Royal Decree Request for the Most Admirable Order of the Direkgunabhorn, B.E. 2538 (1995) His Majesty King Rama IX Declares on September 23, B.E. 2538 (1995) Translation His Majesty has decreed to devise the regulations, procedures and conditions of the request for the Most Admirable Order of the Direkgunabhorn. As recognized in Section 178 of the Constitution of the Kingdom of Thailand, revised edition, (No. 5) of 1995 and Section 5, (Division 2) of the Act of the Most Admirable Order of the Direkgunabhorn of 1991, His Majesty has the Royal Consent to publish that: Section 1 This is called "Royal Decree of Request for the Most Admirable Order of the Direkgunabhorn of 1995." Section 2 This is in vigor after the publishing in the Royal Gazette. Section 3 In this Royal Decree, "Royal Decoration" is the Most Admirable Order of the Direkgunabhorn, as recognized in the Act of the Most Admirable Order of the Direkgunabhorn. Section 4 The Prime Minister has the Royal Order to publish this Royal Decree and to maintain its right. The Regulation and Announcement are in vigor after the publishing in the Royal Gazette. Chapter I Request for Royal Decorations Section 5 The request for the Royal Decorations for the deemed person, who has rendered devotional services to the Kingdom, must follow the regulations, procedures and conditions of this Royal Decree. Section 6 The request starts at the Silver Medal (Class VII) of the Direkgunabhorn and ends at the Knight Grand Cross (First Class) of the Most Admirable Order of the Direkgunabhorn, unless otherwise specified in this Royal Decree. Section 7 The Royal Decoration is conferred upon those who: (1) Possess good conducts. (2) Have never been sentenced to jail, except for delinquencies. (3) Have never been demanded the return of the Royal Decoration, as recognized in this Royal Decree or other laws, except the return in exchange of Royal Decorations of higher class. www.thailaws.com 1

Section 8 Devotional services to the Kingdom can be divided into two categories: Section 9 (1) Devotional services to the state, religion and Thai people. (2) Donations for public use. Devotional services to the state, religion and Thai people, according to Section 8 (1) must meet these characteristics: (1) Services of outstanding virtue. (2) Acts of bravery. Section 10 The consideration guidelines for Section 8 (1) are: (1) They are original and have never been used to request for Royal Decorations, as recognized in this Royal Decree or other laws. Should they be of a group of persons, they should be divided and identified the persons in charge. (2) Should they be to legal persons, those persons must demonstrate the will to work for the public, as specified in the list published in the Royal Gazette by the Office of the Prime Minister. Should the legal persons, as in clause I (2), be government agencies, the services, used to request for the Royal Decoration, must not be the daily routines of the agencies. Section 11 Devotional services to the Kingdom, according to Section 8 (1), must be certified by the head of government agencies, of classification 8, head of departments of the State Enterprises or head of divisions of the Thai Red Cross. Section 12 The request for the Royal Decoration for the deemed persons of Section 8 (1), starts at the Silver Medal (Seventh Class) of the Direkgunabhorn and ends at the Knight Grand Cross (First Class) of the Most Admirable Order of the Direkgunabhorn. The Royal Decoration of higher rank can be attained after the interval of five years. Section 13 Donations for public use, according to Section 8 (2) must meet these characteristics: (1) Donations are for general public, e.g., for maintenance of religion, education, public health, medicine procurement, community development, public welfare or security of state. (2) Donated properties must be of the donor or of which the donor can donate in his name. Section 14 The consideration guidelines for Section 8 (2) are: (1) Donated properties have never been used to request for the Royal Decorations, as recognized in this Royal Decree or other laws. (2) Donated properties, which are transferable through registered documents registered, must come accompanied by those documents. (3) Donations from a group of persons must provide the details concerning the amounts donated by each member of the group. Should the details be not provided, it is assumed that each member donate the same amount of properties. www.thailaws.com 2

(4) Should the donations be to legal persons, those persons must demonstrate the will to work for the public, as specified in the list published in the Royal Gazette by the Office of the Prime Minister. (5) Solid properties must be certified by the departments or persons in charge and land properties must be certified by the civil officials of the Department of Land. (6) Donated properties must be free of terms and conditions. Section 15 Under Section 16 Devotional services to the Kingdom, according to Section 8 (2) must come accompanied with the certified documents of donated items, signed by: (1) Central Administration Agencies: Documents are signed by the director or head of department. (2) Regional Administration Agencies Documents of less than 500,000 Baht in value are signed by the head of districted agency and sheriff. (b) Documents of more than 500,000 Baht in value are signed by the head of provincial agency and governor. (3) Local Administration Agencies Documents of less than 500,000 Baht in value are signed by the head of provincial administration agency, municipality, sanitation or Pattaya City Administration. (b) Documents of more than 500,000 Baht in value are signed by the governor. (4) Bangkok Metropolitan Administration: Documents are signed by the Secretary General. (5) State Universities: Documents are signed by the rector. (6) State Enterprises: Documents are signed by the director. (7) Thai Red Cross: Documents are signed by the Secretary General. (8) Legal Persons, as specified in the Office of the Prime Minister's lists, published in the Royal Gazette: Documents are signed by their representative. Section 16 Devotional services to the Kingdom, according to Section 8 (2), which are in affiliation with the religion, must be rendered to the registered religious organizations and accompanied with the certified documents of donated items, signed by: (1) Provincial Areas: Documents of less than 500,000 Baht in value are signed by the Education General and sheriff. (b) Documents of more than 500,000 Baht in value are signed by the Education General and governor. (2) Bangkok Metropolitan Area: Section 17 Documents of less than 500,000 Baht in value are signed by the representative of the Department of Religion and head of district. (b) Documents of more than 500,000 Baht in value are signed by the director of the Department of Religion. Devotional services to the Kingdom, according to Section 8 (2), which are not rendered to the organizations, as in Section 15, must come accompanied with the certified documents of donated items, signed by: www.thailaws.com 3

(1) Provincial Areas: Documents of less than 500,000 Baht in value are signed by the head of districted agency and sheriff. (b) Documents of more than 500,000 Baht in value are signed by the head of provincial agency and governor. (2) Bangkok Metropolitan Area: Section 18 Documents of less than 500,000 Baht in value are signed by the representative of the concerned government agency and head of district. (b) Documents of more than 500,000 Baht in value are signed by the director of the concerned government agency. Should the donation be to more than one organization, the documents must be signed, according to Section 15 or Section 16, by the representative of those organizations. Section 19 Devotional services to the Kingdom, according to Section 8 (2), which are rendered in other countries, must come accompanied with the certified documents of donated items, signed by the ambassador or Consul General. Section 20 The calculation of the value of donated properties must meet these aspects: (1) Land: According to the certified lists of civil officials of the Department of Land at the moment. (2) Foreign Exchange: According to the Foreign Exchange Rate into Thai Baht at the moment. (3) Other Properties: According to the market value at the moment. Section 21 Request for the Royal Decorations for the deemed person, according to Section 8 (2), must be processed in regard of the List of Value, annexed at the end of this Royal Decree. Section 22 The documents to request for the Royal Decorations, together with the details of devotional services and their certification, must meet the regulations of the Office of the Prime Minister. Chapter II Consideration of Request for Royal Decorations Section 23 The consideration of request for the Royal Decorations for the deemed person, according to Section 8, must be processed by these agencies: (1) Central Administration Agencies, Bangkok Metropolitan Administration, State Universities, State Enterprises or Organizations. (2) Province in which Regional or Local Administration Agencies are located. (3) Thai Red Cross. (4) Legal Persons, as specified in the Office of the Prime Minister's lists, published in the Royal Gazette. www.thailaws.com 4

Should the services be rendered to more than two organizations, the organizations, according to (1) (2) (3) or (4), benefited most from the deemed person, as in Section 8 (1), or donated most from the deemed person as in Section 8 (2) will process the request. Section 24 The organizations in charge, according to Section 23, will set up a committee to consider the qualifications, backgrounds, and conducts, according to Section 8, and the suitability of the deemed persons. The qualifications and numbers of members of the committee and their meeting, as in Clause 1, must meet the regulations of the Office of the Prime Minister. Section 25 The organizations in charge, according to Section 23, will submit the result to the Office of the Prime Minister or the Ministries, according to Section 26. Any departments or agencies, which do not report to the Office of the Prime Minister or the Ministries, will submit the result directly to the Secretariat of the Cabinet. Section 26 The Office of the Prime Minister or the Ministries in charge will set up another committee to revise the result, according to Section 25 Clause 1, before submitting it to the Secretariat of the Cabinet. The qualifications and numbers of members of the committee and their meeting, as in Clause 1, must meet the regulations of the Office of the Prime Minister. Section 27 Under Section 31, the Secretariat of the Cabinet will submit the result, according to Section 25 Clause 2 and Section 26, to the Committee, as in Section 28. Chapter III Committee for Consideration of the Request for the Royal Decorations Section 28 The Committee is named "Committee for Consideration of the Request for the Royal Decorations," comprising of the Deputy Prime Minister, whom the Prime Minister appoints Head of Committee, Secretary General of the Prime Minister, Secretary General of the Cabinet and the qualified persons, not exceeding ten, whom the Prime Minister appoints Members of Committee. The Prime Minister also appoints any of the civil officials working for the Secretariat of the Cabinet to be a Member and Secretary of the Committee and appoints any of the civil officials of the same to be Member(s) and Assisting Secretary(ies). Section 29 The Committee for Consideration of the Request for the Royal Decorations has rights and responsibilities to consider and submit the request for Royal Consents and, in particular, to complete these: (1) The consideration of the class of the Royal Decorations to be conferred, if not specified in the lists, annexed at the end of this Royal Decree. (2) The consideration of the omission of the Order of Precedence and the period of interval. In exceptional cases, the Committee for Consideration of the Request for the Royal Decorations requests for the Royal Decorations for the deemed persons, not covered in Section 23 Section 24 Section 25 and Section 26. www.thailaws.com 5

Section 30 Once the Committee for Consideration of the Request for the Royal Decorations has come up with the result, the Secretariat of the Cabinet will submit it to the Prime Minister for the final approval. With the Prime Minister's approval, the Secretary of the Cabinet will submit it to His Majesty for the Royal Consent and publish the names of the recipients in the Royal Gazette. Section 31 In case of urgency, the Secretariat of the Cabinet will submit the case directly to the Prime Minister. With the Prime Minister's approval, the Secretariat of the Cabinet will submit it to His Majesty for the royal consent and publish the names of the recipients in the Royal Gazette. Chapter IV Consideration of Request for Royal Decorations for Special Cases Section 32 The request for Royal Decorations for persons of other nationalities, who do not work for foreign governments, international organizations or Thai government agencies, must be processed, according to List 2, annexed at the end of this Royal Decree, by the ministries or departments in charge, benefited most from those deemed persons. The ministries or departments in charge must submit the request to the Ministry of Foreign Affairs to consider for the class of the Royal Decorations to be conferred, according to List 2, annexed at the end of this Royal Decree. Once the Ministry of Foreign Affairs has come up with the result, it will inquire the government of those deemed persons for the consent, should that be the case. With the state consent, the ministries or departments in charge will submit the result to the Secretariat of the Cabinet, for the final approval of the Prime Minister. With the Prime Minister's approval, the Secretariat of the Cabinet will submit it to His Majesty for the Royal Consent and publish the names of the recipients in the Royal Gazette. The request for Royal Decorations, according to this Section, cannot be processed, according to Section 7, Section 23, Section 24, Section 25 and Section 30. Section 33 The request for Royal Decorations for sportsmen, personnel of private schools and universities or distinguished persons must be processed, according to the regulations and conditions, as specified in List 3, 4, 5 or 6, annexed at the end of this Royal Decree. Section 34 The request for Decorations for the deceased persons must be processed by the ministries or departments, benefited most from those deemed persons or by the Thai Red Cross. The ministries or departments in charge or the Thai Red Cross will submit the case to the Secretariat of the Cabinet, for the final approval of the Prime Minister. With the Prime Minister's approval, the Secretariat of the Cabinet will submit it to His Majesty for the Royal Consent and publish the names of the recipients in the Royal Gazette. The request for Royal Decorations, according to this Section, cannot be processed, according to Section 7, Section 23, Section 24, Section 25, and Section 30. Section 35 Should any problem arise in any case, the Committee for Consideration of the Request for the Royal Decorations will submit the case to the Prime Minister for final approval. They must be either founder Principal or personnel of private schools, 2 Founder according to Section 15 (1) or Member Commander (3) of the Act of Private Schools 3 Assisting Manager, Assisting Principal or Teachers of 1982, who have provided courses, according to the Member Companion Regulations of the Ministry of Education, for at least eight years, at the date of request. Should the principal or teachers have worked at and resigned from one institution and been recruited at the other, within 45 days of the resignation, they can add up the time being at the former institution into that of the new one. 2.
