NOTICE INVITING TENDER Name of work: ANNUAL RATE CONTRACT (ARC) FOR MISCELLANEOUS FURNITURE REPAIR ITEMS AT NISCAIR S BOTH THE LOCATION (PUSA AND SVMARG) Estimated Cost: Rs 4,56,970/- (based on market rates) Wax sealed Tenders on behalf of Director, NISCAIR are invited in two bid system i.e. Technical +EMD and Financial separately for the above work. Tenders should be on the specified form (Non-transferable) which may be obtained from the NISCAIR, BOOK SHOP (Pusa) New Delhi- 110 012 during office hours up to 13/8/2010 on payment of Rs. 500/- (Rupees five hundred only) by demand draft of a scheduled bank drawn in favour of Director, NISCAIR, New Delhi (Non refundable). Tenders should be submitted in double sealed covers super-scribed with the name of the work, date and time of opening written both on the inner and outer envelopes. They will be received upto 3.00 P.M. on 16/8/2010 and Technical bids will be opened at 3.30 PM on the same day in the presence of bidders if any. Tenders should be dropped in the tender box before the closing date and time indicated. Terms & Conditions: 1. Eligibility Criteria: (The bidder must fulfill the following eligibility criteria and should submit the following document with their technical bids failing which their bid shall be regretted out rightly) i) The Bidders should be registered with CPWD or Railway or MES or Post & Telegraph Department or public sector organization or Autonomous bodies etc. under appropriate class and / or have worked out for CSIR or its laboratories/institutes. ii) iii) iv) The bidders should have successfully carried out at least three similar ARC works amounting to not less than 40% or two similar ARC works amounting to not less than 50% or one similar ARC work amounting to not less than 80% of the TENDERED cost in the last five years. The bidders should submit the related completion certificates in support of above works issued by the respective departments. The bidder should also have valid PAN number in the name of the firm. 4

v) The Earnest Money Deposit (EMD) amounting to Rs. 11,500/- (Rupees Eleven thousand five hundred only) as demand draft or pay order of a schedule bank and drawn in favour of Director, NISCAIR, New Delhi should accompany the tender in the envelope of technical bid. Tenders received without earnest money will be invalid. 2. Time for carrying out the work shall be twelve months (One year) and the date of commencement shall be reckoned from the 7 th day of issue of award letter. It is to be noted that execution of work shall be done during working hours only (i.e 9.00 A.M.- 5.30 P.M., Monday to Friday). NISCAIR reserves the right for getting the work executed beyond office hours and on all gazetted Holidays, Sunday & Saturday during the stipulated period of completion and shall be abided by the Contractor. 3. The Director, NISCAIR does not bind himself to accept the lowest or any tender and reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted. 4. Canvassing in connection with the tenders is prohibited and the tenders submitted by the contractor who resort to canvassing are liable for rejection. 5. The tenderers shall not be permitted to tender for works in the concerned unit of NISCAIR in which a relative is posted in the grade between Controller of Administration and Junior Engineer, (both inclusive). He shall also intimate the names of persons who are working with him in any capacity or subsequently employed by him and who are relatives as mentioned above. NOTE: A person shall be deemed to be a relative or another if, and only if, (a) they are members of a Hindu undivided family; or (b) they are husband and wife; or (c) the one is related to the other in the following manner: Father, Mother (including step mother), Son (including step son), Son s wife, Daughter s (including step daughter), Father s father, Son s son, Son s son s wife, Son s daughter, Son s daughter s husband, Daughter s husband, Daughter s son, Daughter s son s wife, Daughter s daughter, daughter s daughter s husband, Brother (including step brother), Brother s wife, Sister (including step sister), Sister s husband. 6. Tender submitted shall remain valid for 90 days from the date of opening for the purpose of acceptance and award of work, validity beyond 90 days from the date of opening shall be by mutual consent. 7. The tenderer shall quote rates both in figures and words. He shall also workout the amount for each item of work and write in both figures and words. On check if there are differences between the rates quoted by the tenderer in words and in figures or in the amount worked out by him, the following procedure shall be followed: i) When there is a difference between the rates in figures and in words, the rates which correspond to the amounts worked out by the tenderer shall be taken as correct. ii) iii) When the amount of an item is not worked out by the tenderer or it does not correspond with the rate written either in figures or in words, the rate quoted by the tenderer in words shall be taken as correct. When the rate quoted by the tenderer in figures and in words tallies but the amount is not 5

worked out correctly the rate quoted by the tenderer shall be taken as correct and not the amount 8. Before tendering, the bidder shall inspect the site to fully acquaint himself about the condition in regard to accessibility of site, nature and extent of ground, working condition of site and locality etc., conditions affecting accommodations and movement of labour & material, No claim whatsoever on such account shall be entertained by the Employer in any circumstances. 9. Earnest money will be forfeited if the contractor fails to commence the work as per letter of award and he shall not be eligible for any claim. 10. Except writing rates and amount, the tenderer should not write any conditions or make any changes, additions, alterations and modifications in the printed form of tenders. Tenderers who are desirous to offer rebate the same should be brought out separately in the covering letter and submitted along with the tender. 11. The contractor shall indemnify NISCAIR for his direct/indirect acts cause loss in any form to NISCAIR. 12. No material will be issued by the department. Contractor has to arrange all materials and T & P required for execution & satisfactory completion of this work at his own cost. 13. The issues not covered by the NIT clauses will be governed by the clauses in conditions of contract for works. The work shall be strictly carried out as per the latest CPWD / CSIR specifications of work for each item & as per the entire satisfaction of Engineer-in-charge. 14. The Contractor should confirm any ambiguity and discrepancy related to the work and tender before submitting the tender document in writing. 15. The clause No. 28 of general conditions of contact relating to Escalation is not applicable to this work. 16. The Director NISCAIR will be the owner/employer of the work and wherever CSIR is printed in conditions of Contract for Works and at other places, that to be replaced with NISCAIR Dr K.S.Krishnan Marg, New Delhi 110012. 17. Payment Conditions i) Payment will be on quarterly basis. Bill is to be submitted accordingly, at the end of each quater. ii) iii) iv) SECURITY DEPOSIT: Security deposit shall be deducted from each bill at 10% of the total value of work done, which shall be released after successful completion of AMC and no interest on deposited amount shall be paid. Tax at source will be deducted for each bill as applicable. No Claim on account of sales tax or any other tax for the material used for executing work awarded under this contract will be entertained by the Authority and all such taxes should be paid by the contractor himself. 6

18. General Terms for attending Complaints: i) The contractor / firm shall ensure a routine visit by the Supervisor / competent person on weekly basis Nodal Officers of respective locations and take adequate measures to attend to complaints on immediate basis. ii) iii) iv) All the components required for replacement will be of approved manufacturer's make as per SOQ or of equivalent quality and shall be approved by the concerned nodal officer. Besides the routine visits, any call for repair by the nodal officers or the designated person in their absence shall have to be attended within 48 hours (off days excluded) and the same shall have to be set functional within three days failing which the firm shall arrange alternative system till it is repaired. In the event of failure to attend the calls as above, contractor shall be liable to a penalty of 10% of the work value of the items in question per day of delay beyond above said stipulated grace period of three days. Penalty shall be proposed by the nodal officers and imposed by Head Infrastructure respectively at the two locations. The amount of penalty shall be recovered from Monthly bills / Security Deposit given by the firm. 19. The Quantities as mentioned in SOQ are only indicative and may increase or decrease depending upon the user complaints. No compensation of any kind shall be payable on account of diminished scope of work in consequence. However for any increase in the quantity of any item as mentioned is SOQ, contactor shall execute the same as per quoted rates. 20 Arbitration a. In the event of any question, dispute/difference arising under the agreement or in connection herewith (except as to matters the decision of which is specially provided under this agreement) the same be referred to the sole arbitration DGCSIR or his nominee. b. The award of the arbitrator shall be final binding on the parties. In the event of such arbitrator to whom the mater is originally referred is being transferred or vacating his office or resigning refusing to work or neglecting his work of being unable to act for any reason whatsoever, the Director-General, CSIR shall appoint another persons to act as arbitrator in place of the out-going arbitrator in accordance with the terms of this agreement and the persons so appointed shall be entitled to proceed with the reference from the stage at which it was left by his predecessor. c. The expression Director-General, CSIR shall mean and include an acting / officiating Director-General. d. The arbitrator may give interim award(s) and/or directions, as may be required. e. Subject to the aforesaid provisions the Arbitration & conciliation act 1996 and the rules made hereunder and any modification thereof from time to time being in force shall be deemed to apply to the arbitration proceedings under this clause.
