicles in Categories M, N, O and L as an obligation; and b. that, based on the consideration referred to in letter a, it is necessary to issue a Regulation from the Ministry of Industry. In view of: 1. Law No 5 of 1984 on Industries (State Gazette of the Republic of Indonesia of 1984 No 22, Supplement to the State Gazette of the Republic of Indonesia No 3274; 2. Regulation of the Ministry of Trade No 62/M-DAG/PER/12/2009 on Labelling Obligations for goods as amended by the Regulation of Ministry of Trade No 22/M-DAG/PER2010; HAS DECIDED: To enact: REGULATION OF THE MINISTRY OF INDUSTRY ON THE OBLIGATORY ENFORCEMENT OF THE INDONESIAN NATIONAL STANDARD FOR WHEEL RIMS OF MOTOR VEHICLES OF CATEGORIES M, N, O AND L Article 1 In this Ministerial Regulation what is meant by: 1. The Product Certificate on Indonesian National Standard Marking, hereinafter referred to as SPPT-SNI, is a Product Certificate of the Indonesian National Standard Marking issued by the Product Certification Body to the producers capable of producing wheel rims for motor vehicles of categories M, N, O and L according to the SNI requirements. 2. The Product Certification Body, hereinafter referred to as LSPro, is an institution that has been accredited by the National Accreditation Committee to carry out the activities of Product Certification on Indonesian National Standard Marking. 3. The Testing Laboratory is a laboratory conducting testing activities on samples of goods according to the specification/testing methods of SNI. 4. The Goods and Services Standard Supervisory Officer in the Plant, hereinafter referred to as PPSP, is a civil servant in the centre or

region assigned to supervise goods and or services at and outside of production sites for which SNI has been mandatorily enforced. 5. The National Accreditation Committee, hereinafter referred to as KAN is an institution authorised to give accreditation to the institution and laboratory to carry out certification activities. 6. The Ministry refers to Ministry overseeing industrial affairs. 7. The Director General for Industrial Development refers to the Directorate General of Transportation Equipment and Telematics Industries, Ministry of Industry. 8. The BPPI Chairperson is the Chairperson of the Research and Industrial Development Agency, Ministry of Industry, implementing the development of the Conformity Assessment Institute. 9. The Head of Provincial Services is the Head of Services at the Provincial level carrying out industrial governmental affairs. 10. The Head of Regency/City Services is Head of Services in the Regency/City carrying out industrial governmental affairs. Article 2 1) Obligatory enforcement of the Indonesian National Standard (SNI) for wheel rims of motor vehicles of categories M, N, O and L shall include: Type of Product SNI No HS Wheel rims for motor vehicles of categories M, N and O SNI 1896:2008 8708.70.93.00 8708.70.94.00 8708.70.99.00 Wheel rims for motor vehicles of category L SNI 4658:2008 8714.19.00.38 8714.19.00.90 2) If the wheel rims of motor vehicles for categories M, N, O and L referred to in Paragraph (1) are revised, the latest revision of the Indonesian National Standard (SNI) for wheel rims of motor vehicles of categories M, N, O and L shall be applicable. 3) What is meant by wheel rims of motor vehicles for categories M, N, O and L referred to in Paragraph (1) are wheel rims of motor vehicles made of steel or combinations of light metal for Category M Motor Vehicles (motor vehicles with four or more wheels used for public transportation), N (motor vehicles with four or more wheels used for goods transportation), O (semi-trailer trucks) and L (motor vehicles with fewer than four wheels).

Article 3 Companies producing wheel rims for motor vehicles of categories M, N, O and L as referred to in Article 2 shall apply SNI by: a. Having SPPT-SNI of wheel rims of motor vehicles of categories M, N, O and L according to the applicable provisions; and b. Affixing a legible and indelible SNI marking to each product. Article 4 (1) Issuance of SPPT-SNI of wheel rims of motor vehicles of categories M, N, O and L referred to in Article 3 a. shall be carried out by the LSPro appointed by the Minister with a suitable scope through: a. testing the conformity of product quality of wheel rims of motor vehicles of categories M, N, O and L with the SNI provisions according to Article 2 paragraph (1) or its revision; and b. auditing the application of Quality Management Systems of SNI ISO 9001-2008 or its revision, or other recognised quality management systems. Recognition Arrangement (MRA) should be established between KAN and the concerned State Accreditation Institute, and there should be bilateral or multilateral agreements in the technical regulatory field between the Indonesian Government and the concerned state. (2) The Quality Management Audit System as referred to in Paragraph (1) b shall be based on the guarantee extended by the quality system certification institution accredited by KAN or accreditation institute overseas that have MRA and KAN. Article 5 (1) LSPro, as referred to in Article 4 (1), shall report the implementation of certification to the Director General of Industrial Development and Head of BPPI. (2) LSPro issuing the SPPT-SNI of wheel rims of motor vehicles of categories M, N, O and L shall be responsible for the supervising and monitoring implementation of the utilisation of the SNI marking issued by the SPPT-SNI issued.

Article 6 Each imported wheel-rim of motor vehicles of categories M, N, O and L referred to in Article 2 traded within the country (domestically), which is originating from the local or imported production shall meet SNI requirements referred to in Article 3. Article 7 (1) Wheel rims of motor vehicles of categories M, N, O and L referred to in Article 2 entering Indonesian Customs areas shall meet the SNI requirements referred to in Article 3. (2) Imported wheel rims of motor vehicles of categories M, N, O and L having SPPT-SNI shall be registered according to the applicable provisions. Article 8 (1) Domestically produced wheel rims of motor vehicles of categories M, N, O and L originating from local production that do not fulfil the SNI requirements as referred to in Article 3, shall be barred from distribution and shall be destroyed. (2) Imported wheel rims of motor vehicles of categories M, N, O and L that do not meet SNI requirements referred to in Article 7 when entering the Indonesian Customs area shall be destroyed or re-exported by the concerned importers. Article 9 (1) Development and supervision on the implementation of application of SNI on wheel rims of motor vehicles of categories M, N, O and L as referred to in Article 2 shall be ensured by the Directorate General for Industrial Development at least once a year and shall be carried out by the Goods and/or Services Standard Supervisory Officer (PPSP) at the Plant. (2) In performing supervision referred to in Article (1), the Directorate General of Industrial Development may coordinate with the Provincial Service and or Regency/City Service or related institutions. (3) BPPI shall carry out development on the Conformity Assessment Institute in the frame of application of SNI on wheel rims of motor vehicles of categories M, N, O and L. Article 10

The Director General of Industrial Development stipulates the Implementing Technical Guidelines of this Ministerial Regulation. Article 11 Entrepreneurs and LSPro violating the provisions of this Ministerial Regulation shall be subject to sanctions according to laws and regulations. Article 12 This Ministerial Regulation shall be effective 6 (six) months from its enactment. In order to ensure public awareness, this Ministry Regulation is published via the State Gazette of the Republic of Indonesia.
